Years ago, I volunteered in a goodwill effort with and for Convicts in America’s Maximum Security Penitentiaries. It was called “PRISONERS UNANIMOUS — EMBRACING ALL PLANETARY PRISONERS”  Maybe you heard of it?

Check FOIA, they probably have several CDs including my visits to penitentiaries across America, and my communications with a handful of government officials, goodwill organizers, friends and families of prisoners, and approximately 1,000 Convicts across America.

I think I was the second woman “in history” to “walk the ranges” at USP Marion Federal Penitentiary, back in the days when it was deemed ‘the worst of the worst” prisons, surpassed today by, so I hear, the likes of Pelican Bay.  It was after allegations of a “full scale Nazi-type of retaliation attack” on the entire Convict population.  I was corresponding with several of the Convicts listed in that dreadful “Public Report.”  I sent copies everywhere, including Amnesty International in Vienna, where they allegedly WATCH for human violations in the Americas.  Hmph.

The Guys and I established an “8 o’clock, local time” prayer network when they educated me about how deplorable America’s “Corrections” system is.  Now, privatized prisons are a bigger part of the “PROFITS BEFORE LIVES” industries.  Some of us still link up, no doubt.

The guys told me how bad things were, and said I was very brave.  They said the prison systems in America are very dangerous, and that I had better think long and hard about touching it.

They told me, “Lady, you better know what you’re willing to die for, because you might well be asked to do so if you get involved in attempting to facilitate change.”

They further advised, “Lady, we Convicts are not the problems in your country. We are the end result of the problems in your country.  If you want change, you have to go Washington.  That’s where the problems are.”   (There is something far more polite and respectful from a Convict calling a correspondent “Lady” than the pretentious “Ms. Ayres” used by defense and psychopaths, wouldn’t you agree?)

Those words reverberate in my head as if they were yesterday. I have never forgotten those haunting words.  As a Survivor of WorkersCompensation today, I know ever more how true they are.

IT’S A GRAVY TRAIN!

ONWARD:

#WorkCompsters have made that choice easier today.  They have already taken my life. 

Too often, Injured Workers make poor choices in efforts to retain competent legal counsel, much to the detriment of the Injured Worker.

This is often not discovered by injured workers until the 2nd, 3rd or 4th attempt to retain competent counsel.

Including THIS warning in every employee new hire packet, and every Human Resources orientation in California could save lives.

Till then, tell your friends and neighbors, and tell them to tell theirs. WorkComp Kills, without consequences to anybody but the Injured Workers and their loved ones.

Many Injured Workers have even sought the help of ACLU and NLG, to no avail.

We are, however, grateful for the organization, NAIDW.org, National Association of Injured and Disabled Workers, for the encouragement, resources and support they provide, and having been providing for many years. “No Injured Worker Left Behind” Semper Fi, Y’all!

We like a few of the industry bloggers who do their best to do their best for the highest good of all concerned.   Cognitive Dissonance seems to be kicking some butt in that arena, wouldn’t you agree?

Bravo to ProPublica for being a catalyst for discussion and possible change. Bravo to WorkCompCentral for relentless efforts at education and inciting legitimate discussions about the need for national discussion and change.

Let’s get beyond “PROFITS BEFORE LIVES”…. let’s incarcerate a few psychopaths for maiming and  killing injured workers, too, shall we?

It matters not if the killers are making $250K a year, or $10.7 million or more a year.  With proper trials first, of course.  FBI and DA and DOJ  need to better orchestrate their efforts, ya think?

Crime is Crime, and CRIME SHOULD NOT PAY IN AMERICA.

For personal assistance in my own, but common,  horrific case on non-stop abuse of a permanently disabled-by-untreated-brain-injury-and-various-acts-of-legal-chicanery-and-file-churning, older female worker, a local crisis center sent a Marine to help me last year.  The Marine Social Worker, kind, fierce and very helpful.

MMI neuro-psychologist report recently received (and posted!)  says my future medical needs include similar support, with probability of needs for assisted living and ‘memory care’ for my shortened life span, shortened due to WorkCompsters and corruption, involving many unclean hands. Hmph, Some “Grand Bargain, California!”

Legitimate doctors in 2012 made legitimate and conservative recommendations for medical care, denied. Had treatment not been denied by the defense counsel (not doctors, just defense lawyer and adjuster for 2012, till 2013 came along for the extreme profits of CorVel to obfuscate facts with intent to deny medical care.)  return to work might have happened in 2012.

After threats from defense counsel, then PTP released me to work with accommodations, which were denied in October 2012.  Things got worse from there, without medical care.  I have been fighting to return to work for years, to no avail.

