Friends in the industry have suggested that I do what I can to initiate mediation toward settlement.  I have done all I can do for a few years and have been merely insulted in addition to further injuries.   It’s hopeless for me to try to deal with these people, even though Workers Comp is supposed to be an “Exclusive Remedy”….. it’s a farce.  That’s a given.

If you and Michael Dougherty et al all want to approach the carrier and defense firm, I would be open to mediation in Los Angeles, but I won’t suggest it to them again.

They are copied herewith because that’s apparently the law, according to Stewart Reubens.  I have been evaluated by approximately 40 doctors in person, and how more have reviewed records? Defense has enough evidence; they know what a brain injury is, and what my future medical picture could look like, and how they have successfully and dramatically shortened my life span, and continue to do so.

You and Michael might want to have them submit a proposal to me, that I can review with someone who is not in an adversarial position against me, and perhaps we can settle up.   If not, well, when nothing changes, nothing changes.  I am open to anything reasonable.  $100K was offered in November 2012 when the extent of injuries was obfuscated by refusals by the carrier/defense to authorize specialty evaluations and treatments.   I was 59 when the injury happened. I think, based on my experiences of each of them,  Grancell wants this to be a till-death-do-us-part claim term.

It’s more profitable for the law firm.  If Teddy Synder, Esq.  would mediate this case, I have been watching her posts for quite a while.  I don’t sense that she is owned by the industry, so I would imagine she could mediate this case.  You or Michael could check with her office?  Or ask Fred Sachs to?  It’s not in Grancell’s  financial interests to move this case anywhere; they apparently gets paid no matter what, huh?

Remember, I have been seen by approximately 40 doctors, and I did not get reasonable nor appropriate medical care at the time of the accident, not even an offer for a ride to the emergency room after my manager helped me up after laying on the ground for who knows how long, and I needed help to get up, and I was very dazed and confused.  The sales meeting happened shortly after that, and everybody had a good laugh about my fall.  I had a 9 am tour.  All I remember about it is apologizing to them that I was confused, and that I had fallen on the ice earlier and hit my head, and they were owners and didn’t want to upgrade, so with apologies, I remember saying, “Let’s get your gift.”  That’s was probably their favorite ever update.

It was after that that the admin manager asked if I was going to see a doctor and I recall saying, “Yes, do I have to see any special doctor?”  He said, as I have often quoted, “Just see any doctor that takes workers comp insurance” and gave me an incomplete DWC-1 form, without any insurance info on it.   I called a local chiropractor and asked if he accepts work comp and the office said he did.  So down the icy mountain I drove, God only knows how; I don’t remember any of it.  I do remember getting to the doctor’s office just before 5, so I don’t know why it took so long to get there.

I thought I just needed an “adjustment” and that I would be fine. The doctors said I had a concussion along with the mis-alignments.  He said I would probably feel like I’d been hit by a truck in a few days, and he was certainly right on that.

I didn’t know what a concussion was, I just knew I couldn’t think anymore, and my eyes looked like, so the office told me later, that ‘nobody was home”.  I had trouble speaking immediately, and the receptionist was often exasperated by my huge challenges to make a simply return appointment.

I called EAP, and they sent me to a LOCAL clinical psychologist, Dr. DeGoede.  While waiting to see the clinical psychologist in a few days, I went to the Urgent Care, using my CIGNA employee health benefits, and CIGNA even had to fax my ID card to them before they would see me. So everybody knew it was a WorkComp injury.   I got lost going there, I was very tired, they said they couldn’t see me till they had the CIGNA card, so I told them I would go home to sleep and asked them to call me when they got the fax.  I got lost going home (about 5 miles away) , and returning to the office. It  was not part of the alleged MPN at the time (I knew nothing of an MPN still) but he has since benefited financially by becoming a referral member.  It was the Urgent Care doctor who prescribed the MRI of my brain, which I got and paid for with a $371 co-pay with CIGNA insurance.

The clinical psychologist referred me to a local neurologist, who turns out was on the alleged MPN, but refused to see me when I appeared, with the hand written referral letter.  That neurologist’s  office perjured later and said I failed to appear. I begged for help or a referral to someone who could help.

CNA had no neurologists nor neuro-psychologists, (apparently still don’t) so they relied on Dr. DeGoede’s rollodex to find Dr. Eileen Kang, Neuropsychologist in Fullerton.   She didn’t know the neurologist her office referred me to at the Orange County Neurology Center, but they could see me within weeks, not months, due to cancellations.  I’m sure that neurologist gets plenty of cancellations.   He wanted me to drive, sleep deprived, more than 100 miles each way for an EEG in his office.  I asked then adjuster to get me an EEG closer to home, and a neurologist closer to home (this was about 2 hours away, and I was in no condition to be driving period, let alone driving sleep-deprived.  That’s when I began to think, “LOOK, I’M INJURED NOT STUPID”

As soon as it was clear I had a brain injury, then adjuster terminated benefits (April 2012; injury was January 9, 2012) .  Remember, the first adjuster, while I was represented, accepted a call from me and told me if I was NOT represented, he would help me get medical care. It sounded to me like that was the only way I was going to get care, and since the law firm didn’t under grasp that the brain is a body part, and not a “psych-component” I was willing to work with him.

That’s how we got the initial evaluations, until it was too clear for CNA that they had a brain injury case.  The first law firm I retained there was no attorney supervising the office manager who sent me to the first orthopedic surgeon…. I think you know how it went from bad to worse from there…..Remember, upon confirmation of brain injury is when all the reallly bad stuff began to happen.

CNA never even authorized an MRI of my brain and took over a year to payback my CIGNA co-pay of $371, and actually, apparently doubled paid the provider. They never provided the neuro-optometry evaluations requested repeatedly since 2012, nor will they schedule the one authorized this year.  They refused to reimburse for self-procured neuro-optometry and lenses and vision therapy.

The auditory processing piece recommended at SCRIPPS includes a software program for approximately $100 bucks for auditory retraining, to go along with the proposed hearing devices.  CNA refused to get the cognitive remediation therapy repeatedly requested, they refused to even get a speech therapy evaluations and I didn’t get speech therapy till August 2014, when SCRIPPS was authorized for a fraction of the time medically necessary.  We all already know the rest of that story.

Remember, it’s not loss of hearing at issue, it’s the auditory PROCESSING, like it’s not vision at issue, it’s the VISION PROCESSING.  It’s a brain injury.  The brain in command center. I have not seen an endocrinologist nor have I had any ongoing treatment other than acupuncture, which has measurable results.  I suspect it will be necessary for a life-time, as I have experienced extreme dizziness and nausea if I go too many weeks between sessions, as happened in recent weeks.  I’m back to a weekly plan, for as long as I can afford it.  Chiropractic, self-procured for pain management, and also in conjunction with right shoulder mobility, takes place several times a month, no thanks to CNA.

