No one should have to suffer physically OR financially due to someone else’s negligence. Being injured while on the job shouldn’t force you to make sacrifices, your standard of living should NOT change.
If Workman’s Compensation isn’t going to cover needed costs, then US workers should have the right to sue in a court of law instead of having a hearing before an arbitrator.
My husband was seriously injured at work when my son was 4 weeks old. After fighting and begging for proper medical treatment, he was completely cut off from workman’s comp. We had to apply for Medicaid for him to even receive his medications. We can barely get by on my income alone. My husband was only 26 years old at the time of the accident and will have to live with a disabling back injury for the rest of his life. This is the biggest nightmare I’ve ever experienced and I pray no one else will ever have to go through this.
If a company leaves you permanently disabled, they have to cover the costs of your life because of their malpractice (implicit or explicit) if not, the worker should be able to continue to sue the company for damages if workers compensation doesn’t work for them
I am a product of that stupid law stating that I can NOT sue my now X-Employer after being injured on the job … a very physical job at that … also because it was in agriculture my comp pay was based on 45 to 55 hours of straight time pay ( ag work does NOT have to pay overtime pay SAD but true )…. Now I am a product of the social security system … not enough money to get by properly BUT too much for any government assistance !!!!!!
Thanks for being willing to speak up, and for sharing with others the need for Federal Intervention, in our out of control, bought out State run workers comp systems. We have had a group named ALEC, The American Legislative Education Council, go State by State, over the last 20 years, boiler plating State Work Comp and Medical Tort laws, so as to favor corporations over the individuals so called “Frivolous Rights”. When the harm is done to you, the harms is not so Frivolous, and destroys lives, all so corporate America can profit. Let’s hope our Federal leaders head the call, and step up to the plate to help patients being harmed by State systems, that have been bought out. An injury to one, is an injury to all, no matter how small or big. And if folks need to learn more about this war on the injured workers, and our patients rights, please take time to see the NPR ProPublica reports that expose this industrial insurance industry complex, for what it is. We should not have to fight so hard to get workers comp to pay legimate bills from injuries at work. We should not have our credit ruined because of workers comp’s refusal to pay what they should. We should not be forced to lie and say the injury did not happen at work just to get insurance coverage.
Without proper standards developed there will always be loopholes in coverage! Please help get this to the right people!

I am currently undergoing treatment for a back injury which has seriously caused harm to me. I am unable to do anything without being in serious pain and having trouble to get Workmens comp to approve anything.

I’m signing because I too was first assigned to an incompetent orthopedist at the onset of my injury and he wasted 6 months of my life and complicated my situation by failing to provide the adequate care that I needed.
The demolition of the workers’ comp system is an outrage. While a state issue it’s become a national disgrace. It needs to be addressed by the presidential candidates. My petition asks Bernie to add federal oversight of workers’ compensation to the DNC platform.
So many have abused this service that now states have been forced to cut cost that now affect real needs. Sounds like the service needs an overhaul and the ability to prosecute abusers.
Workers compensation is a sham. More to protect employer than worker. No cost of living increases ever. They illegally practice medicine with their checkbook.
They have deicided that pain in workers comp cases needs to be left basically untreated because they claim it costs too much but then the cost ends up on SS.D. and medicare or medical because untreated pain turns into chroinc pain but if these works had pain treated at the time of injury instead of fighting for months years in the comp system designed to protect everyone but the injured worker to get them to accept what the doctor they sent you to says you need. If workers injuries and pain were treated right in the beginning there wouldn’t be so many turning to chronic pain. They would save money paying for treatments done right away over paying for more doctors Laywers to try and say it is all not needed. Injured workers would recover faster and get back to work but with the denial tactics that can go on for years the workers get worse and worse because of their denials are keeping the workers ill and injured longer and longer to the point recovery is lost and left crippled. How does that benefit anyone?
I was injured at work 5 weeks ago. No one followed procedure at work. I was never offered medical care. An incident report was not filled out for 15 days. I am being treated under my insurance and without income using FMLA. I found Tennessee recently changed its laws and no attorney is taking cases. I am sending an appeal and my understanding is I would have to deal with company lawyers and judges. Even criminals are entitled to a defense.

