That person who allegedly ran for insurance commissioner a hundred or so years ago accused me in 2014 of being an industry shill because one of her drones lied to her and said that she never talked my ear off on June 14, 2014 at 5:36 pm for 57 minutes and 47 seconds (my Smart Pen keeps track of things for me…and it was new to me at the time…). She and her pals sent threatening emails to me and more about me at that time, too.
They repeated that process in May 2016, and continued the threats, defamation and attacks via emails and right over there on LinkedIn, making it real easy for the investigative reporters who are friends of Injured Workers to say;
‘Whoa, don’t need this sh*t…. that chick is nuts! That’s why hardly anybody will bother to write about Injured Workers; time wasters’
Back to that gal who allegedly ran for insurance commissioner and her drones— they ruined yet another opportunity for a few investigative reporters and other influencers to learn more about injured workers and interact one on one. They were invited guests to my thread, and they have since been blocked on LinkedIn and here on Facebook. You can see their incoherent ramblings on a few of the industry blogs….one goes on about the Confederacy or some such ‘conspiracy’ that broke workcomp.
They just can’t fathom that the WORKCOMP system is NOT BROKEN, it is working AS IT WAS DESIGNED TO WORK. GET OVER IT, AND GET OUT OF IT, OR RIP.
Could this prank or threat be more of their work… Siri said the IP was a corporate account…??
[Did you see that movie, “Hackers” – I think was the name, a documentary that said hackers are more dangerous than nuclear warfare. It was a heavy flick, It was mostly about government and corporate hackers… you know, the real dangerous crowds. I can’t say I agree with that, nuclear annihilation is pretty terminal…I will have to watch it again if I can find it… I saw it in 2014 or 2015]
Most all that disinformationists’ team were evicted from my groups, to the best of my knowledge, but who knows how many people they are running around telling that I work for the industry? The industry probably cringes at that thought, too! DePalo wrote in another of his articles before his apparent new benefactors hit the scene:

But they, whoever they may be,  may have crossed a line with this screen shot, if it was them. Whoever it was, if you’re part of that crowd, your stories of learned helplessness are not the point of the collection of stories…. the anonymous collection is for people who value freedom and health and civil rights and human rights, and want theirs back.
It’s not for people perfectly content to die lives of quiet desperation on their knees, begging for government intervention and rescue. For those, there is no hope. Have interesting lives in the great outdoors.
The laws are already in place. No trail blazing required there.
LAW ENFORCEMENT IS SADLY LACKING, AND CORRUPTION AND MALFEASANCE AND FELONY FRAUD SEEM TO BE THE REAL ISSUES, STILL GUARDED BY THE PROFITS BEFORE LIVES CROWDS.
REMEMBER, WORK COMP IS NOT BROKEN…IT’S A MEGA BILLION DOLLAR INDUSTRY…INJURED WORKERS ARE SIMPLY FUEL AND FODDER. Get that, and get on the road to getting your human rights back.
Over on LinkedIn I have connected with some people of influence, and I will see what I can do to check out the real threat of these issues further. Enough is enough.
The only other peeps I know of who are in a tizzy about those questions in What’s YOUR WorkComp Story are the Sedgwick peeps…they kicked me out of their LinkedIn group, “Sedgwick Institute” after I submitted the questions to them, and asked if they might want to add any questions that could support their purported intentions to improve WorkComp processes.
By the way, my first set of questions were simpler and nicer. The final draft was based on INJURED WORKER SUGGESTIONS to hit hard with tough questions. So there you have it.
As you know, WorkComp Central started with their national piece, “Assume Responsibility” disparaging diatribe in early May 2016, that included links to several of my blogs and did a whole bunch of name calling (big words I had to ask Siri to look up definitions… See my blog on ‘Accused Vociferous WorkComp Militant Opinings..’ ) DePalo’s peers had some good chuckles at his over the top/over the edge attacks on me and others in the Injured Worker communities. My professional friends laughed out loud!

People keep telling me not to take these atrocities personally, that CNA is doing this to all injured workers.  They say the law allows it.  I don’t think so.  Fraud is a felony, that means it’s against the law.

Anyhow, attached is a voice mail message with Fred Sachs.

IF you guys can organize comp rooms at the Ramada Inn-Newport Beach on Superior Avenue, starting next week, I still have a chance to resume Coastline Acquired Brain Injury Program.  Without such help, I cannot return.   I’m not asking for an advance on anything because the $5,000 you provided in January to pay for lodging,  Matrix called it “income” and says it gets ‘subrogated’ and I am paying that back to them.  I tried to explain that it for treatment, so in essence, you gave Matrix $5k, not me, I was apparently just the intermediary.   I hope that doesn’t make me complicit in some sort of insurance con-job. Yikes. So, Tina Jordan or Michael Doughtery may be able to provide lodging so I can return to Coastine and you can figure out how to pay.