The Orthopedic issues have always been secondary to the brain injury to me, and acupuncture, self-procured since August 2013, is the only ongoing medical care I have received, with measurable improvements that have also eliminated the suggested need for right shoulder surgery, although the defense apparently resorted to extortion to convince the PTP to falsely state the right shoulder injury was “Non-Industrial” when a fast glance at the Crowe-Paradis future medical piece clearly showed the right shoulder, the need for further MRI’s etc. Defense resorts to chicanery; I stand in truth.   When my manager helped me up from the ground, heard my response to his question, “Are you ok?” and I said, “No, I’m not. I hit my head reallly really hard” the direction Grancell has taken this case is dubious, at best, but I don’t think Stewart reads much, and I suspect there is some serious CYA happening.

I got an EEG in 2012, because the adjuster threatened me that if I did not get one by March 30th, he would terminate my benefits.  Defense likes to show that as an EEG of 2010, because of the doctor’s typo on the cover letter, which clearly references the 2012 evaluations and the actual EEGs show the 2012 dates.  Obfuscation with intent to deny medical care has been continuous.  That EEG was omitted repeatedly, moved around the medical index from 2012, to 2012, then separated and scattered about…. to ensure falsehoods of ‘pre-existing evidence of EEG’ had some plausible deniability to the staff’s writing reports for the doctors in question.

It took till 2014 for CNA to get an EEG for the 2012 brain injury, and then they refused to have a follow up, as recommended by the neurologist, to have a doctor review the EEG with medical records.  I have spent more than $43,000 to survive the Wyndham WorkComp plan, and the only real progress I have made is my sheer will to survive, and the compensatory strategies I am learning at Coastline Acquired Brain Injury Program (since October 2014).   Fellowship with other Brain Injury survivors is also very helpful in accepting this “new normal”…. everybody in my class is exceptionally intelligent, and we all have different struggles, depending on which brain lobes are involved.   Based on my symptoms, all of lobes are involved.  It’s not just that I get a little dizzy and some headaches, believe me, it’s not just that.

You see, if I had received medical care at the beginning, and as recommended and I was stuck with these cognitive deficits, I would shrug and say, ‘bummer, let’s work around it”…. but because I am a victim of  what appears to be aggressive criminal conduct, with intent and success in causing permanent harm to my brain,  for the profit of several/many people, not only do I have to fight to work around my cognitive impairments, I have fight to stay alive, and the legal stress and the financial stress are of some of the worst things that a Brain Injury Survivor can deal with.

In 2014, a structured settlement guy attempted to open lines of communication with the carrier toward settlement and/or mediation, I also asked both the 2 adjusters and current defense counsel to engage in mediation.   I sense they threatened him because he never provided me with anything that looked like he had done anything to determine the numbers, and actually just relied on my guestimates.  In a face to face meeting, he actually snarled at me and said, “THEY WILL NEVER TALK TO YOU.”

“Yikes, ok, Dude, chill.  Nice to meet you, too.” was my reaction.

It was suggested that I do the math myself and propose a settlement number.  I know they have computers to sort that out, and I gave it my best shot at $700,000, and after attending the SCRIPPS 9th Annual Brain Injury Conference in May 2014, where I learned of the long term risks involved in my injuries on top of current impairments,  the estimated number rose to $1.3 million, also considering shortened life span from the initial fall, and the continuously shortening of my life due to the failures to have been provided with medical care, and all attempts at self-procured care interrupted with threats by the defense counsel.

My efforts were met with further insults to injuries.   Not only did they just say “No”…. a representative from the Carrier actually called me, said he did not care that I haven’t received medical care for more than 2.5 years (at the time) and then asked, “So tell me, Linda, when ARE you going to die?”   A while later, the defense attorney, in a politely framed but completely vile agenda suggested that since I am so challenged in dealing with the legal processes (pure chicanery in my book!) of Work Comp, that I consider a Court Appointed Conservator.  Combined with the omission of medical records, false statements to doctors with intent to deny medical care, and causing permanent and irreparable brain damage to me,  I have no interest in anything from them other than an immediate and reasonable settlement offer.

If you and Michael Dougherty, on behalf of Wyndham, pow-wow with the Wyndham agents, CNA and Grancell, perhaps you can encourage settlement or mediation.  I have no reason to believe they will act in good faith, as they have not done so from the very beginning.  Remember, they terminated benefits in April 2012 upon confirmed diagnosis of brain injury, which could be considered a criminal act.  Yes, I know they can work around it.  The truth is what it is regardless of lies surrounding it.

If I keep trying to edit this to make it shorter, I will keep adding to it.

In addition to the points of the earlier email, an extension to my leave so I can finish up at Coastline  (last day of program for 2015 is December 10)   I am hopeful that by then I can return to work with minimal accommodations, and if you’re willing, we can plan on a transition return to work while I am still at Coastline (full 2 week training, then back to 2-3 days at Coastline with 2-3 days on the sales floor, with an aim to be full time and well equipped for high season, starting December 14th-ish.

This is the longer version so that if you and Michael want to approach CNA and Grancell with a request for mediation, settlement and or claim audit, you have plenty to work with.  [Ditto for any Civil Rights Litigation Firms!]  You don’t have to be a lawyer to see the problems in this case.  I wish I could speak like I can type, but I can’t.   I used to be able to.   My speech is improving, it is much slower, but as a sales person, I do my best to make it appear that I am being pensive and deliberate as I search for words and untangle my thoughts.

Fifth Amendment or Fifth Attorney – WHAT DIFFERENCE DOES IT MAKE IN WORKCOMP?

Thank you again for the hotel discount vouchers. I am heading out to Newport Beach shortly, but I had promised Stewart Reubens of Grancell that I would respond to his recent emails by today. That was compounded and exacerbated by the unbelievable denial of medical care out of Maximus, the California ‘end of the road’ agency. The doctor received ex-parte records and he was either off-his-meds, had too many martinis, or might be subject to drug testing or else? I found other reports by the same doctor on the internet.

Maximus personnel was very nice when I told them we have a problem with the report as the fraud is egregious. They told me on Friday to send a request to them for reconsideration before sending it to the the WCAB appeals people. This is it. It is my experience that when dealing with WorkComp legal/medical fraud, facts mean nothing to the perpetrators, and legal chicanery prevails. Taking matters to the Virtual Streets seems to be the one and only hope for injured workers. My list of fraud allegations and perpetrators is long indeed, provided, in part, already to the FBI – Palm Springs Office.

Well, that’s another quandry, as it is somewhat out of synch. Before I hit the road, I will try to respond in this letter to both Stewart Reubens and the Maximus help people, and copy “supplemental people” as Stewart calls them, and I will put it on the internet as well.