I live in Tennessee with recently changed workmans comp laws. I am a 53 year old nurse who suffered a back injury at work on March 31st of 2016. I have been without income for 5 weeks, unable to obtain legal counsel due to the law changes. I can request an appeal/mediation and attempt to speak in front if insurance lawyers and a judge. Even criminals are entitled to legal defense! There are no workmans comp protections for TN workers.
I am a victim also. I got hurt at Nike when a supervisor was horse playing around and was not adhering to safety standards in the shipping and receiving area and caused me to fall and injury myself on cement floor. Now I am battling the Nike workman comps lawerys who is trying to state that I have not issue and medical bills should be my responsibility. Going to fight to make sure that I am whole again. Unreal that 98% of their athletes are Black and here I am a 64 years old Black female and they are trying to discredit my injury that was caused by a Manager that did not respect Nike safety rules and now I am suffering daily for his foolishness. Not RIGHT!

My husband also is a victim of a faulty work comp. process &, even though the doctors put him on perminant disability status, which he is, he can’t even get any kind of disability from KS ?because we have more than $2,000. of assetts !? Meanwhile, I know people with permanent dissability status who have never had an injury in their life, can run circles around most of us & definately have more than $2,000. in assetts! The only people who are protected under today’s worker’s comp. practices are the lawyers & the Doctors, but not the injured workers.
A friend of mine has this back surgery that leaves her on all four’s. She can’t get up and screams in Pain. And NO ONE IS THERE TO HELP HER. What a Disgrace that she gave all to the State of California in as a Psychiatric Tech. and h Not received help. Yet they Union took her money they took her time and left her with nothing. She even became homeless. What an Abomination
I am absolutely OUTRAGED to read this woman’s story!!! There can be no question that this needs to change, and it needs to change right now, because it affects a slew of new victims every day. Allowing worker’s comp red-tape to leave this woman, and who knows how many others, permanently crippled is despicable and downright cruel!!! Then to not even cover the costs of her treatment? Outlandish! And if you are not infuriated by the treatment of these company slaves, er, I mean employees, then please be upset over the financial burden falling upon the shoulders of the taxpayer! The woman is right, this is NOT the bargain it was meant to be when it was implemented. How could anyone with the authority to fix this disgusting situation sit by and allow it to continue? I’ve experienced the same thing. I’m now on social security disability, broke, lost my job, my house unable to afford medical insurance not able to get back on my feet after my many surgeries. Had to go live with my kids. I just did my job got hurt doing my job lost my job.

I am a Director of a small privately own business. We pay an enormous amount in in worker’s comp insurance for our employees. We have had small claims without any problems. I would hope that if one of my workers was seriously injured on the job, they would be completely covered. That’s why we paid for insurance.
I’m am in that boat right now because I had my hand crushed in between to trailers at I work I drive for a living well I did now my hand and fingers I can’t feel or bend them and I have not a workers comp check in months so I’m fighting a losing battle I hope you make it

Worker’s Comp and employers abandon injured employees.
Wrks Comp is failing, but so is SSA disability, judges deny and delay, until the afflicted can no longer survive. Attorneys don’t get paid unless claimants win, so they do less work on More clients, hoping the will win some cases to get paid. The disabled take their lives suffering pain just like veterans who suffer!

On my job when employees get injured we are sent to a walking clinic and not by a real doctor they put you on light duty. Check you to see if you are on drugs and not care about if you are really hurting cheap way out time for you guy’s in Congress to get on the job and stop playing with us hard working people that preformed the duties and get hurt on the job and you pay a clinic to assist us with treatment
because I’m still suffering from a work related injury from 1987 and have a chronic pain syndrome that limits me from holding a job I have worked multiple jobs that I could not hold I have a life time medical claim from my injury that is void because of statutes of limitations that I was never informed of the industrial commission is not set up to protect employees its only serves employers best interest this is a one sided agency this sadens me and has had a direct negative affect on my life survival

i completely understand your situation, minerva! i once burned my hand at my first job…i was being yelled and cussed at by the manager, causing me to be distracted, and as a result burned my hand with water i was running out of a bunn machine set at 300 degrees! it was assessed by a supervisor that it was my own fault for being distracted…they did pay for my er visit, however, there was nothing in the first aid kit, so when the fast food business slowed down, i had to drive myself to the closest store to buy my own supplies! also, i was told that if i left to go to the er i would be fired…this being my first job, also young and naive, i complied! i dealt with hours of pain and suffering…i not only had to work with customers, but also handled food!!! another job was as a custodian job at a school…i dealt with many injuries and even covered another custodians duties, all without getting any workers comp or even overtime! anytime i said anything about it, i was told that until i was tenured(which u have to work for 3 full years to e tenured) that i could be let go for any reason… the last job i worked at, i was an unarmed security job at a food distribution center. we had experienced a drive by shooting(this was in a bad part of town) and i had my first full blown panic attack. at that job, there is a 90 day trial period that, for any reason, they can let you go…i was 2 days from making it through my trial period when i was fired for going to the hospital! there are many employers that take advantage of their employees and things like this need much more attention and regulation that are given now…especially when the employees are young adults that are naive and dont know that much about their rights!
Workers Comp now benefits the employer and does not give a darn about the injured worker.

