No one should have to suffer physically OR financially due to someone else’s negligence. Being injured while on the job shouldn’t force you to make sacrifices, your standard of living should NOT change.

If Workman’s Compensation isn’t going to cover needed costs, then US workers should have the right to sue in a court of law instead of having a hearing before an arbitrator.

My husband was seriously injured at work when my son was 4 weeks old. After fighting and begging for proper medical treatment, he was completely cut off from workman’s comp. We had to apply for Medicaid for him to even receive his medications. We can barely get by on my income alone. My husband was only 26 years old at the time of the accident and will have to live with a disabling back injury for the rest of his life. This is the biggest nightmare I’ve ever experienced and I pray no one else will ever have to go through this.

If a company leaves you permanently disabled, they have to cover the costs of your life because of their malpractice (implicit or explicit) if not, the worker should be able to continue to sue the company for damages if workers compensation doesn’t work for them

I am a product of that stupid law stating that I can NOT sue my now X-Employer after being injured on the job … a very physical job at that … also because it was in agriculture my comp pay was based on 45 to 55 hours of straight time pay ( ag work does NOT have to pay overtime pay SAD but true )…. Thanks for being willing to speak up, and for sharing with others the need for Federal Intervention, in our out of control, bought out State run workers comp systems. We have had a group named ALEC, The American Legislative Education Council, go State by State, over the last 20 years, boiler plating State Work Comp and Medical Tort laws, so as to favor corporations over the individuals so called “Frivolous Rights”. When the harm is done to you, the harms is not so Frivolous, and destroys lives, all so corporate America can profit. Let’s hope our Federal leaders head the call, and step up to the plate to help patients being harmed by State systems, that have been bought out. An injury to one, is an injury to all, no matter how small or big. And if folks need to learn more about this war on the injured workers, and our patients rights, please take time to see the NPR ProPublica reports that expose this industrial insurance industry complex, for what it is. They have deicided that pain in workers comp cases needs to be left basically untreated because they claim it costs too much but then the cost ends up on SS.D. and medicare or medical because untreated pain turns into chroinc pain but if these works had pain treated at the time of injury instead of fighting for months years in the comp system designed to protect everyone but the injured worker to get them to accept what the doctor they sent you to says you need. If workers injuries and pain were treated right in the beginning there wouldn’t be so many turning to chronic pain. They would save money paying for treatments done right away over paying for more doctors Laywers to try and say it is all not needed. Injured workers would recover faster and get back to work but with the denial tactics that can go on for years the workers get worse and worse because of their denials are keeping the workers ill and injured longer and longer to the point recovery is lost and left crippled. How does that benefit anyone?

I was injured at work 5 weeks ago. No one followed procedure at work. I was never offered medical care. An incident report was not filled out for 15 days. I am being treated under my insurance and without income using FMLA. I found Tennessee recently changed its laws and no attorney is taking cases. I am sending an appeal and my understanding is I would have to deal with company lawyers and judges. Even criminals are entitled to a defense.

I live in Tennessee with recently changed workmans comp laws. I am a 53 year old nurse who suffered a back injury at work on March 31st of 2016. I have been without income for 5 weeks, unable to obtain legal counsel due to the law changes. I can request an appeal/mediation and attempt to speak in front if insurance lawyers and a judge. Even criminals are entitled to legal defense! There are no workmans comp protections for TN workers.

