Brain cognitive interruption What do you recommend for injured workers, who may have lost jobs, or been on leave of absence without pay for 2, 3, 4+ years after a work place injury, wherein the employer’s vendors refuse to provide medically necessary treatments, causing also losses of homes, health, and creating permanent disabilities, with refusals to allow return to work, with or without accommodations? Just a quick comment, such as:

It’s a market ‘niche’ of more than 50 million people in the USA alone, if they survive WorkComp. Many are forced to become ‘Freedom Fighters’ and ‘InjuredWorker Advocates’ while fighting for survival against some very sneaky and formidable foes. It hardly fits a ‘consultant’ or ‘volunteer’ capacity, and such legal atrocities often leave workers with permanent disabilities, unable to perform a fraction of prior abilities.     I’ve been working since 1969….never before touched by this vile system of WorkComp until 2012…. Alrighty then:

    It has nearly destroyed my life since a witnessed slip and fall of January 9, 2012 that resulted in a traumatic brain injury, while thousands and thousands and thousands of dollars were ‘spent’ on evaluations that resulted in little-to-none medically necessary treatment. The file still churns. I’ve spent more than $30,000, and lost more than that since I haven’t been able to return to work (despite valiant attempts at accommodations, trials, pleas!)  trying to stay alive and dodge these WorkCompsters….

    It’s time for change.   Any of you who believe the propaganda that InjuredWorkers are “on the dole”… TRY LIVING WITHOUT AN INCOME FOR A COUPLE OF YEARS…. BECAUSE THE STATE LET’S THE INSURANCE CARRIERS GET AWAY WITH  NOT ONLY FAILING TO PROVIDE MEDICALLY NECESSARY TREATMENTS, BUT ALSO WITH REFUSING TO PAY TTD, THEN GIVES THEM BIG BONUSES UPON NEGOTIATED RESTITUTION…. 

    Maybe David and pals can create a “WorkCompCentral – INJURED WORKERS FORUM”….  In the interim, do check out NATIONAL ASSOCIATION OF INJURED AND DISABLED WORKERS …. all over social media…  NAIDW.org

    I can assure each of you, I’m not the only one with an axe grind and a deeply felt wish for Doctor’s Trials to include complicit vendors, including lawyers.

    It was experience in the first 2.5 years post-injury that those who profit by worker injuries are afraid to speak to us….. as it causes severe cognitive dissonance for them.

    I, myself, have been subjected to some pretty vile verbal attacks by both attorneys, info and assistance officers, industry leased/owned doctors, and by long-term alleged injured workers, who act more like industry trolls than peers in a Fight for Freedom as Prisoners of WorkComp Wars.

    Meanwhile, #InjuredWorkers ARE Uniting…we know ‘where the bodies are’….and we have clues to “who dunnit”…

    Let me know if I can be of any assistance in creating more a communication flow between both sides…. after all, we’re Americans, right? HOME OF THE BRAVE….and WE ARE THE MEDIA NOW… till last gasps….

Afterthought response…… you didn’t send them electronically, as repeatedly requested as an ADA accommodation?  Yikes.  I wonder where they are? I got all sorts of other legal mumbo jumbo Thursday…. and I still have to submit another appeal to those CorVel WorkCompsters on yet another set of ‘non-recommendations’ based on omitted medical records and their fake reports from earlier fake reports…. Geeeeze, how do they do it?  I also have  more requests for medical miles from last year, and must get copies of the recent fall ambulance and ER room bills to Fred, and I’m supposed to be learning cognitive ‘compensatory strategies’ and I ASKED YOU NICELY TO LEAVE ME ALONE TILL AT LEAST JUNE, SINCE YOU HAVE PAID ANY TEMPORARY TOTAL DISABILITY BENEFITS SINCE MAY OF LAST YEAR…..and the local crisis center Social Worker isn’t coming back till the end of the week.  Where oh where can that new pile of your file churning stuff be?

Naw, that’s time sensitive stuff that needs to get done….I just got those folders so I can see things; with the visual impairments, if I can’t see it, I forget about it.  At Coastline, they say I need visual cues, but that I prefer auditory input for best processing, however, the auditory evaluation indicated that with frontal lobe deficits, cognitive processing is impaired by what I hear, so I must have visual cues….that also makes phone conversations hard…  Maybe whatever you’re talking about is in this pile?

Happy New Year to you, too.  I’m so grateful I can write and say nice things about Matrix/Reliance, and particularly you and Stephen Buchs.  Thank you, from me, and on behalf of other Wyndham employees.  At least one of the insurance providers honors fiduciary responsiblities.