As I looked through it all, I remember that in 2013, CorVel had authorized modified care to include a couple acupuncture and chiropractic treatments, but Grancell again refused to set up those appointments and the Judge had to tell Ms. Mall to just do it….that took about 9 months. Ms. Mall, the first Grancell attorney, has a knack for telling whoppers, and she is the first to incorrectly tell doctors that I had a head injury in 1993 and another in 2008. No doctor until January 9, 2012, Dr. DeGoede whom the CIGNA Employee Assistance Program sent me to is the first I had ever been diagnosed with a brain injury. In the reports to doctors that Grancell is now attempting to have me evaluated by, Stewart is telling them of his opinion (non-medical, based on no medical evidence) that I have had previously diagnosed brain injuries and treatments. They both, Kim and Stewart, lie when they say I withhold info of a car collison of 1993 and 2008. Both I recovered from, and neither had ever suggested a head injury. Kim and Stewart seem to like to practice medicine at my expense.  They also like to put the 2012 EEG report of head injury to falsely show it as a 2010 report of head injury, although the doctor apologized for the mis-dated report, but any thinking person could read the report and see it was in fact done in 2012.  The doctor was not even in California in 2010, when Grancell attempts to mislead doctors.

The Maximus report I received last week falsely states numerous things, including what appears to be a set up for a fraud investigation at my expense. Somehow that doctor says the right shoulder was the primary industrial injury and that the injured worker [me] did not report a head/ brain injury until weeks later following an incident at home.  They disregarded the medical records I provided, and just seemed to follow exparte communications,

Well, that’s further insult to further injuries. Take a look at the DWC-1 form that I was given on January 9, 2012, without any insurance information on it and see what it says about hitting my head real hard.

These actions are quite similar to the deceptions caused by Ms. Mall when she omitted approximately 300 pages of medical records to QME/AME doctors in 2013, and encouraged them to falsely opine prior head injuries, moving the date of reported injury not weeks, but into the future of 2013, and they used medical records of 2012 as ‘evidence of pre-existing head injury’.  When brought to THEIR attention, those corrected the date of injury on their report, but not their false allegations, nor did I get any of the recommended since January 2012 medical treatments.   UFB, for sure, but it has kept me from medical care over 3.5 years, and has kept the legal/medical files churning, to the point somehow Grancell got the Judge to authorize even more evaluations.

The Exclusive Remedy and Labor Code of California does not say insurance carriers are to provide evaluation after evaluation….it is allegedly about providing medical care as an exclusive remedy to civil rights and law suits.  It apparently requires DOJ/FBI/DA intervention to help companies like Grancell with proper interpretations of the law, and perhaps RICO support.

Now, I have provided the Maximus report to my State Senator and have asked for intervention to involve the District Attorney – Corporate Fraud Unit and the FBI for similar task force. I am hoping that Michael Grabell of ProPublica is tracking what I send, or perhaps Ana Garcia of Los Angeles is another investigative reporter that may become involved.

So, for the record, I have asked Fred Sachs, CNA Adjuster and Stewart Reubens, Defense counsel of Grancell Stander to cancell all the appointments that were in violation of my right to be heard by the Judge at WCAB with ADA accommodations (first they said they would not accommodate for ADA, then they changed the date of the hearing, then they cancelled the hearing, then I started receiving notices of appointments with non-specialists in the field of brain injury, auditory processing, vision processing and chiropractic and acupuncture have been denied again.

My total out of pocket expenses to date because CNA refuses to provide medical care now exceed $43,350.44 since date of injury, 1/9/12. While all the medical reports indicate that I received medically necessary treatments, they don’t seem to account for the fact that I paid for most all of it myself. CNA, for a brain injury, paid for a few clinical psychologist sessions in 2012 along with some chiropractic; in 2013, they paid for 6 physical therapy and a few more chiropractic, in 2014 they paid for some acupuncture and 24 sessions of speech therapy, physical therapy and occupational therapy, cut short from the 3-6 months of care that was requested.

The current CorVel modified recommendations included neuro-optometry eval, neurology consult as requested last April 2014 to review the EEG with corollary medical evidence. Let’s get those issues handled, sort out the inaccuracies of the Maximus report, let’s get the FBI and DA-Corporate Fraud units involved with the CNA Fraud Unit representative and let’s organize a claim audit once and for all.

The allegations by Maximus that I sustained a shoulder injury at work and a head injury at home…. well, that seems to be a last straw, doesn’t it? The Maximus report also alleges there is no evidence for continuation of any of the ACOEM/MTUS guideline recommended treatments for traumatic brain injury. I think that doctor also suggested I failed to return to work at some point.

Holy Moly…. Tina, tell them how hard I have been trying to get back to work and that your hands appear to be tied by the defense counsel and carrier? Remember, in November 2012, my attorney of the time, in collusion with Ms. Mall of Grancell, attempted to coerce me to accept a $100,000 settlement, forfeiting all future medical, disability and it required that I quit my job (oh yes, it also mentioned the shoulder injury along with the closed head injury, but Ms. Mall’s team apparently threatened my primary treating doctor’s office more than once with dismissal from the alleged MPN if the early records regarding the right shoulder were not changed to ‘non-industrial’ ….they tried to call me MMI orthopedically last summer and did so this December, deferring to Neuro/psych doctors for head/braininjury after cancelling my appointment for their final report.

I have had no Primary Treating Doctor since December 2014, and Dr. Hilda withdrew from the case in April 2015, and Stewart says it’s not his job to help me get medical care, and that I can choose my own doctors. If that was so, why did I get stuck with an Orthopedic Surgeon since April 2013 with no knowledge of brain injury, and every referral was dismissed, and finally Ms. Mall said his referrals didn’t count because he is bone doctor not a brain doctor. D’oh — not verbatim, but words to that effect.

Because I retained incompetent legal help for 30 days in 2012, then 9 months in 2012 (that guy tried to get me to accept $100K, less attorney fees, with the above restrictions and said, “Nobody will believe you have a brain injury” and I said that’s because he didn’t get me to any brain doctors as everybody recommended, and I assured him I am INJURED NOT STUPID. The next attorney was retained in January 2013 because of the pattern and practice of Ms. Mall (and now Mr. Reubens) to omit medical records with intent to deny medical care—- and fortunately for other injured workers, that attorney who mis-represented me for merely 90 days, is allegedly retiring and just returned my file. He, like the other 3, refuse to release their liens, and as their staff says,. “Oh don’t worry, the 15% doesn’t come out of your part”…. They seem to fail to grasp that no competent attorney will clean up their … failure to represent and failures to do their jobs…. and be willing to split a fee. These applicant attorneys seem to be bottom feeders, yet Ms. Mall and Mr. Reubens like to suggest that there’s something wrong with me for having dismissed 4 incompetent representatives.

I have to head out to Coastline Acquired Brain Injury Program and I have found a local psychologist who will meet with me and help me, I hope, sort out the rest of my life since it also does not not promising that I will be able to complete the Coastline ABI program, and will have to find a way to return to work at the conclusion of the Summer Session.

I have asked Fred Sachs, CNA Adjuster, again for a treating doctor of neurology and neuro-psychology in the Palm Desert/Palm Springs area. Dr. Seymour Young, neurologist who ordered the EEG last year doesn’t take WorkComp, but he may be willing to be on my team via Medicare. The vision and auditory processing issues are not going to be resolved because Kim and Stewart get people to lie about the case; Wyndham didn’t hire me in multiple locations nor send me to Big Bear to help out in that mess because I was not a valuable employee…. I used to help managers even in Hawaii with management reports, including employee retention and motivation and training.