The workers comp process is too long and coverage is often insufficient. Safety regulations are not enforced at many businesses, and workers suffer. Perhaps if employers are forced to pay more for workers comp, they’ll enforce safety regs in the first place and prevent injuries.

If a person is injured at work and cannot work due to the injury, the person shouldn’t be penalized for it. Not only do they need the equivalent pay they can’t earn from work, but they need additional monies to pay for their injury and medicines.

Billion dollar companies should be paying workers compensation, not the taxpayers. Unfortunately I’ve seen way too many hard working, honest Americans fall into poverty and have trouble putting food in their children’s mouths because of greedy companies and politicians. Why should we, the hard working average Joe, suffer because of an unsafe work environment? I too have been injured on the job and was denied any sort of compensation because of what they called a “technicality”. Thank God I have private insurance and was able to be treated promptly, but most people don’t have that luxury. I do not think every worker should be getting gobs and gobs of money, because many a time the injury occurs due to employee error and they try to scam the system. However, those who deserve the compensation should get it and shouldn’t be struggling to put food on the table and keep a roof over their families heads.

I’m in the boat, a back injury from a job and nothing but the pain as compensation for it.
My husband also had a worker’s comp case a few years ago. When he had to come to some kind of settlement with them, he was informed by the lawyer that it is a federal law now that you can not get a lump sum payment and have medical coverage for the injury. He had to choose whether to take very small monthly payments and have the medical, or a lump sum payment.
I have seen this in action and feel I too have been rail roaded in the past. The state supports the big business interests.

WC does not protect the employee, it protects the employer. I work for a research hospital with more than a thousand employees on my campus and the WC doctor is available one day a week.
I’m a business owner that just had an employee get the worst treatment after a car accident. Thankfully he’s able to work again. But I had to help support him in order for him to make it through. Just for him to get screwed in the end by the workers comp company. So good luck, hopefully something week come about from this.
I’m signing because my arm was crushed at the workplace due me falling after stepping into a hole in the concrete floor. I have been treated horribly by worker’s comp and the doctor I had to use who hated worker’s comp and discharged me as a patient as soon as he could. I have a 10 inch vertical non-union break and two 3 centimeter non-union horizontal breaks in my humerus, and I was released as “cured.” WC was abused for years; I know some folks who abused it. Those of us with legitimate claims should not be paying for that!

Halliburton, had their company doctor/chiropractor sign off on me returning to work the night of a broken leg & ankle, torn ACL and other injuries to my leg. This was after the criminal chiropractor viewed the X-Rays at the hospital he wasn’t authorized to be at, because he wasn’t a doctor.
We need serious new laws to prevent these criminal acts, with minimum prison sentences and immediate removal of ALL medical licenses for doctors who do this.
I hope people will wake up and realize it’s the employers that are committing all the workers comp fraud, you just hear about the employees because the employers REQUIRE a non-disclosure agreement before they settle ANY case. They tried it with me and I had them screwed because I documented everything they did from day one and burned thru $130,000.00 to prove a point! They settled the day before we were to go to court for the penalties hearing.

My father has been fighting a battle with workers comp for years. His injury has caused him physical, mental, and financial devastation. Instead of being protected by workers comp, he has become a victim of it.
So where do we go for relief when our worker’s comp falls short? We have no choice but to turn to Social Security Disability Insurance, Medicare and Medicaid for lost wages and medical costs. This means that it’s American taxpayers, rather than worker’s comp insurers, who shell out tens of billions of dollars a year to make up for the cuts. Nobody wins in this.
I’m signing because if a employee is injured on the job and a doctor states this injury was caused by a work related injury and there is no evidence of intentional injury, workers compensation insurance should pay up. It’s that simple.