I am a victim also. I got hurt at Nike when a supervisor was horse playing around and was not adhering to safety standards in the shipping and receiving area and caused me to fall and injury myself on cement floor. Now I am battling the Nike workman comps lawerys who is trying to state that I have not issue and medical bills should be my responsibility. Going to fight to make sure that I am whole again. Unreal that 98% of their athletes are Black and here I am a 64 years old Black female and they are trying to discredit my injury that was caused by a Manager that did not respect Nike safety rules and now I am suffering daily for his foolishness. My husband also is a victim of a faulty work comp. process &, even though the doctors put him on perminant disability status, which he is, he can’t even get any kind of disability from KS ?because we have more than $2,000. of assetts !? Allowing worker’s comp red-tape to leave this woman, and who knows how many others, permanently crippled is despicable and downright cruel!!! Then to not even cover the costs of her treatment? I am a Director of a small privately own business. We pay an enormous amount in in worker’s comp insurance for our employees. We have had small claims without any problems. i completely understand your situation, minerva! i once burned my hand at my first job…i was being yelled and cussed at by the manager, causing me to be distracted, and as a result burned my hand with water i was running out of a bunn machine set at 300 degrees! it was assessed by a supervisor that it was my own fault for being distracted…they did pay for my er visit, however, there was nothing in the first aid kit, so when the fast food business slowed down, i had to drive myself to the closest store to buy my own supplies! also, i was told that if i left to go to the er i would be fired…this being my first job, also young and naive, i complied! i dealt with hours of pain and suffering…i not only had to work with customers, but also handled food!!! another job was as a custodian job at a school…i dealt with many injuries and even covered another custodians duties, all without getting any workers comp or even overtime! anytime i said anything about it, i was told that until i was tenured(which u have to work for 3 full years to e tenured) that i could be let go for any reason… the last job i worked at, i was an unarmed security job at a food distribution center. we had experienced a drive by shooting(this was in a bad part of town) and i had my first full blown panic attack. at that job, there is a 90 day trial period that, for any reason, they can let you go…i was 2 days from making it through my trial period when i was fired for going to the hospital! there are many employers that take advantage of their employees and things like this need much more attention and regulation that are given now…especially when the employees are young adults that are naive and dont know that much about their rights!

If a person is injured at work and cannot work due to the injury, the person shouldn’t be penalized for it. Not only do they need the equivalent pay they can’t earn from work, but they need additional monies to pay for their injury and medicines.

Billion dollar companies should be paying workers compensation, not the taxpayers. Unfortunately I’ve seen way too many hard working, honest Americans fall into poverty and have trouble putting food in their children’s mouths because of greedy companies and politicians. Why should we, the hard working average Joe, suffer because of an unsafe work environment? I too have been injured on the job and was denied any sort of compensation because of what they called a “technicality”. Thank God I have private insurance and was able to be treated promptly, but most people don’t have that luxury. I do not think every worker should be getting gobs and gobs of money, because many a time the injury occurs due to employee error and they try to scam the system. However, those who deserve the compensation should get it and shouldn’t be struggling to put food on the table and keep a roof over their families heads.

My husband also had a worker’s comp case a few years ago. When he had to come to some kind of settlement with them, he was informed by the lawyer that it is a federal law now that you can not get a lump sum payment and have medical coverage for the injury. He had to choose whether to take very small monthly payments and have the medical, or a lump sum payment.

I’m signing because my arm was crushed at the workplace due me falling after stepping into a hole in the concrete floor. I have been treated horribly by worker’s comp and the doctor I had to use who hated worker’s comp and discharged me as a patient as soon as he could. I have a 10 inch vertical non-union break and two 3 centimeter non-union horizontal breaks in my humerus, and I was released as “cured.” WC was abused for years; I know some folks who abused it. Those of us with legitimate claims should not be paying for that!

Halliburton, had their company doctor/chiropractor sign off on me returning to work the night of a broken leg & ankle, torn ACL and other injuries to my leg. This was after the criminal chiropractor viewed the X-Rays at the hospital he wasn’t authorized to be at, because he wasn’t a doctor.

We need serious new laws to prevent these criminal acts, with minimum prison sentences and immediate removal of ALL medical licenses for doctors who do this.

I hope people will wake up and realize it’s the employers that are committing all the workers comp fraud, you just hear about the employees because the employers REQUIRE a non-disclosure agreement before they settle ANY case. They tried it with me and I had them screwed because I documented everything they did from day one and burned thru $130,000.00 to prove a point! They settled the day before we were to go to court for the penalties hearing.