I suggest you ask Michael Dougherty to immediate get going with a Claim Audit and I will follow up next week with the Senator’s office, the DA-Corporate Fraud Unit, the FBI, Maximus and Grancell. I will also prepare a DOR to get back in front of the WCAB Court, to be heard on these issues of fraud and failures to provide medical care and other violations.

I just can’t do anymore than this today, and it upsets me just having to think about the criminal fraud I have been subjected to by this swath of apparent white collar criminals.

Are these matters of the FIFTH AMENDMENT or can they resolved with a FIFTH ATTORNEY.

Let’s plan to meet in accordance with interactive process guidelines, some Thursday or Friday in Palm Springs and I will ask the new doctor in Palm Springs if you can be included in a session where we talk about return to work accommodations planning. One time, in January 2012, Daniel Elliott, then adjuster, spent a full session on the phone with Dr. DeGoede, who explained back then the seriousness of my brain injury and the need for immediate medical care. CNA did not have a neurologist or neuro-psychologist to send me to then either, and Daniel relied on Dr. Goede’s contacts to get me to some specialists, then all hell broke lose when the extent of my injuries was evident. I have a long drive ahead, so, we’ll deal with more of these details later in the week.

How nice.  That’s the first I am hearing of a monetary award for years of service!  Did I miss one for 2013? I got a card from Tommy with a Pin for the first year back.  I still have it.  Timeshare did change my life…for the best when I bought my first one, then for the better when I became a salesperson, then….. for my near total destruction upon being injured at work.

Please consider THIS  letter a further addendum to request for continued leave of absence, through December 1, 2015, such leave being part of the accommodation request.  If I can get back sooner, I will.  Dr. Hilda will reevaluate periodically, as will staff at Coastline.  

Please see the attached letter from Matrix Absence Management, a member of the Tokio Marine Group, as administrators for Reliance Standard Life Insurance Company, and the Long Term Disability Provider of the self-purchased Wyndham LTD policy.  I can tell you that Matrix/Reliance has been consistently kind, professional, and helpful, even through the financial chicanery of CNA that complicated payment of the LTD policy, more than once.  The experience between the two insurance companies is as different as night and day, good and evil, honorable and unlawful, kind and vicious…..

 

Attached is the IME, Independent Medical Exam by one of the Reliance ‘independent’ neurologists. Stewart Reubens, of Grancell, also requested a copy of this report and it is therefore being sent to all stakeholders. I am under no legal obligation to share this information; it is relevant to the possibly criminal matters at hand, that absolutely require Wyndham Intervention at the highest levels now. Let’s avoid a #FEHA lawsuit, although it seems Grancell has other aims. I have not been authorized to return to work because medically necessary treatments have not been authorized for over three years.

Ain’t that a crime?!!  If it wasn’t WorkComp, it would likely be attempted murder!   ” First- degree murder  is any intentional  murder  that is willful and premeditated with malice aforethought.”  Complicity in such acts likely has serious consequences as well.

Please note the Reliance letter clearly states:

“Based on the medical information contained in your file, you are considered totally disabled from performing any occupation for which you are qualified, by reason of training, education, or experience.  As a result, benefits will continue to April 8, 2017, or until you no longer meet the provision of your policy, whichever occurs first.”

How is it, do you think, that both of Wyndham’s insurance companies can have such diverse opinions on my ability to return to work?  Grancell has done everything possible to ensure I am not able to return to work, while they churn the files.  Yesterday, I received another big set of papers from CorVel corporation, pure chicanery and deceptions, but it is their standard of practice.  I have about 3 reams of their bogus expensive reports.

If the Mayor can call for an Audit of CorVel’s WorkComp practices, Wyndham Worldwide can certainly call for an audit of at least my case, and ideally, an audit of all claims over the past 5 years that resulted in absences of longer than 90 days, or forced resignations as a requirement to facilitate medically necessary care. Certainly such an audit will identify a pattern of practice clearly showing the Wyndham is paying premium for insurance coverage that does not provide medical care to injured workers, and in fact, failures to provide medical care by said provider, cause egregious harm to both injured worker and employing corporation, with callous disregard for life and corporate profits and shareholder interests.  (Good for defense law firm shareholders apparently, good for nobody else.)

 

I know how that cop’s family must feel. My dad was a firefighter. I know how that ‘Brotherhood’ can mobilize and organize to help it’s own when under attack by the likes of CorVel, and what is to come for the family, also, during recovery.  I have seen the industry attacks on Cops in LA, alleging they are off work for long periods of time, blaming the cops, not the deniers of medically necessary treatments.   Yeah, industry propaganda.   Anybody with a job anywhere in the USA could be next.

LI  Self Procured Medical Care

I have stories about those first weeks when a “Case Manager, Nurse Lorraine” terrorized me, and   my doctor’s!!!    Did she work for Corvel?  I don’t know.  I think she worked for CNA.  I do know that for more than 2 years, since 2/21013,  CorVel has been complicit in denials of medical care based on some pretty fictitious and outrageous misrepresentations of medical records, and omitted/ignored medical records, in full disregard of ACOEM, MTUS and NIH guidelines for treatment of closed head injury/concussion, tbi, traumatic brain injury and related consequences. CorVel staff make it very clear that they work for the insurance company, and that would seem to be a severe conflict of interest.

The consequences and validity of the course of treatment that have contributed to my leave of absence being more than 3 years, and great bodily to me because of the breach of fiduciary responsiblity by CNA and it’s defense counsel, Grancell-Corona and Grancell-Novato,  is simply stated as follows:

CNA INSURANCE has authorized this medical care since date of injury:

2012 – Chiropractic, Clinical Psychologist (less than 20 sessions each)

2013- Physical Therapy-6 sessions

2014 – Chiropractic, Acupuncture, 24 sessions of Speech Therapy, Occupational Therapy, and

Physical Therapy  (Obtaining a Court order was required for Grancell to authorize scheduling of authorized chiro and acupuncture)…..

2015 – NO MEDICAL CARE, NO RETURN TO WORK, NO DISABILITY BENEFITS paid by CNA SINCE MAY 2014, after refusing to pay, despite Court agreement, in 2012/2013.  Funky accounting let them off the hook with a $16K profit for ‘negotiated’ reimbursement to the State of California for monies the State paid out of my account in 2012/2013.  (Small Permanent Disability advance received yesterday, that will serve to facilitate Coastline ABI program attendance. According to the law, PD estimated payments were due 14 days after last TTD payment… which was May 8, 2014.  See another problem here? Let’s work together for a solution; CNA has a fiduciary responsiblity to Wyndham, and TO ME, as an insured injured worker; that has been breached repeatedly; let’s change that for me, and for all injured workers who follow this path.)

Clearly, the above meets no thinking person’s idea of legitimate, reasonable nor appropriate medical care for a well documented traumatic brain injury.  It does not comply with WorkComp guidelines, ACOEM, MTUS, NIH or any thinking person’s notion of how to deal with brain injury.

