    The New York State Workers’ Compensation Fraud Inspector General said in its complaint against Guard Insurance Company a berkshire Hathaway Group company, that Dan Hohala Complex Claims Supervisor willfully and with the intent to defraud, committed fraud against the injured worker, the WC system and the citizens of the state of NY in violation of the NYS Workers’Comp Law 114.2 and NYS Insurance Laws 176.05.

    The complaint and felony charges as found by the NYSFIG will be used to hold Guard Insurance Company vicariously liable in the federal charges being filed against them in the wrongful acts committed between 2010 through 2014 against both the injured worker and on the citizens of the state of New York.