Workers Compensation will make offers and they take forever knowing you will get to a point that you will take anything just to live if your to injured to work. I had to take a small offer and have got to the point i can barely walk and live. This was the jobs fault for not getting me help to lift push and pull heavy pallets when i asked. You should be able to take them back to court if your injury becomes so much worse. The system is not to help the injured. It is help for the jobs to get away with paying you nothing.

I am disabled from a work comp injury and I have to fight the insurance company for every thing I need. They wouldn’t let the surgeon that had been approved for two years do my surgery. I had to go to an unknown and there were complications .
I have also been in the position of having to give up the battle for my rightful claim to worker’s comp for a workplace severe injury. I was to sick and too exhausted to keep up the battle. Disgusting!
I have been on workers comp with shoulder and elbow injuries since 2010. My first shoulder surgery was for adhesive capsulitis. Caused from having to wait too long for treatment. This surgery would have not been needed if workers comp didn’t make me wait so long. They have 3rd party companies who have never seen me before denying that what my surgeon says I need to recover.
Once your Injury is proven legitiment. They need to stop all the roadblock strategy and take care of us so we might get back to work a soon as possible. There are too many of us legitimately injured workers hung out to dry. The system is broken.

I received workers comp years ago and two years later they tell me I have to pay it back. They should stop employers from not responding in a timely manner and letting them just fill out paperwork two years later and make the person pay it back. That is unfair!!
The same happened to me A work injury and disabled since 2000 and ridiculed and living in poverty had SSDI until this year at 66 years old and took a very small cash settlement for permanent disability not offered any other job with the company after 16 years Main part of settlement was future card for life which was retroactively recalled and blamed on Arnold Schwartenger I have had no job training and am in fear of losing my home and only medical is Medicare thru SSDI and now Ssi and does not cover any healing holistic stuff or pain management and no chiropractic acupuncture physical therapy now have Kaiser
And have had mental illness and deep depression and residual affect of bad balance and have fallen many times and now in a trick bag because the Ssi is just above limit do can not receive Food or housing assistance and no medical and company virtually off Scott free and completely intimidated me and
Forced me out and did not offer modified work nor any decent worked comp only lasted short time Znow no home phone no internet may loose home and Safeway prospers and actually was bought out and anyone hurt was pushed out and not compensated and done actually suicided and I have been hospitalized for depression after being hurt working 16 years and planning to retire at a ripe age not be forced out and into poverty and put on the burden of the Government rather than workers comp and Zi thought future benefits could not be taken away but they stopped paying any treatment and the lawyer did not even get all bills paid and said I was lucky to get $10,000 settlement and some to go in a fund to replace Medicare for a small amount and lost my original medical which I was told would be same and was talked into early retirement as approsed to being set up to be fired. Ripped off and then put at Gov discrediting and in poverty in such an expensive town and fear being homeless. Cut off home phone internet Tv all extras and fear to loose home and not enough to pay for Med or decent med and no dental and having to borrow for dental work Depressing

However with these idiots not keeping up with workers comp or employers raising income earnings in alignment with inflation, it is only making more and more of us have nothing but the choices of which rely on tax payers’ dollars. If they want us to wean or stop dependence from these forms of assistance, than people need to step up and keep their damn promises/words.

although people are abusing FMLA, if you are seriously hurt then you be protected by the workplace and the federal government.
I was injured in a wc case. My employer refused a workplace accommodation after I returned to work from a neck and low back surgery. I was transferred to the mailroom which was in violation of my FMLA. Due to their negligence, I injured my left shoulder and had to have surgery. It took almost two years of court hearings before I got the surgery. This is so disgusting and employers need to stop this nonsense and need to be held accountable for their actions.

I work with workman’s comp cases everyday. These people go through hell to get any proper or speedy medical testing, or treatment. There is so much red tape involved, and so many wind up with surgery, but not before they go through pain, and long fights with insurance companies.

I’m one of those workers – injured on the job (twice) I received a paycheck each period for the 2nd injury. There was no possible treatment for the first (cracked rib) but what gets ME is the lack of required preventative measures and post-injury corrective measures and enforcement – along with (as in the video) harmful and unnecessary delays for treatment due to bureaucratic requirements.
Regardless of your political leanings: Voting Bernie Sanders into office WILL accomplish ONE goal – scaring those left in-office into taking REAL action towards justice for those victimized.