Self procured (I PAID FOR IT MYSELF VS. QUIETLY LOSING MY LIFE) medical care has included physician requested but adjuster/attorney denied treatment:

2012- Functional Neurology with TBI Expertise, MRI Brain, chiropractic

2013 – Vision Therapy & Prism Lenses, Chiropractic, Acupuncture, Speech therapy

2014 – Vision Therapy & Prism Lenses, Chiropractic, MRI – TBI Protocol, Acupuncture, Neuro-Psychology sessions

How many thousands and thousands and thousands of dollars have been spent on reports that requested medical care since 2012, that were simply ignored until February 2013, then they were denied in UR evaluations that would not pass a legitimacy test? More than $50,000 was spent at SCRIPPS in 2014, for merely 24 days out of the recommended 3-6 months.   What a waste of money was that!  Whose money was it? Furthermore, such a program is more beneficial for NEW Injuries, not 2.5 year old untreated head injuries.  Helpful, yes, but if CNA had only agreed to Coastline ABI program when it was first presented in May 2014, I could be almost back to work now for a fraction of the cost, and more compensatory skills.

CNA was required by law to be proactive in finding and securing help for me.  The only brain injury treatments received were all based on my own diligence and research, at the guidance of various reporting doctors, who’s recommendations were consistently ignored.  Romano Trust vs. Sedgwick rulings apparently gives companies like CNA the right to kill injured workers.  Is that the type of company that represents Wyndham Corporate Culture and Values?  WILL WYNDHAM STEP UP NOW?

Out of all the evaluating doctors seen, only 3 supported denial of medical care….. known industry leased/owned doctors….Zardouz, Kent and O’Brien.    Any district attorney investigation should likely start there, then move through the list of complicit CorVel doctors, and, of course, to the handling of the mis-information by Ms. Mall of Grancell, and supported by Mr. Reubens of Grancell, while the CNA adjusters seemed to be ‘just following orders’.   Most likely, WE, THE PEOPLE, NEED THE DEPARTMENT OF JUSTICE TO INTERVENE IN WORK COMP CRIMES, NATIONALLY, WITH A SPECIAL COMMISSION.  In seeking Class Action potential, it seems too many attorneys are too afraid of the big corporations, or have no working knowledge of fighting for civil rights.  Others simply seem to be in cahoots with the dubious doctors, law firms, scams and other providers.

Thank you also for the vouchers for discounts at the Wyndham property in Newport Beach, near Coastline Community College Acquired Brain Injury Program. The staff at Ramada Inn – Newport Beach is always so kind, patient and gracious. When I first arrived there, in October 2014, I didn’t know it was a Wyndham property (I forgot how big Wyndham is!)  I told my “WorkComp Story” at check in, as I tell anybody who will listen, and the Front Desk Manager listened patiently and said, ‘Well, let’s get your experience with Wyndham back on a positive track.  Allow me to upgrade your visit.”   Kindness goes a long way.

With the tiny advance on Permanent Disability funds just received (thanks, Fred!), I hope to be able to complete the one year ABI program, which is officially concluded December 10, 2015, and I will jump through all the hoops to get there, stay there,and excel there, getting the compensatory strategies that are offered when people with brain injuries have exhausted all restorative treatments, or didn’t get any, like I didn’t.   Maybe I can organize a Student Union activity on behalf of InjuredWorkers in California, or an educational launch to reach ignorant doctors, lawyers and adjusters, and work with DA’s to deal with the rest of them.  That would be a big goal, but as a Salesperson, I know the value of goals, written goals, and Vision Boards.  More than one of my doctor’s has indicated that I’m so smart, that’s the only reason I have survived this atrocity to the degree that I have.  I want to help Wyndham get a better insurance company and a better, more-pro-active work comp program to avoid fiascos like this in the future.

NOBODY SHOULD HAVE TO EXPERIENCE THESE HORRORS.   Plus side, I’ve learned to blog, and from the comfort of my War Room, I can type like there’s no tomorrow.  That part of my brain stayed in tact…… I wrote you, Tina, a letter, that morning of the 2nd impact on 2/4/12, when I told you if I die because of failures to provide medical care, that I hoped my family would sue Wyndham to kingdom come.  Well, I didn’t die yet, no thanks to Wyndham or it’s vendor.  My quality of life has severely diminished, and my life span has been dramatically shortened, and future health risks from untreated TBI are numerous.

Let’s make a positive impact now, while I can still fight the good fight!

The first year was the most important for care. CNA knew that. So did Grancell.  It’s in the reports they chose to ignore. Remember, they attempted to coerce me to accept $100,000 in November 2012 in lieu of a deposition, treatment, and it required that I forfeit all civil rights, including my right to return to work.  I’m stuck with permanent brain damage because of all of this, and of course, I am not happy about it all.   Remember also, that the first neuro-pscyhologist, Dr. Eileen Kang, recommended “speech therapy with cognitive remediation” and indicated after that I would return to work.  Speech therapy was never authorized till I got to Scripps – Encinitas, in the Summer of 2014.  The damage was already done.

I will plan to return to work on or before December 1, 2015, hopefully, with few other accommodations to be requested/required.   Dr. Hilda Chalgujian is following my case, and Dr James Pasino at Coastline Acquired Brain Injury program is the neuro-psychologist in charge of the program, which is nationally renknowned and a model for other State program, and is supported by the Department of Rehabilitation.  I have requested and been authorized to participate early in the ‘career planning strategies’ for ABI survivors, which starts next week, in addition to the regular curriculum.  It is normally recommended that the program be 50% completed, but since I don’t know if I will be able to afford to stay through June 2015, I want to get as much good from the program as possible, and perhaps I can be one of the first virtual participants in the suMmer/fall program.  That’s just a hope of mine.  The drive is very hard on me, but I have to do it if I ever expect to have a life again.  LINK FOR MORE INFO:  http://www.coastline.edu/students/students-with-disabilities/acquired-brain-injury/

So, I await confirmation of the continued leave of absence, the Award redemption information, and confirmation that a full audit will be conducted, with perhaps a call to the Attorney General’s office in California to expedite further investigations of these horrific crimes.   While Grancell attempts to fraudulently state that I was this way before…. I have to laugh at their arrogance.   There is no such evidence, nor is there any way that Wyndham would have repeatedly hired  me in different locations, and even send me to Big Bear in January 2011 to help out during a time of severe management upheaval.  As you may recall, I was #1 Sales Rep of the Month more than once.

It is my hope and prayer that Wyndham will make a difference, starting with it’s injured workers, and taking it global.  There are good people at Wyndham, and I have been blessed to know many of them.   I recoil, as if from a hot flame, at the very thought of the people at Grancel and CNA, but I’m just sensitive to evil that way.

So, as I told Stewart Reubens and Fred Sachs, I don’t want to fuss about things while I am at Coastline.  I have also learned that 3 years in complete Survival Mode (or 2 years, since the first year I was hardly present cognitively)…. such stress is similar to what prisoners of war experience, and it is very dangerous for a brain injured person. Obviously, treatment will never happen via CNA, as many doctors have told me, in their own sheer utter discouragement and despair.  Nor is there any interest in good faith mediation.  So I hope they will just stay out of my way and let me recover and get back to work.