 

This is a little long to bring some of the recipients also up to speed.  The bottom line for you is, can you put my disability payments on auto-payment.  I think you know the rest of the content.

 

 

I understand you are handling my claim again, so here is an updated progress report from Dr. Hilda Chalgujian, now the primary treating doctor, a neuro-psychologist, since the Orthopedic Surgeon now says he can’t do anything about getting brain treatment, as evidenced in 2 years of asking, so he has deferred to Dr. Hilda and apparently washed his hands of my case, as evidenced by cancelled December appointment.

 

I just received Dr. Hilda’s report, dated 2/6/15; it is attached.

 

Please make it a part of my medical records.  I am copying Steve Buchs, in case he is still handling medical records related things.  (Also copying CNA and defense counsel.)

 

I have also requested an extension of the leave of absence from Wyndham until December 1, 2015.  If I can get back to work before then, I’m doing all I can to make it happen, despite the terrorism of the defense firm. Remember, the first neuro-psychologist, Dr. Kang, in February 2012, referred by Dr. DeGoede, Clinical Psychologist, referred by CIGNA EAP program, who intially referred to Dr. Esmael Septi, Neurologist, who was on the alleged MPN list, but refused to see me when I appeared for appointment in February 2012, then his office perjured when it said I failed to appear.  Anyway, Dr. Kang said that with Speech Therapy with Cognitive Remediation, I would likely have been back to work in months…in 2012.   Then the attorney moved me to Dr. Marcel Ponton, also a clinical psychologist, in April 2012.  Dr. Kang thought it was just for a second opinion and that she was continuing to treat me.  She was surprised to learn last year when I contacted her that I still had not received Speech Therapy, or any of the medically necessary treatment Dr. Ponton had requested, such as vision therapy, neuro-evaluations, EEG neuro-feedback and more.  What a fiasco.

Amy is just at the one year marker, and therefore has a shot at some recovery, and restorative treatments. If I didn’t have to fight workers comp, I might be better too.  Dr. Hilda’s comments in her report on what fighting does to me/for me are …. alarming.

CNA’s failures to treat denied me any recovery there, so now all I can hope for is “compensatory strategies’ to deal with the devasting injuries.  Hmph.  All they had to do was give me some of the requested medical care, but they couldn’t do that.   They couldn’t follow the ACOEM/MTUS/NIH guidelines.  My loss.

 

Can you set up automatic deposit for my disability payments?  I am staying in a hotel (a Wyndham property, kindly at a discounted rate by Wyndham Human Resources) so that I can attend the Coastline Acquired Brain Injury Program 3-4 nites a week.  As you know, I have to pay for it, as I have had to pay for most all the medically necessary treatment I have received to date.   I can’t rent a place yet, since it looks like the insurance carrier’s defense firm is up to more no good.  I have been advised by others to not sign a lease, even a six months lease, to make it cognitively easier to be at the Coastline program.

 

I have a social security hearing scheduled  (I will have to miss program time one or two days to facilitate that) but assuming they finally approve my claim, I will then have the money to continue the Coastline program through December.  I am also seeking financial aid to make it possible, and also scholarship money.  It seems to be my only hope left.  I’m really struggling with organizing the medical records to submit, and the Crisis Center Social Worker may come and help me again Friday; I hope so.  She couldn’t make it last week.

 

The WorkComp defense carrier is continuing with legal chicanery and what I call ‘terrorism and bullying’, and are pulling me into Court on 4/8/15 (my birthday, also causing missing Coastline program time to see if a Judge will support their chicanery; I had asked them to postpone till at least June to let me be at Coastline without their terrorism, but no, they can’t do that.  I willl ask the Judge for a postponement, even if it requires a note from the District Attorney.

 

It seems to me that CNA could simply have someone competent review the reports of prior neuro-pscyhologists and see what remains to be done before requesting a Judge to compel.

 

I am fighting still their denials to provide medically necessary treatment.  Nobody will say CNA has done right by first/second year treatment of chiropractic and clinical psychology, and 6 physical therapy treatments, and in 2014, some speech, occupational and more pt for clearly diagnosed brain injuries.  ACOEM/MTUS/NIH have a far different criteria for treating brain injury than does CNA, hence, I have been off work more than 3 years. Monsters.

 

I believe CNA or their Defense Carrier is requesting records from you.   I am requesting also that this current narrative report from Dr. Chalgujian be included.