I am in a similar situation. After 2 years of comp benefits I too have been shut off. I am in pain everyday and after one unsuccessful surgery the doc says nothing can be done. My long term disability says I should be able to find some job (so they won’t pay)but no one will hire me. So I live on SSDI & I’m broke

Being self employed I am aware of the premiums employers must pay for W.C. It is an exhorbitent expense that every American business must bear. The insurance companies should be forced to comply to the same standards when providing coverage to injured workers as states do when mandating laws that force employers to comply with w.c. regulations.
This need to be addressed FEDERALLY, especially in states like Texas, where businesses have loophole after loophole businesses can disappear into and not have to do a single damn thing to cover one penny of the expenses a worker may face if they get injured ON THE JOB!!!! This is not the first case I have heard of with the same results!! Employees need to be treated better from their employers when they are injured on the job. It is many months – mostly years – before they see any compensation…by that time they are sicker and in debt – or have gone bankrupt! So not fair!

Worse, about 95% of people I have talked who have filed a Workman Compensation claim are terminated by the employer. What? It’s ridiculous that even when the Workman’s Compensation doctor tells you that you need a lumbar pillow or etc but still refuses to help pay for whatever even the Workman’s Compensation Doctor is telling you, you need. Then, you can’t work anywhere else really because of your injuiries yet you cannot survive off Workman’ Compensation . I was recently injured at work, too, and was out of work for 6 weeks. My worker’s comp check was $350. TOTAL. For all 6 weeks of lost full time hours at $15.50 an hour. AND I now owe them $15 because they said they overpaid me!
Because i didn’t even realized that it was that bad for workers compensation, i knew it was bad but not that bad. Just wow, talk about getting screwed. You got my signature.

Because I too was denied a valid work related worker’s comp. claim. The American taxpayer funded S.S.D. programs is a sanctioned looting permitted by our own governing officials within our country. Insurance companies get a free get out of jail card of their responsibility to a valid work related injured employee and no one wants to do anything about. Millions upon millions of taxpayer defrauded-looted every single day. No one from the Inspector General’s Social Security Fraud office is really doing their job. Cruel and unusual punishment is a constitutional violation, Bill of Rights. So worker’s compensation practices must be investigated to discover why these frauds are allowed and a worker’s rights appear to be so easily neglected and violated.
I have been done dirty by work comp and the state and no help and then they don’t even want to pay for the pain management that I have to have because of the injury and they don’t pay the bill or the prescription. I have to pay out of pocket Medicare will not pay for a work comp injury and they want make them pay they take food from my family’s mouth and make my kids do with out because I have to pay for something they should have to pay for. I am also a result of this flawed Workers Compensation system. Everything stated in this petition is what I experienced. I also live under the poverity leves and if I didn’t have a son that isn’t married I would be a street per son. It took me over 10 years to be granted Medicaid. I am not one looking for a free ride as I am educated and a Registered Nurse who has worked from the time I was 14 years old working at a Dairy Queen. After I was injured I became a disposible per son. I felt that I was injured in the line of duty like one injured in the line of duty. There are so many horrible trials that I experienced. Way too much to list here. Employees don’t have any lights. There are obviously many more who are left disabled and in poverty.
I was an Insurance Claims Adjuster for over 25 years and know 1st hand the Worker really does get the short end of the stick. States’ even changed Regulations to attract more Business giving them reason to come to that State. Work Comp Courts favor the Business and Insurance Companies and not the Worker and even loss of limbs pay little to the Worker. I just feel in general injured employees do not get what they really should.

Workers compensation should be abolished. Nobody can pay their bills with workers compensation, and damn sure cant afford any of the medical bills. I also have been a victim of workers compensation malpractice. They force you to go to a doctor of their choosing, and those doctors will say whatever they want them to.
Workers compensation is suppose to help the workers when they are injured on the job. But in most situations they don’t. A worker has to fight for everything & it should not be that way. Social Security will not give enough to get by either. They will not approve anybody anymore. No matter how much you are disabled. They gave it to so many people that don’t need it and can work that there is no money left in reserve. They have more money going out than in.
My friend who had cancer and was terminal finally got approved and his first check came when they put him in the casket. That was years ago. Now he would be denied.