Without Coastline, I would have to say you have succeeded in fully destroying my life.  I know you don’t care, Shane Reideman made that very clear last fall when he called and asked me, “Tell me, Linda, when ARE you going to die?”

So, are we going to mediate with Judge Siemers?  I understand he is the only Judge who can deal with a case of this complexity?

If I’m not going back to Coastline, we can mediate with Judge Simers any time.  Looks like I have the rest of my shortened life span to fool with Workers Compensation, and perhaps make a difference to my fellow Americans.  If not, I die trying, huh? (Shane, happy now?)

I told the intermediary that I don’t fly,[radiation levels way too high, if you read the news] but I could drive to SFO (would need a rental car, per diem, and lodging) but that would be my compromise, or perhaps the Judge come to Los Angeles.  His CV is outstanding.  I might be able to trust him.

I need the CNA list of what has been paid to me.  I’m almost out of time to appeal their demand for a return of more money than even they gave me.  They have edited their calculations a few times. Le’s find out where that allegedly monthly payment of approximately $4,000 since May 2014 has been diverted to? (Shane, is that the type of fraud your department handles??)  Would you believe they even sent the initial retro-pay to a dead back account, even though my SSA retirement money had been coming to a different account for over a year?  The Treasury agent found that of extreme interest.

ps… So, if the below is true, then there is some validity to the CNA rest and rest and rest and rest and wait and wait and wait approach to ‘treating’ a traumatic brain injury for more than 3 years 7 months, huh?  No wonder I wake up ready to take on the world for the first hour or two of the day.!  Thanks guys and gals!

C’mon, I want out of WorkComp, I want the 15% legal fees to be donated to Coastline Acquired Brain Injury Foundation, and I want a reasonable settlement to enable me to forget I ever crossed paths with any of you  Oh, yes, I want some sort of restitution program by Wyndham/CNA/Grancell to ensure they never have the opportunity to harm another injured worker like this again.   Maybe I can be on the Board of Directors of such an organization.

Stewart, can you have someone look into setting something like that up?  Thanks.  No rush, looks like we’re going no where toward settlement, so there’s time…. since no treatment cut my life span by more than the 8 initials years estimated by the Brain Injury Association of America, looks like we have maybe another 10 or 15 to use the media to make a difference in America?  We’ll, let’s try.  COUNT ON ME to do my part!

Have a great day, Everybody.  I have no place to be…oh ohhhhhhhhhh…. the piano tuner is coming today.  I read that playing the piano is supposed to help with brain recovery so as Stewart and Fred know, I bought a piano last year, or maybe 2013, I don’t remember.  I didn’t realize, at the time, I had to learn to play it for it to be effective.  A local piano teacher had me is some very simple VERY SIMPLE VERY SMALL CHILDREN’S BOOK.  She was kind, but aghast at my cognitive impairments.  Most of the kids she teaches start with two very simple books.  We had to break it down to just one book for me.  I guess if I don’t really get to return to Coastline, piano lessons are back on the agenda.

Fred, wanna pay for them?  There’s also a company called LearningRx…  There’s help out there for people with brain injuries, I just don’t know how Thomas Motamed can run an organization with people in the dark ages about something as simple as NEURO-SCIENCE.  He takes in $10.7 million plus a year for harming people like me? Yecccch.   At least at Grancell, peeps get “Bagel Fridays” and at Wyndham, well, if you’re on the A-list, you get credit-worthy tours.  It all comes out in the wash, doesn’t it.

Few studies discuss the true causes of the absolute failures of the Grand Bargain, known by  injured workers as the Grand Work Comp Fraud.

As evidenced at Doctor’s Trials of Nuremberg, when doctors are criminals, there are grave social problems. When the criminal activities of doctors are supported and protected by criminal lawyers, the problems are compounded for all concerned.

No, we don’t need more studies. All involved know the truths of the atrocities. But, if more studies are desired, begin to study how cops and firefighters are tortured and abused by the WorkCompsters when injured on the job.

Think harder and include the plight of injured veterans, being denied medically necessary treatments and “incapcitation pay”  while self righteous  and arrogant psychopaths allege the horror stories are exceptions rather than the rules of the work comp killing games. 

When doctors and lawyers and judges and their ilk breach oaths of office…  take heart in knowing there are others who take their Oath seriously,

The more I think about this legal chicanery… and the defense’s new demand for access to 25 years of medical Records, when they have ignored medical evaluations, recommendations and requests for treatment for the past 3 plus years, it sort of feels like a quote strip search unquote in a fascist gulag.

Another pathetic piece of this drama is that had work comp provided immediate reasonable and medically necessary treatment, the possibility of return to work in the first several months existed. the failure of #CNA to provide medically necessary treatment and their continued failures is simply a pattern and practice of cause and continuous harm in breach of fiduciary responsibility…

Not saying all doctors in WorkComp are horrible creatures; many have left the industry for private practice.  It is said that some have ‘retired into’ WorkComp evaluations.