  • December 4, 2014 €œI am still temporarily totally disabled and now my conditions are exacerbated. I am unable to participate in the December 8 training class, much to my great disappointment and anguish.
  • November 26, 2014 €œI ’m tired and have brain fatigue and a little preservation . . . other cognitive deficits exist . . .
  • November 26, 2014  My California Real Estate Broker license expired because I was unable to cognitively perform the continuing education courses in time.
  • November 4, 2014 Because of my cognitive impairments, I am much slower to figure things out .

 

When you expressed your desire to return to work, we requested a medical release, but you have not provided one.  We need that release and its accompanying description of your limitations so that we can work with you to see if there is a position for which you are qualified, the essential functions of which you could perform with or without accommodation.  We cannot place you back in the workplace without that information and subsequent discussions with you.

 

In an email you sent on February 1, 2015, you stated €œI . . . .am hereby requesting extension of leave of absence to complete one year at Coastline Community College – Acquired Brain Injury Program in Newport Beach, which, ideally, will be completed on or before December 1, 2015, at which time I hope to be able to return to work.”

 

Regarding your request of an extended leave of absence until December 1, 2015, from your email on February 1st, I will share your request with the Leave Support Center and ask them to review your request and provide you a written response with the outcome.   Additionally, per your request, I signed discount vouchers for Wyndham hotels and provided them to you so you could secure accommodations at your expense.  Let me know if you need more in the future and I would be happy to assist.

 

Finally, you inquired about reported compensation in the amount of $54.73 for 2014.  We researched and found that the amount is associated with your three year service award with WVO.  To address this outstanding issue, you may either redeem the award (we will provide you the information to redeem online) or you may elect to forgo the award and we can reissue a W-2 to you for 2014.  Please note that reissuing the W-2 may take approximately 45 days to complete.

AS THE FILE CHURNS, Wyndham Sleeps and CNA asks IW:

“…when ARE you going to die?”

Primary Treating Physician for Ayres vs. Wyndham et al is an Orthopedic Surgeon designated as PTP for BRAIN INJURY CASE, because the alleged MPN Network of CNA is apparently losing swathes of doctors for non-payment and ridiculous handling of claims, they have no brain injury experts and damages caused by CNA by refusals to provide medically necessary treatments.

CNA now relies heavily on Corvel Corporation orthopedic surgeons and clinical psychologists to deny brain injury care based on false and incomplete medical evidence, and lack of expertise  in the brain department.  People complain about that Maximus IMR Gang?  …..Corvel says, ‘let them all eat cake!’ as their nurses and sonders churn out denials like they were going out of business.  The Corvel ‘doctors’ seem to have fangs in the Social Security denial system too?

Most of the CNA leased/owned independent doctors don’t even know that the brain is a body part located in the head, and one of their neurologists says ‘take an over the counter analgesic’ and their other neurologist says, ‘Look, you didn’t get any medical care the first two years, you’re already over 35, nothing will help you now.  Go for a walk, get skinny, use the neuro-optometric theraputic lenses they wouldn’t pay for, but you did, and stop whining about vision and auditory impairments.’

Some real doctors just walk away from the #WorkComp Scams, some stay in it, slugging it out on behalf of injured workers, and others just ride the Dinner Car of the #WorkCompGravy Trains.

Nearly every single request for expert treatment for brain injury by the PTPs have been denied, first by non-doctors, Kim Mall, Attorney for Grancell, then by Daniel Elliott, Adjuster for CNA aka American Casualty.  Remember remember, Wyndham Worldwide had (and probably still has) no standard practice for injured workers other than handing them an incomplete DWC-1 form with a shrug and “See any doctor that accepts work comp insurance” with the ‘time-share-salute’.

The Evaluation [QME]  by Dr. Jeffrey Holmes, Orthopedic Surgeon, has been aborted again, and to be rescheduled in December, after spending nearly 70 minutes at the appointed time, confirming medical records and sorting through confusion.  It was a pleasure to meet Dr. Holmes and his kind and gracious staff.  Harvard men can have manners, yes?

As injured worker was quite clear that the good doctor was being invited by Defense to participate in an on-going fraudulent denial of medical treatment scam, and that he deserved to have all the facts so that he could make a legitimate evaluation of the right shoulder injury and other orthopedic challenges.

2012 medical records and 2012 attempt to coerce premature settlement by Defense clearly referenced right shoulder injury, and current hard-fought for Acupuncture has been for the ‘right shoulder only’ and they tried to tell the acupuncturist treatments were not to be used on the brain.  D’oh!

(Acupuncture is a whole-body system of treatment, most helpful to some brain injured patients.) The Defense postion letter started out with lies, that just got more egregious, and current defense counsel stated he saw no reason to change anything in Kim’s letter.  Birds of Feather poop together?

Current PTP was successful in getting 6 physical therapy sessions authorized in Spring 2013, for a Winter 2012 injury. Then an MRI in Summer 2013 of the shoulder was authorized, determining a need for surgery and a severe shoulder rotator cuff tear.  It took a Court Order to get appointments scheduled for Physical Therapy and Acupuncture in 2013. Is that right use of Judge’s time?

Defense attorney Kim Mall (Grancell-Corona) then indicated that the adjuster was wrong, there would be no further evaluation because it was not an accepted body part.  She did not want to hear that the adjuster was trying to do the right thing.  She squashed it, and no doubt billed on.

 

Work Comp  TBI Wyndham and YOU

Several days in front of a WorkComp Riverside Judge, to deal with issues of omissions of medical records—more than 300 pages left out for 3 doctor reports, so those doctors relied on instruction from the defense, based on their egregiously flawed reports, QME/AME/and 2nd Consult.

 

Conveniently, those industry leased/owned doctors moved the reported date of injury on some reports a year forward, to 2013, using medical evidence of 2012 to ‘support’ fraudulent claims of ‘pre-existing’ symptoms such as dysfluent speech, impaired cognitive abilities, inability to recognize people, auditory and visual processing….. One made a correction to the date when confronted, but not to the false opinings, or his meds were off too.

No worries, WorkComp Courts REFUSE TO HEAR COMPLAINTS ABOUT ATTORNEY/PROVIDER FRAUD, AND SO DOES THE COMMISSION IN CALIFORNIA.  DISTRICT ATTORNEY IS TOO BUSY? CAAA suggests injured worker keeps on looking for a competent legal firm to represent.

DEFENSE FIRM REFUSES TO MEDIATTE, SAYS THE CASE IS “not ripe”… (i.e. Injured worker is still breathing???)