I too was injuried at work…2 injuries…and am not getting the benefits that I should be getting…not fair for working 20 years and now living day by day
I have also been abused by the system. When they weren’t happy with the diagnosis the doctor gave, they sent me to a doctor that would do what ever they would say. With no treatment from this doctor I was released back to work after 7 weeks. I will never be able to do the job that I was doing and have to be retrained. With no income coming in my family is in real danger of losing our house until I can get back to work.

oh boy — I feel for you and others like you. My boyfriend was permanently disabled – not as a worker – put a patron picking up his lumber. He is still waiting for compensation for his suffering. No wages as he worked for himself. He was close to death as no Dr would touch him without insurance. we were very lucky that the man who came to look at my house for sale (could not afford to keep it) also worked for a great NJ Surgeon. My guy is fixed! This Dr was willing to perform life saving surgery without being paid because ‘he cared’ and did not want my guy to die — and his story was so unsettling. He has also gotten zero yet from social security. We have lawyers for all this. Shortly, we expect justice to settle this whole thing. Heart felt prayers to all who deal with similar situations.

Worker’s comp is a joke. I was injured at work too, and Liberty Insurance would just send me to their doctors on their payroll. Then, they would send in a new medical report to the board (all the facts except my name would be wrong) and payments would be stopped – I would have to go to a new hearing again & again. The system is designed to wear you down and make you feel psychologically just as bad as you do physically. Big companies and big insurance bully workers this way, and worker’s comp boards allow it. What a joke. There was a man who had been shot at work, and the insurance company was allowed to stop his payments with a medical report that said, “this man was injured at work because he fell…” No, he was shot in front of lots of people. Worker’s comp is a total injustice to workers who are already hurt. Blame the victim, so the big power house insurance companies don’t have to pay. They pay “doctors in their pocket” outrageous fees to send in false reports. Really Big Joke on the American Public. SAD.
I am in full support of this position because I have first-hand experience in this matter (second-hand, actually) as my husband was denied much needed surgery on his tendons in his left knee when he fell and three of the four tendons were ripped from the bone. He finally got approval for surgery more than two years later and had to go out on disability. The paycheck was so little that it didn’t do anything to help us with bills and rent! The settlement was ridiculously low for the seriousness of the injury! Please, sign the petition….

I’ve watched two close friends suffer because of worker’s comp. One signed away her rights for a tiny settlement because she became financially insolvent; the other lives with such pain that he cannot even muster the strength to go to church anymore. This young man can’t work because of the pain, but he’s been declared only partially disabled. Worker’s Comp doesn’t want to keep paying for his medications or treatments. He can fight, but these cases become all-or-nothing: take this deal or risk losing and get nothing. Federal MINIMUM standards would be a step in the right direction.
Not only do we get next to nothing and with me it was their negligence and illegal action but I also haven’t had medications paid for in the last 3years or more. No reason, never went to court because there is no actual DENIAL! UNFAIR AND NOTHING I CAN DO! And lawyers seem to drop you like a hot potatoe but you must have one. So I hurt every day and so it Jills me to work but then SSI says I’m all better cuz I did work! Ugh!!
Worker’s comp insurers are typically private companies, but they are given protection by the state from lawsuits and more, all for the sake of lining their pockets and giving their investors big dividends by denying services, medications, and such for any of their patients.

The facts are clear that what Minerva has experienced is very typical in the world of injured worker versus the workers compensation process. They are on the side of the employer and could care less about the injured employee.They will drag your case out as long as they possibly can while you go bankrupt or lose everything that you have due to no income. They also delay your medical care to the pointy that by the time you do receive treatment you are probably worse off medically. This system needs to be changed.

No worker should lose coverage
I was also injured. I never received the medical help that would have clearly identified my true injury. An MRI found the damage to my spine. 2 surgeries later I am fused L3-L5. Most of the pain is gone now. I do have times where everything below my waist goes numb and cramps are a constant. We need reform. We need it now.