I have been on workers comp with shoulder and elbow injuries since 2010. My first shoulder surgery was for adhesive capsulitis. Caused from having to wait too long for treatment. This surgery would have not been needed if workers comp didn’t make me wait so long. They have 3rd party companies who have never seen me before denying that what my surgeon says I need to recover.
Once your Injury is proven legitiment. They need to stop all the roadblock strategy and take care of us so we might get back to work a soon as possible. There are too many of us legitimately injured workers hung out to dry. The system is broken.

Forced me out and did not offer modified work nor any decent worked comp only lasted short time Znow no home phone no internet may loose home and Safeway prospers and actually was bought out and anyone hurt was pushed out and not compensated and done actually suicided and I have been hospitalized for depression after being hurt working 16 years and planning to retire at a ripe age not be forced out and into poverty and put on the burden of the Government rather than workers comp and Zi thought future benefits could not be taken away but they stopped paying any treatment and the lawyer did not even get all bills paid and said I was lucky to get $10,000 settlement and some to go in a fund to replace Medicare for a small amount and lost my original medical which I was told would be same and was talked into early retirement as approsed to being set up to be fired. Ripped off and then put at Gov discrediting and in poverty in such an expensive town and fear being homeless. Cut off home phone internet Tv all extras and fear to loose home and not enough to pay for Med or decent med and no dental and having to borrow for dental work Depressing

I was injured in a wc case. My employer refused a workplace accommodation after I returned to work from a neck and low back surgery. I was transferred to the mailroom which was in violation of my FMLA. Due to their negligence, I injured my left shoulder and had to have surgery. I’m one of those workers – injured on the job (twice) I received a paycheck each period for the 2nd injury. There was no possible treatment for the first (cracked rib) but what gets ME is the lack of required preventative measures and post-injury corrective measures and enforcement – along with (as in the video) harmful and unnecessary delays for treatment due to bureaucratic requirements.

Worse, about 95% of people I have talked who have filed a Workman Compensation claim are terminated by the employer. What? It’s ridiculous that even when the Workman’s Compensation doctor tells you that you need a lumbar pillow or etc but still refuses to help pay for whatever even the Workman’s Compensation Doctor is telling you, you need. Then, you can’t work anywhere else really because of your injuiries yet you cannot survive off Workman’ Compensation . Social Security will not give enough to get by either. They will not approve anybody anymore. No matter how much you are disabled. They gave it to so many people that don’t need it and can work that there is no money left in reserve. They have more money going out than in.
My friend who had cancer and was terminal finally got approved and his first check came when they put him in the casket. That was years ago. Now he would be denied.
They don’t care about us hard working tax payers.They are too busy chasing prostitutes and stealing our money.They only worry about getting caught in their game.
The people in the position to help with the Americans that are deserving of it only want to move up the political latter. So they think that by opening the boarder to the south and allowing the worst of other countries problems with people they don’t want to jail and feed, that they will look like they care about you and me. They also want to allow terrorists in under the impression of being a humanitarian.
Our country is spiraling out of control and I feel like it will never recover. We are going to hell while our government is telling you about how good it is. How bad will it get before people demand change.

No wages as he worked for himself. He was close to death as no Dr would touch him without insurance. we were very lucky that the man who came to look at my house for sale (could not afford to keep it) also worked for a great NJ Surgeon. My guy is fixed! This Dr was willing to perform life saving surgery without being paid because ‘he cared’ and did not want my guy to die — and his story was so unsettling. Worker’s comp is a joke. I was injured at work too, and Liberty Insurance would just send me to their doctors on their payroll. Then, they would send in a new medical report to the board (all the facts except my name would be wrong) and payments would be stopped – I would have to go to a new hearing again & again. The system is designed to wear you down and make you feel psychologically just as bad as you do physically. Big companies and big insurance bully workers this way, and worker’s comp boards allow it. What a joke. There was a man who had been shot at work, and the insurance company was allowed to stop his payments with a medical report that said, “this man was injured at work because he fell…” No, he was shot in front of lots of people. Worker’s comp is a total injustice to workers who are already hurt. Blame the victim, so the big power house insurance companies don’t have to pay. They pay “doctors in their pocket” outrageous fees to send in false reports. Really Big Joke on the American Public. SAD.