 

I am overwhelmed by all the legal stuff I received Thursday, with more chicanery from that CorVel company, under investigations in Texas for their abuse of injured workers.  I hope California will follow suit.  They simply follow the directions of the adjuster, as I have been told directly, even though I represent myself in pro per.  They do nothing without adjuster approval, according to one of their supervisors.  They have also violated my HIPPA and ADA rights.  Not your problem, but if they are requesting anything from you, you need to know who/what they are.

Thanks Steve.  I promise to do my best not to be a bother.  I have even called my favorite prayer line and asked them to help pray me out from under these monsters to get to settlement so I can get on with my life, what’s left of it.  When two or three are gathered together in prayer, mountains move!

 

LinkedIn is also helpful.  ;D  I’m learning lots about surviving #WorkComp.  CNA’s training department has viewed my profile repeatedly, several other insurance executives, including Sedgwick.  That makes me wonder if the industry realizes that CNA’s contract for Wyndham might be up for grabs after this case, and if more like it are exposed.  It’s quite awful what they have done.  There are even Judges and law enforcment peeps viewing my profile, regularly.  I try to keep the information fresh, although I do perseverate a bit, and appear to be tangential at times…. part of the TBI.

Grancell law apparently wishes to continue file churning in further attempts of continuous harm and failures to provide medical care.

CNA insurance carrier apparently wishes to continue the breach of fiduciary responsibilities to have provided and to provde immediate, reasonable and appropriate medical care.

Wyndham Worldwide Human Resources and Risk Management staff seem to have a bad case of ‘not my job’ and continue to refuse to engage in interactive process for return to work, even though third party services were paid for in Summer of 2014, HR Director REFUSED TO ENGAGE, and continues to do so, and pretends she is in compliance, and alleges she is just following orders of legal counsel, to cover up her egregious mistakes in mis-handling of the injuries from day one, and the problems have only escalated because of the failures of many, and the unclean hands of even more.

Meanwhile, the life of the Injured has been decimated by these creatures and their willful arrogance and intent to harm, for personal gain.

See excerpts from recent correspondence below.  The audacity of requesting another evaluation is the ultimate in file churning.  The injured worker has had so many ‘neuro-psych’ tests that ‘practice effect’ is hardly a concern; Injured Worker could likely administer the battery of tests, from spelling world backwards, to counting from 100 by 7’s, blocks, drawings, stories, recalling words, name words that start with “F” and more.  WHAT A RACKET!

Well, let’s take a quick look at all the diagnosis, requests for medical care, failures to provide medical care, reports from QME/AME doctors that couldn’t get the dates of injury straight, but did indicate that treatment received was reasonable, and that due to failures to receive treatment, things are just too bad how sad for an injured female disabled worker way over age 35.   Records show reports from many many many doctors, and very few of their treatment recommendations were authorized.  After waiting approximately 1 year for treatment, injured worker procured the recommended treatments and properly submitted requests for medical miles and treatments.

MTUS, ACOEM and NIH guidelines for care and treatment of Traumatic Brain Injury were callously disregarded by defense firm and insurance carrier, and employer refused to intervene despite repeated pleas for help from injured worker.

OH WOE IS ME. NOW THEY WANT ME TO SHOW UP ON MY BIRTHDAY FOR FILE CHURNING COURT EVENT. d’OH

Dear Fred:

I am awaiting confirmation from Wyndham Worldwide Human Resources reqarding my request for accommodation for leave to be extended through December 1, 2015 while I attend the Coastline Acquired Brain Injury Program, with intent to be ready to return to work in some capacity on or before December 1, 2015.

May I suggest that the prior neuro-psych evaluations that have been ignored by Grancell be sumitted for evaluation by a third party with brain injury expertise such as Bruce Leckart or Dr. Diane Roberts Stoler, Ed.D, LLC a neuropychologist, expert witness, author, and TBI survivor. Both parties apparently have experirence dealing with insurance carriers and both, I believe, require retainers, since CNA is not reliable when it comes to keeping commitments to pay, at least in my case.

I am not happy at the audacity to request yet another neuro-psych report to interrupt my time at Coastline, and the Court hearing will be addressed. It’s quite evil to expect me to miss time from Coastline Acquired Brain Injury program to support the Grancell determination to churn this file and create more billable hours, while causing continuous harm to me, seemingly, without consquences to them. Three years out of work, temp total disability benfits terminated May 8, 2014, authorized treatment nowhere close to ACOEM/MTUS guidelines for clearly diagnosed head injuries,…..