Sadly Minerva, we don’t count. We are a burden to companies today. It has been like this for nearly 15 years now. Companies look at worker’s differently due to the stock market. Powerful CEO’s realize the more “fat” they can cut from their payroll, the bigger bonuses and stock options await them. The company’s stock price goes higher (higher E.P.S.) and more millions come “their”way.
Now I know why MetLife’s Disability Dept. was telling me to file for Worker’s Comp back in 2008. MetLife knew I was bring my case to a Court of Law. Reading your story I see I would not have had a chance to sue Verizon and MetLife and the crooked “IME” doctor, used by a “third party” company to examine you. There is not enough space here to tell you what I found out about these “IME exam’s (GOOGLE IME exam’s). The ENTIRE system is RIGGED against disabled workers. My wife wrote many letters to every high ranking politician in the Northeast East, to help us in our battle against Corporate Greed. The Insurance Company’s are one of the most powerful companies in the world. They have powerful lobbyist’s down in Washington that sway Judge’s-YES. I am going to tell you the truth and you’re not going to like it. Before this destroys your life-quit. My 20 year marriage was destroyed, Verizon did not listen to my doctor’s and did not accommodate me properly. Verizon thought it was OK that Verizon managers made the “medical” decision what was deemed accommodating ! I needed emergency triple by pass surgery to save my life at 48 ! I lost my job at Verizon and now collect S.S.D.I. because Verizon took 7 months to obtain an ergonomically correct chair for me. Verizon then lied to ALL to the Courts involved saying it “only” took 3 months. I had documents showing Verizon & MetLife both lied to ALL the Courts. The Courts did not care. I called the SAME vendors Verizon uses to obtain the chairs for it’s worker’s. I recorded ALL the calls with the vendor’s. All the vendors told me that they could have a chair shipped to lower Manhattan in a few days, a week to 2 weeks, if the chair was not in stock. A co-worker called me at home and said the Verizon mangers were keeping your chair in a closet until I could not work any longer due to my pain. The Verizon manager’s lied under oath in their depositions. You will not get JUSTICE sadly. You can not beat a rigged system. Move on, while you are still alive.
My son is, currently going up against Workman’s Comp. due to a back injury incurred on a job site. He was a temp. worker to to do a job that three other people were supposed to do. He was hired to do a different job. He had to get a lawyer and will be going to court in May. I’m not holding my breath. He is 31 years old and walks with a cane and in a lot of pain due to collapsed disc in his back. They hired a second doctor to examine my son because W.C. did not like the first doctor’s diagnosis. It has been 3 years.

Anyone who signs this petition, should also sign the petition on this site regarding ending predatory healthcare pricing, as I believe this and the workers’ comp issue are related, or at the very least, predatory healthcare pricing certainly affects those who are left without the proper financial support by workers’ comp. Check out that petition to learn about the unsavory, dishonest, startling and un-American deal that our government has allowed the healthcare industry and insurance companies to arrange with each other. Employers need to be held accountable for injuries caused by their negligence. Worker’s comp doesn’t cover the employee and neither does the employer. It’s a free for all for the employers!
As an employee you pay into Worker’s Compensation. The standards have been cut back drastically in to many states. A standard does need to be set. If your pace has gone on more than five years, And you’re still having serious issues, then you should file for permanent disability. Otherwise you do become a drain on Worker’s Comp. therefore draining the funds The employee is not paying into anymore. If you have worked for a company more than 10 years, The workers comp doctors should assist in getting the disability put through in a timely manor. Unfortunately workers comp, and disability does not allow you to maintain certain luxuries in life, but it should at least allow you to maintain a stable standard of living with medicine, food, and shelter.
a similair instance happened to me. I had (still have actually) bilateral carpal tunnel, bilateral epicondylitis and right deqaurveins syndrome. When I went to my surgeon he asked what was bothering me the worst at that time, I told him the right side. After many months of treatment on that side, and following a surgery to perform dequarveins release on the right side, I started seeing him for the left side (he felt it was best to treat one side at a time). Well turns out, my statute of limitations had already expired on teh right side because it was treated in a timely manner. All because my surgeon didnt feel he should try to treat both sides at the same time. I got an attorney and tried to sue for the right to have treatment on the left side, and they denied me. I never received benefits and to this day have never received treatment for my left side issues.

I have a similar problem, I get very limited assistance from workers compensation. It wasn’t my fault I got injured while I was working.
The worker suffers more now than ever. These companies’ insurance companies drag their feet in getting you treated in a timely manner. This must stop.
We need to do more for the workers and make sure they get the appropriate care from Worker’s Comp and not only that but ensure the Labor Department keeps track of what is going on.
I was injured and left permanently disabled at work in 1999 and had much the same experance. Except I did not receave surgey for the disableing cervical injury after fighting the insurance companys for 5 years. Then found out the judge that saw my case was not only elected with funding from the company I worked for but the insurance company as well, and on top of the the judges wife is a defence attorney for insurance companys. Conflicts of intrest? I would think so. But it does not change the facts of fruad and criminals perpatrating itself as government in this country!
I am in the same boat, got injured at work, went into debt,& now it’s been challenging..