DEFENSE FIRM REFUSES TO PROPERLY PROCESS MEDICAL EXPENSES REIMBURSEMENT REQUESTS FOR NEARLY $30,000, AND INSURANCE CARRIER IS AWARDED $16,000 BONUS BY STATE OF CALIFORNIA – EDD — APPARENTLY OUT OF GENERAL TAXPAYER FUNDS…FOR REFUSAL BY CARRIER TO PAY TEMPORARY TOTAL DISABILITY BENEFITS IN YEAR 1 AND 2 OF INJURY…. Perhaps the WorkComp AUDIT UNIT will do their job and suprise all stakeholders with fines and penalties.

THE INJURED WORKER HAS NOT YET RETURNED TO WORK…. WYNDHAM CONTINUES TO REFUSE TO PARTICIPATE IN THE INTERACTIVE PROCESSES OF #FEHA, AND THE DEFENSE FIRM CONTINUES TO OBFUSCATE TRUTH…SENDING QME DOCTORS BUNDLES OF DISORGANIZED FILES, THAT SEVERAL HAVE BILLED 7-8 HOURS TO “organize” prior to review, and generally, those doctors just have their “staff” write a report following guidelines of defense counsel, fraudulent misrepresentations and all.

These doctors are not apparently accustomed to an injured worker fighting for survival without a lawyer—two threatend to sue for ‘harassment’ when omitted records were properly served with requests for supplement reports reflecting further medical evidence.  Several Court hours were wasted (but billed by Defense firm?.)…. to sort out the missing records.

The file was pulled from Kim Mall, and given to Stewart Reubens, in Grancell-Novato office.  Stewart doesn’t like to read.  His office must be full of rubber stamps?

Evaluations Evaluations Evaluations…. and #WorkComp Defense now wants MORE EVALUATIONS?!!! For how many more years??

The recent Ortho Eval was aborted again, due to file obfuscation by Defense Firm, to be rescheduled.

While Grancell refuses to honor ADA request for electronic communications, it seems that Stewart sent a letter recently requesting yet another neuro-psychologist evaluation (after DIR told him NO once more) and he is apparently clue-less that such testing cannot be done more often than every 7-9 months, or ‘practice effect’ renders the results bastardized.  Or, maybe he does know that, as he knows such a battery of tests was done again in October 2014.   All results point to a traumatic brain injury, with requests for treatment.

Even the Grancell leased Forensic Psychiatrist wrote, ‘If there was evidence of a concussion from a slip and fall, injured worker would certainly be entitled to medical treatment….but there was not fall, no concussion, and it was probably just an epilepsy attack.”  D’oh! Doc off his meds that day?

Forensic Psychiatrist wrote 3 supplemental reports at the request of Grancell’s Kim Mall, each one more outrageous and egregiously fraudulent than the prior, until they decided to put the reports on the ‘do not regurgitate in summary’ instructions, and also asked to have the name and report dates removed from the Medical Index.  Invoking the 5th amendment might have been more efficient?  (He also suggested that if IW has civil rights complaints, she take it to The Hague.  He provided the direct line for the local DA to facilitate further complaints….THAT’S SCARY THAT HE HAD THAT NUMBER SO HANDY, HUH?  d’OH!  He refused to believe complaints had already been filed.)

I can’t get no satisfaction, and can’t get no medically necessary treatment from that big company, CNA (their CEO, Tom Motamed makes $10.7 million a year in a business that maims (and CAUSES PREMATURE DEATHS!) of America’s injured workers! D’oh!)  Earlier this year I even had to call Adult Protective Services due to the financial terrorism, and I copied the State Controller, too.  There was a remedy, but no resolution and it started again in July 2014, and I don’t know what to do next.

The State of California paid CNA a BONUS OF NEARLY $20,000 for CNA’S REFUSAL TO PAY TEMPORARY TOTAL DISABILITY PAYMENTS TO ME IN 2012/2013.  SOCIAL SECURITY SAYS A FUNCTIONING BRAIN IS NOT NECESSARY TO SELL TIMESHARE.  MY STORY IS SAD AND I KNOW YOU’RE BUSY, AND I HAVE TRIED TO GET HELP FROM LOCAL GOVERNMENT PEOPLE, AND QUITE FRANKLY, TOO FEW GIVE A DARN.

I have not heard back from you regarding the Quality Assurance position in Indio, the training dates for sales in November, or any of the other recently posed questions, in regards to the spread sheet I made, at your request, regarding potential accommodations.  This information is required so that the primary treating physician assigned to my case, Dr. Darren Bergey, Orthopedic Surgery, can make proper recommendations for accommodations and return to work status on Friday, and as you know, he has also deferred to the medical opinions of Dr. Hilda Chalgujian.
 .
Dr. Hilda made it very clear in April that my needs for medical treatment were urgent and more than necessary.  CNA, Grancell, and Corvel seem to have acted in orchestrated collusion and in defiance of the Wyndham insurance policy and the laws of the land.   However they have done it, it has harmed me egregiously.
 .

Below is a map of proximity of Wyndham Avenue of the Arts and Coastline College and the Cognitive Rehabilitation Program that starts Monday, October 20, 2014. Orientation is Saturday morning, October 18th.   As part of the accommodations to be explored, will you kindly obtain authorization for complimentary stay at the Avenue of the Arts property for arrival Friday, October 17th, departure Thursday, October 23rd, in order for me to attend the orientation, and seek housing.

It is clear that the Wyndham insurance carrier and defense firm intend the continuous harm to me and it is time for Wyndham to come to the aid of this injured worker. While they continue to fail to authorize treatment for brain injury, they hope to help some of their independent doctors make book with extra evaluation dollars.  Stewart is working very hard to get an accurate medical list of records together and he insinuated that the WorkComp Judge authorized their fraudulent obfuscation of facts.  I didn’t read the order that way, but who am I to argue with a Grancell Partner/Shareholder.  If he says the Judge approves fraud, d’oh….I won’t touch that one.

That’s for higher authorities.  He didn’t use those words, but close enough to what I saw, but the refusal to correct the errors was based on skewed misinterpretations of a full day in Court when the other Grancell lawyer had to be ORDERED BY THE COURT to provide more than 300 pages of omitted medical records that had caused seriously incorrect medical reports by 2 doctors in Spring 2013, and then she did it again for the next evaluation in December 2013, alll with clear intent to deny medical treatment to a disabled injured worker due to disabilities, age, and profits.

Clearly matters for higher authorities.   Stewart intends to continue the charade with the next evaluation. Does anybody else wonder why so many doctors have been paid to ‘evaluate’ me and none of their recommendations are acted on; all ignored or denied.  False prescriptions bills go unnoticed, and Stewart thinks that it’s ok to include in medical records that I saw a brain injury doctor from Casa Colina in October 2012, which I did not, and this is the same doctor who helped CNA override the attempts to revoke my driver’s license in 2012, and same doctor was seen, self-procured in Spring 2013, and apparently lost my file and refused to write a report, when in our evaluation, he said I was an ideal candidate for the Casa Colina Day Brain Rehab Program, and that he was very familiar with Work Comp and knew how to work the system to get me in without much fuss.  Then he lost my file and kept my money for the report that he never delivered and never returned my calls?
District Attorney stuff, let the government handle these boyz.