I am in full support of this position because I have first-hand experience in this matter (second-hand, actually) as my husband was denied much needed surgery on his tendons in his left knee when he fell and three of the four tendons were ripped from the bone. He finally got approval for surgery more than two years later and had to go out on disability. The paycheck was so little that it didn’t do anything to help us with bills and rent! The settlement was ridiculously low for the seriousness of the injury! Please, sign the petition….

I’ve watched two close friends suffer because of worker’s comp. One signed away her rights for a tiny settlement because she became financially insolvent; the other lives with such pain that he cannot even muster the strength to go to church anymore. This young man can’t work because of the pain, but he’s been declared only partially disabled. Worker’s Comp doesn’t want to keep paying for his medications or treatments. He can fight, but these cases become all-or-nothing: take this deal or risk losing and get nothing. Federal MINIMUM standards would be a step in the right direction.

Not only do we get next to nothing and with me it was their negligence and illegal action but I also haven’t had medications paid for in the last 3years or more. The facts are clear that what Minerva has experienced is very typical in the world of injured worker versus the workers compensation process. They are on the side of the employer and could care less about the injured employee.They will drag your case out as long as they possibly can while you go bankrupt or lose everything that you have due to no income. Sadly Minerva, we don’t count. We are a burden to companies today. It has been like this for nearly 15 years now. Companies look at worker’s differently due to the stock market. Powerful CEO’s realize the more “fat” they can cut from their payroll, the bigger bonuses and stock options await them. The company’s stock price goes higher (higher E.P.S.) and more millions come “their”way.
Now I know why MetLife’s Disability Dept. was telling me to file for Worker’s Comp back in 2008. MetLife knew I was bring my case to a Court of Law. Reading your story I see I would not have had a chance to sue Verizon and MetLife and the crooked “IME” doctor, used by a “third party” company to examine you. There is not enough space here to tell you what I found out about these “IME exam’s (GOOGLE IME exam’s). The ENTIRE system is RIGGED against disabled workers. My wife wrote many letters to every high ranking politician in the Northeast East, to help us in our battle against Corporate Greed. The Insurance Company’s are one of the most powerful companies in the world. They have powerful lobbyist’s down in Washington that sway Judge’s-YES. I am going to tell you the truth and you’re not going to like it. Before this destroys your life-quit. My 20 year marriage was destroyed, Verizon did not listen to my doctor’s and did not accommodate me properly. Verizon thought it was OK that Verizon managers made the “medical” decision what was deemed accommodating ! I needed emergency triple by pass surgery to save my life at 48 ! I lost my job at Verizon and now collect S.S.D.I. because Verizon took 7 months to obtain an ergonomically correct chair for me. Verizon then lied to ALL to the Courts involved saying it “only” took 3 months. I had documents showing Verizon & MetLife both lied to ALL the Courts. The Courts did not care. I called the SAME vendors Verizon uses to obtain the chairs for it’s worker’s. I recorded ALL the calls with the vendor’s. All the vendors told me that they could have a chair shipped to lower Manhattan in a few days, a week to 2 weeks, if the chair was not in stock. A co-worker called me at home and said the Verizon mangers were keeping your chair in a closet until I could not work any longer due to my pain. The Verizon manager’s lied under oath in their depositions. You will not get JUSTICE sadly. You can not beat a rigged system. Move on, while you are still alive.