Better guidelines for QME/AME designations, along with ethics requirements and recordings of evaluations of all injured workers for at least the next ten years must be considered in order to save lives and indict criminals.  Let’s have fresh trials, and stop history from repeating itself in America.

When doctors are not held accountable for false reports that cause harm and death,  written for profit and with intention to deny medical care and worse, something’s rotten in the system. When doctors can willfully change dates of injuries in order to use earlier medical reports to falsely substantiate ‘pre-existing’ conditions, something’s rotten in the system.  When the System itself allows for ‘secret reports’ and hefty payments to doctors who can’t even get a date of injury straight, something is rotten in the system.

Does anybody have hard stats on WorkComp in America?  At the recent #WorkCompCentral #CompLaude Gala, it was mentioned, if memory serves sufficiently, that approximately 15% of injured workers in America are unrepresented..

  • If that math is correct, that’s about 8 million — UNREPRESENTED INJURED WORKERS.  
  • It does not count the ‘poorly represented’ injured workers!  WHAT ARE YOU DOING FOR THAT MARKET SEGMENT?

Insurance companies here are paid big bonuses for refusing to pay disability benefits, provide medically necessary treatments, and they seem to use any means necessary to shift cost burdens to State and Federal Agencies, before people enter the ranks of homelessness and incarceration.  Same insurance companies are on a 3-D plan, DELAY, DENY, DECEIVE, approved by volumes of useless laws?  Employers can willfully refuse to engage in interactive process for return to work discussions…FOR YEARS!!!  d’OH!  Without consequences? Hmph.

Apparently, there are ‘Tea Parties’ and ‘Tea Parties’ and “Tempests in Teapots?”

Often, #InjuredWorkers make poor choices in retaining legal counsel, and many have retained 2 or more, leaving them defenseless, since incompetence in the legal fields allows dismissed counsel to place a lien on the WorkComp claim, rendering it useless (i.e. unprofitable) to further counsel.

If 15% of the InjuredWorkers in America are currently unrepresented, 15% of 54 million is 8,100,000 at any given time.  Many of those InjuredWorkers are too sick or medicated to fight the good fight, and many will simply join the ranks of the homeless and prison population and cemetaries.

Does YOUR STAFF understand the rights of flag-waving InjuredWorkers, In Pro Per, or is your staff increasing risk of malpractice complaints against your teams?

This case has several instances of WorkComp provider staff telling this injured worker that they can only take directions, requests, medical records, complaints and correction directly from the Defense Counsel, or adjuster, if unrepresented. The perjured Proof of Services and responses to proofs of services are another issue that causes egregious harm.

Really?  How interesting.  Does the ACLU agree with that interpretation of Civil Rights and Labor Codes?  Does the DOJ agree?

What’s up?  Do we have a status on Brain Injury Rehabilitation Day Program Start up yet?  TIC TOC  CHOP CHOP  It was finally approved by the WCAB UR Appeal process on July 11, 2014… (Yeah, I know, the doctors recommended 3-6 months, and the approval was modified down to 1 month, but we can fight later about that) so let’s go.

Yesterday, SCRIPPS advised they had not yet heard from Daniel Elliott, CNA Adjuster.  I politely suggested they go directly to you, for reasons we both know.  So, maybe word today?

Did you have a chance to review the approximately 300 more pages of records that were provided to Dr. Holmes by the Claimant, in pro per, since your firm forgot to send an update of records and medical records index to either Dr. Holmes or claimant prior to the Orthopedic QME?

The SUMMARY PAGE of the series of unfortunate events followed by more unfortunate events that have contributed to failure to provide medically necessasry treatments for more than 2.5 years seemed to have your name all over it.

Learning Services; CNS  Centre for Neuro Skills are standing by, and Casa Colina is another option, or just send me back to Jaudy Treatment Center, it’s all scientifically based, but the doctors like to be paid, not stiffed.  You’re welcome, I know you are busy.

Oh yeah, the invitation is still open for mediation.  I have also self-procured piano lessons….We’re on the kid’s book, and going very slow.   At first the instructor didn’t think I really have a brain injury because I ‘look ok’….. I don’t even get to use two books, like her under age of 10-kids use…. I’m in the first book, and we go slow, real slow.  But, it’s mathematical and scientific and said to be a good treatment for people with brain injuries…..So, till my employer decides I’ve been on the rest and wait program long enough to be provided with medical care, I’ll keep muddling along.

OH, my creative, therapeutic blogging is coming along nicely too, and I always feel better after I do a little “Ain’t it awful, WORK COMP” rant.

ok, I know I know…..we’re not pen pals.  Just checking on status of SCRIPPS.  MY BAGS ARE almost PACKED AND I’M READY TO GO.