Something similar happened to me. I had a job of a lifetime until I got hurt. The company couldn’t wait to throw me out no matter what I did. Now I struggle on disability.

Similar situation to someone close to me. This is sickening and change is needed immediately!!! Many lives are being destroyed due to this.
I’m signing because I am tired of paying insurance companies that actually do everything they can to not respect their part of the contract. As an employer, i pay a lot of money every year for workers comp. I do expect this company to do their job when the time comes…
Working in a phisical job is dangerous and if you have a accident you need to have a standard for workman’s comp coverage.
I am disabled due to poor equipment maintenance a 900lb door feel on me at work. These insurance companies try to get out of anything they can!

The injured worker especially in Texas has been on losing end for a very long time. We need new laws that supports the injured worker and not the company
I was injured while on the job at Walmart. I went to the hospital via ambulance where I received a shot of morphine for the pain. Immediately afterward I was taken to the clinic that Walmart uses for their employees for drug testing and medical evaluation. I told the people at the clinic that I was given morphine at the hospital and that it would probably show up on the drug test. Three weeks later, after going back to the clinic for Doctor visits and physical therapy, Walmart wanted another drug test because they said the first one was dirty. I already told them it was going to be dirty. I even got a document from the hospital stating that they gave me morphine. Exactly one month later Walmart called me and told me that I was fired for gross negligence by not giving them a second drug test! Well, luckily I managed to secure legal representation for the workers compensation issue. Now I need to get legal representation for unlawful termination. I just hope my attorneys are good because I just know Walmart’s will be.
I am a victim also.
Bring back the right to sue employers.
Workers compensation is important to me. Maybe some day I’ll need it, and if I do – I wanna be helped, not hindered.

To often in on the job injurie cases the victim is the worker who faces financial disaster. because of state laws that protect the employers who are negligent in their duty to protect workers in the workplace. Employers spend billions of dollars to get state laws changed to benefit their bottom line. We need federal law to protect these workers in states that strip workers compensation laws and put an undue hardship on the working class in this country.
Because I know it’s true. The “right” to sue the employer–a joke b/c you may not make enough $$ to afford an attorney! Why not like auto cases? Contingency fees v. the employers’ insurance, what’s wrong with that? Workers’ Comp doesn’t work b/c Gopers are always defunding everything they can and WC is a vulnerable target.
I have seen first hand coworkers injured at work and denied. Because lobbyist along with the extreme right wing republican politicians that control Oklahoma State Gov. Sold out to corporations!
Workers comp is something that is so easy to overlook until you need it!

I got hurt 3.years ago also today is my birthday I’m 34 and get strong pain on my leg I was hurt during a demolition in a hordored house the guy who hired me and my friends from “All Trade Services in Chicago” told me just to take a week of while I recovered and to return to work then upon returning he fired me for the Injury he wanted some time to pass so I woulntve able to file a claim and get coverage I got left jobless and in pain with bills after almost cutting my lag off and receiving major stitches to hold my muscles together
I am also disabled (but do receive disability pay until I turn 60 and it rolls over to a normal pension) and can understand the frustration she is feeling. To get hurt at work (like me as a Firefighter/Paramedic) and not receive pay for the entire time your disabled is atrocious! This is horrendous and some one need to stop this kind of thinking and start thinking of the person that worked for them and was injured on the job.
Been there. Done that. And the same people who whine about the safety net costing too much are the same ones who are driving up the costs!
Something similar happened to me. Injured my leg, wasn’t able to work, took almost a year before I started receiving payment and physical therapy treatment. If I had been able to start it right away, it would have been much less of a problem, but I had all kinds of scar tissue in the muscles and tendons that cause me pain and hinder my mobility greatly. I wasn’t even compensated a decent amount. In about 2 years time I had received a total of maybe $3000. Pathetic, absolutely pathetic. This nerds to be addressed ASAP.
I’m in the midst of this struggle.

Workers compensation is a way to help hurt workers it should be a level playing field across the country!!!
Everyone has a right to fair and equal review of their case. No one should have to go bankrupt because they were hurt on the job.
This is my work future!
It’s the rite thing to do and I see the same results going on in one of my family members workman’s comp case.
AND THE “SELF INSURANCE” MODEL IS A SCAM…
I am struggling with workman’s comp now.
My family has had to deal with WC before. The pushing off of payments and questioning the doctors has led to severe permanent damage that could have easily been avoided.
Workers have rights and big companies and insurance are always the winners!
My wife went through the same thing.