I just want medical treatment and a place to stay while I’m getting it.  CAN YOU HELP ME NOW?   Fred’s suggestions about the ‘circle jerk’ of more rounds of appeals to Corvel, recently reported to have ‘quasi-black-market’ businesses practices, under investigation, are not acceptable.  1.5 years of that nonsense is enough to make anybody aggravated, with their out of state doctors and illiterate nurses skewing facts from the reports they do receive from CNA/Grancell.

The injury was witnessed, the manager helped me up from the ground after being there for what seemed to be about 5 minutes, and the initial failures that have exasperated my medical conditions started on 1/9/12 when I was not even offered a ride to the hospital.  [We had a sales meeting right afterwards, and everybody had a good laugh, and they said,  ‘Ewwwwwww, Linda has Fukushima rads from the snowflakes allll over her!!!’]
[I got ‘the talk’ the week before for a picture in the break room about the Fukushima nuclear meltdowns. The manager said it was ‘grim’. D’oh! Ya think! Triple Nuclear Meltdowns in progress since 3.11.11….. yeah, sort of grim for all of us.]
I get it that I have to contend with brain injury because of Wyndham, and because I did not get medically necessary treatment for going on 3 years, when anybody with a functioning brain knows that the first 90 days are critical for care, and that ongoing speech therapy with cognitive remediation, occupational therapy, vision therapy and psychotherapy are key components to such recovery.
 .
So, while CNA suggests I participate in their “circle j**k” by suggesting I submit yet another appeal to yet another bogus denial of treatment, I am asking you to elevate this beyond your comfort zone.  I am reaching out on LinkedIn to Wyndham employees globally.  There is a COUNT ON ME side to Wyndham, and you can continue to COUNT ON ME to ensure that these horrors are minimized and ultimately eliminated for other injured Wyndham Workers.

I look forward to returning to work and once again being a valuable and valued employee, despite my cognitive impairements.  If, however, Grancell’s legal opinion that suggests my injuries are minor, there’s not much more to talk about.  Let me know where to report to work, in what position, and I will request release to work with minimal accommodations from both Dr. Bergey and Dr. Chalgujian.  Without promise of any medical care, I do not know if they will accept the professional liability of releasing me, under such dangerous conditions.  Their responses will likely weigh heavily on your response, and the return to work offered in order to properly recommend accommodations and restrictions.

Your response is required by Thursday, close of business, 5 pm, or will be considered collusion to continue the egregious harm to me, and continued refusal to participate in the FEHA interactive process in order to help me return to work, meeting timeframes intensified by your refusal to meet in August or September of this, or in earlier Accommodation requests of 2014, 2013, and 2012.   I will also appreciate confirmation of complimentary reservations at Wyndham Avenue of the Arts property as stated above, with an offer for a longer term discounted rate for the first semester at Coastline, in order to allow me to find proper and adequate housing.

I hope to hear from Fred Sachs, CNA Adjuster on my situations, by today or tomorrow regarding reconsideration of the Coastline Cognitive Rehabilitation program.  It’s unfortunate that the first adjuster, Daniel Elliott, did not pursue Coastline when I first asked him about it.  Maybe Fred can do something now.

PS  If you would kindly reimburse the more than $27,000 I had to pay for medical expenses on my own,  and if you would return the $20,000+ bonus the State of California gave you for refusing to pay temporary total disability payments in 2012/2013, I would haven’t to ask for help to get there, even though you have started the financial terrorism thing again.  Bummer. No income since July 2014, and LTD is skewed up because of your  chicanery and they cannot confirm they will resume and for how long.   BTW, AGGRAVATION IS NOT GOOD FOR A HEALING BRAIN.

Then we will know if looking at a position at the Wyndham Irvine Hotel or possibly Oceanside for sales is the next step.  The Interactive Process will help sort that out, but a preliminary decision must be made shortly.  Otherwise, I guess the next best option is the Quality Assurance position in Indio.  Worst case scenario will be an outreach for fund-raising to help me with accommodations and lodging for the Coastline treatment opportunity, since the bad faith efforts of all concerned seem to have escalated.

All Stewart can seem to work on is trying to get the medical records index straight so they can send me to another Orthopedic Surgeon in November for another evaluation so they can cross their fingers that he may collude with the Grancell opinion (not medical opinion) that the right shoulder rotator cuff tear was “non-industrial” as they directed current PTP to change records to reflect, in stark contrast to early medical reports, and in contrast to the premature settlement offer they attempted to coerce me to take, which also required I forfeit my future medical care benefits

(which, in TBI case, CNA providers indicate range from $600,000 to $1.3 million, when TBI is treated! As you know, the only treatment I got authorized started in August 2014 at Scripps and 3-6 months were requested, 16 days were initially authorized, follow up with 8 more, and we did not get the Interactive Process started, even though it was paid for; date of injury, January 9, 2012)

[BTW, if Stewart’s allegations are right, in stark contrast with findings of real brain injury experts,  and my injuries are ‘minimal’ then by looking at my resume and my past experience with Wyndham since 2005, it’s easy to see that I could do the Quality Assurance Representative job practically with my ‘eyes closed’….]

Please don’t keep me guessing, I will have to make plans in any event, and unfamiliar circumstances causes cognitive challenges, so I must move methodically and do my best to keep notes and keep them organized.

2.  WorldMarkByWyndham – new position, start immediately – Indio – Quality Assurance Position, salaried, $50K + immediate benefits  (relocation not required)
3.  Wyndham Worldwide – any position available, start immediately since injured worker’s benefits —INCOME– were terminated in July, with CNA profitting by refusal to pay…. Long Beach Specialist Presenter position just posted…. That could be wyn/wyn/wyndham!  
4.  In the event there is no movement toward Coastline or RTW, final option is national fund raising effort amongst Wyndham’s WOMEN ON THE WAY, COUNT ON ME PROGRAM, with perhaps some hep from ARDA and other hospitality organizations.  Wyndham now has a huge opportunity to lead the way to right treatment of injured workers in the mega-billion dollar industry.  What has happened to me because of the system fail is unconscionable.

Let’s plan on Monday, October 20, 2014 as the day Wyndham Worldwide took a hard look at their WorkComp system fails, and began to right the wrongs that egregiously harmed an injured worker and shareholder, and former owner/member.

PS  Note to Fraud Unit at cna.com…. thank you again for your call.  I did follow your recommendations and I have reiterated my unhappiness complaints to the various agencies you suggested, and it was recommended that I continue to copy your department as I am a protected insured against fraud under the Wyndham Workers Comp insurance policy.  We’re all in this together.  Fingers pointing at Grancell at the moment, or so it seems.   Further investigations and audits seem in order.

I just spoke with the admissions office at Coastline Community Cognitive Rehabilitation Program and I have been accepted into their program.  The fees are due by Friday and the cost is $184.00 per semester. 
 
This requires a one year commitment, possibly two years, depending on my cognitive improvements.
The failures of Wyndham, CNA and Grancell can be righted, to some extent, if there is cooperation to help me get cognitive care now for the injuries that were not treated at the time of injury, not during the first nearly 3 years……