Because of the CNA pattern of continuous harm and failures to provide medically necessary treatments and reimbursements for self-procured life-saving medical care, I have also asked repeatedly that Wyndham conduct an immediate an comprehensive audit of not only my case, but all work comp cases involving failures to return to work for over 90 days over the past 5 years. It is my hope that CNA will be absolved of wrong doing and culpable parties at Grancell will be held accountable. If it turns out the CNA is complicit, so be it, and so may indictments run wild.

I hope that the CorVel investigations in Forth Worth spill into California. I have offered my records and support to the Law Enforcement community. I have, as you may know, friviolous and dubious non-recommendations dating back to February 2013. Daniel Elliott and Kim Mall orchestrated all prior failures to provide medical care, repeatedly requested by all doctors I was sent to, without even full reimbursements of medical miles and other expenses.

I received, yesterday, an urgent, respond in 72 hours request from CorVel for additional information, dated 2/4/15. It further violates my ADA requests for electronic communications, of which Stewart Reubens of Grancell and Elena Vega of CorVel have been repeatedly apprised of. I will file another EEOC complaint to include Elena and Stewart.

Be that as it is, if I am reading the current “Modification Recommendation” correctly, CNA continues to deny the treatment offered at Coastline Community College, world reknown, and for people who have received substantial medically necessary, or who, like me, were egregiously denied medical care by a work comp or other insurance provider. Compensatory Strategies are all the hope left available to me, as I have been criminally cheated out of medically necessary treatments since date of injury. Coastline Community College ACQUIRED BRAIN INJURY PROGRAM is a 1-2 year program, at a cost of approximately $700/year, plus lodging. What bad faith to continue to deny and continue to cause me serious harm.

Furthermore, it appears that you will be authorizing the annual neuro-optometry evaluation and adjustments, as necessary. Dr. Lynn Lowell was the doctor whose report is most recent. Of course, Stewart refuses to reimburse for that medically necessary cost, as evidenced by all doctors except the 3 insurance company doctors, and the Corvel doctors. WILL YOU BE MAKING AN APPOINTMENT FOR ME WITH DR. LYNN LOWELL OF KETCHUM EYE UNIVERSITY, or will be sending me back to Dr. Eric Ikeda at the Casa Colina Brain Injury Center? Please advise.

Is there still a dispute as to the location of the brain by CorVel’s Dr. Nudelman, further delaying the bilateral hearing aids, necessary due to the cognitive deficits? A child knows that the brain is located in the head. Will you be making an appointment with the SCRIPPS audiology department for the hearing devices and training program that goes with them for the brain injured patient, as clearly outlined in the evaluations?

Apparently, the Neurological consultation requested repeateadly by Dr. Bergey and Dr. Chalgjujian and Dr. Young, for further review and EEG evaluation with “clinical correlation” is still advised. Has CNA found any neurologists with TBI expertise? Daniel never did, nor have you. I have provided you with the IME Neurology with further recommendations. Perhaps you will make an appointment for me with Dr. Michael Lobatz of SCRIPPS- ENCINITAS, a world reknowned doctor and TBI expert, or one of his colleagues.

ANY APPOINTMENTS MUST BE MADE LATE THURSDAY AFTERNOON NEAR NEWPORT BEACH through at least June, or anywhere, preferably close to home, on Friday’s.

I received a notice yesterday from the Court regarding Kim Malll’s petition for another neuro-pscyho, and I will address this soon enough. Bear in mind, CNA has ignored reports and requests for medically necessary treatment since date of injury from the following doctors over the course:

As you know, industry neurologists Dr. Kent and Dr. Zardouz are not knowlegeable about traumatic brain injury, and were grossly mislead by communications and omission of medical records repeatedly by Ms. Mall, as Dr. O’Brien is another set of circumstances all together, also implicating Ms. Mall in the egregious errors in reporting, also the very evident use of 2012 records of the aforementioned doctors, and others, to falsely suggest preexisting issues

Further reports by Scripps Brain Injury Rehabilitation program, speech therapists and neuro-optometrists and neureologists and orthopedic surgeons have also been ignored, with clear intent and success to cause egregious harm to me.

Appeals to Corvel follow, within the ten day time frame.

So, let me know what’s next. Do what you have to do. So will I. I asked that Stewart stop bothering me so that I can focus on Coastline’s programs, so I can have a shot at regaining my life. He couldn’t even do that. FINE.