Anyone who signs this petition, should also sign the petition on this site regarding ending predatory healthcare pricing, as I believe this and the workers’ comp issue are related, or at the very least, predatory healthcare pricing certainly affects those who are left without the proper financial support by workers’ comp. Check out that petition to learn about the unsavory, dishonest, startling and un-American deal that our government has allowed the healthcare industry and insurance companies to arrange with each other. Although reading about it will likely make you think there is less hope for the success of this workers’ comp petition, as government certainly seems to side with corporations over individuals, especially when it’s a choice between siding with an entire industry of corporations over individuals, but that shouldn’t stop you from signing both of these petitions and spreading the word about the injustices that were the impetus for creating these petitions. We should always speak up when we are being treated unfairly, and especially when the government that was created to protect and serve us is doing nothing to prevent it, and in some cases, is actually knowingly allowing it.

As an employee you pay into Worker’s Compensation. The standards have been cut back drastically in to many states. A standard does need to be set. If your pace has gone on more than five years, And you’re still having serious issues, then you should file for permanent disability. Otherwise you do become a drain on Worker’s Comp. therefore draining the funds The employee is not paying into anymore. If you have worked for a company more than 10 years, The workers comp doctors should assist in getting the disability put through in a timely manor. Unfortunately workers comp, and disability does not allow you to maintain certain luxuries in life, but it should at least allow you to maintain a stable standard of living with medicine, food, and shelter.

a similair instance happened to me. I had (still have actually) bilateral carpal tunnel, bilateral epicondylitis and right deqaurveins syndrome. When I went to my surgeon he asked what was bothering me the worst at that time, I told him the right side. After many months of treatment on that side, and following a surgery to perform dequarveins release on the right side, I started seeing him for the left side (he felt it was best to treat one side at a time). Well turns out, my statute of limitations had already expired on teh right side because it was treated in a timely manner. All because my surgeon didnt feel he should try to treat both sides at the same time. I got an attorney and tried to sue for the right to have treatment on the left side, and they denied me. I never received benefits and to this day have never received treatment for my left side issues.

Except I did not receave surgey for the disableing cervical injury after fighting the insurance companys for 5 years. Then found out the judge that saw my case was not only elected with funding from the company I worked for but the insurance company as well, and on top of the the judges wife is a defence attorney for insurance companys. Conflicts of intrest? I would think so. But it does not change the facts of fruad and criminals perpatrating itself as government in this country!

I was injured while on the job at Walmart. I went to the hospital via ambulance where I received a shot of morphine for the pain. Immediately afterward I was taken to the clinic that Walmart uses for their employees for drug testing and medical evaluation. I told the people at the clinic that I was given morphine at the hospital and that it would probably show up on the drug test. Three weeks later, after going back to the clinic for Doctor visits and physical therapy, Walmart wanted another drug test because they said the first one was dirty. I already told them it was going to be dirty. I even got a document from the hospital stating that they gave me morphine. Exactly one month later Walmart called me and told me that I was fired for gross negligence by not giving them a second drug test! Well, luckily I managed to secure legal representation for the workers compensation issue. Now I need to get legal representation for unlawful termination. I just hope my attorneys are good because I just know Walmart’s will be.

To get hurt at work (like me as a Firefighter/Paramedic) and not receive pay for the entire time your disabled is atrocious! This is horrendous and some one need to stop this kind of thinking and start thinking of the person that worked for them and was injured on the job.

Something similar happened to me. Injured my leg, wasn’t able to work, took almost a year before I started receiving payment and physical therapy treatment. If I had been able to start it right away, it would have been much less of a problem, but I had all kinds of scar tissue in the muscles and tendons that cause me pain and hinder my mobility greatly. I wasn’t even compensated a decent amount. In about 2 years time I had received a total of maybe $3000. Pathetic, absolutely pathetic. This nerds to be addressed ASAP.