I have endured being penny-less, relying on The Salvation Army for utilities,  filing for social welfare due to carrier arrogant practice of denials of payment of TTD, “because they could” (and they were rewarded handsomely by EDD for refusing to pay in 2012/2013 and for refusing to provided medical care.  Now, SSA is involved in the charades and chicanery, and trying to sort it all out.

Is it a felony for carriers to provide SSA and EDD with false evidence of benefits paid with intent to deny SSA benefits?  Seems to be part of a set of RICO violations, wouldn’t you think?

Yet evaluations upon evaluations upon evaluations have been performed by approximately 38 doctors (ca-ching, no care, just primarily report regurgitations written  by non-medical staff, signed by doctors, paid the big bucks).

While we are at it, omission of medical records and obfuscation of facts seems facilitated by the silly “chronological” ordering of medical evidence, rather than by specialty, then by chronological order.   Carrier in my case gets charged by most doctors 4-8 hours for “organizing the records”…. and maybe it’s not all the signing leased doctor’s fault their non-medical staff do things like change the date of injury to a year forward, then use first year medical evidence to falsely opine “pre-existing” symptoms.  D’oh.  Number of hours spent during an evaluation are often “inflated” and far worse, totally fabricated!

The majority of Lawyers don’t seem to care.  They  shrug say ‘their hands are tied” (and “their lips are sealed?!!!”)  Others have told me “Too much fraud in your case, it’s over my head” and “Too many people didn’t do their jobs, there’s no money in it for me”….

One interviewed actually had the audacity to ask, after pages of questions had been answered, “One more question, tell me, why did you wait over 2.5 years for medical care for a brain injury?”  D’OH!   That didn’t even merit a final response, and that attorney came HIGHLY RECOMMENDED.

Here’s my story, again.  Date of witnessed slip and fall backwards on ice, resulting in Concussion/Traumatic Brain injury 1/9/12 while working for Wyndham Worldwide.

What kind of system do YOU profit by that requires someone with a brain injury to represent herself because your colleagues (4 of them) could be found guilty of ABA Ethics Violations and Incompetent Representation?

Due to your accepted CA  legislated fraud regulations, and your “2 attorney” superstitions, Injured Workers bear the brunt of the lack of expertise of your crowd/CAAA memberhips.  This also allows Defense Firms to claim the title ENEMIES OF INJURED AMERICAN WORKERS.

How many injured workers retain and dismiss multiple attorneys, as the corruption is tolerated by those retained to protect injured workers? How many injured workers in California, and in America, must represent themselves due to the failure of the ABA crowds?  Some have said that more than 15% of Injured Workers are InProPer…. probably as a last resort, not a first.

Why do your various profit centers/industries refuse to work with InProPer Injured Workers, and why do your industry leased/owned doctors seem so puzzled, baffled and perplexed by the legality of an Injured Worker self-representing? Why do the medical office staffs believe they can ONLY TAKE ORDERS from the Adjuster or Defense Firm?

IS THIS SIMPLY ANOTHER CASE OF “FOLLOW THE MONEY?”

When incompetent and worse attorneys can be allowed to be rewarded for causing harm to an injured worker, how can that be good for anybody?

If WorkComp Mill attorneys  have a “case load of 300 clients”…with wishing and hoping that somebody drops dead for some ultimate pay-off for the attorney, how does that help an injured worker get medical care, benefits, return to work and settlement?

Why do employers condone such malicious unconscionable behavior of denials of medical care, benefits, and bullying and all sort of acts of terrorism, experiments, surgeries, poisoning and worse by insurance companies? What good can a WorkComp attorney do?

I even asked a WCAB Judge for permission, as stated is possible on the WCAB recommended reading, to retain an attorney to consult with, on an hourly basis.

Alas, not only did the Judge tell me he would not hear the F-words in his court room, (Felony Fraud with intent to deny medically necessary treatment), he sentenced me to fighting for my life with every ounce of courage and strength and stamina I can muster, fighting organized crimes that EVERY ONE OF YOU ARE FULLY AND COMPLICITY AWARE OF.

But wait, the Team of Four don’t have all the blame.  Defense counsel says it’s all my fault.  Hmph.  He even suggested I consider a Court Appointed Conservator since I am having such difficulty maneuvering the WorkComp system, with denials of medical care, fraudulent reports, unresponsive law enforcement and more.  The Carrier’s Fraud Department called, as most of you know, last Fall and made it very clear he did not care one iota that I had not received medically necessary and recommended care, and the conversation concluded when he said, “So, tell me Linda, when ARE you going to die?”

Some things I read on LinkedIn indicated the Employers are responsible for the bullying and terrorism of their vendors. Wyndham Worldwide was immediately apprised of the horrific bad faith and breach of fiduciary responsibility, and outright disgustingly mean thing to say. ( Intent of the caller? A “medicated worker” might have been compelled to irreversible action by such ‘poor customer service’, wouldn’t you agree? )

How many members of your CAAA organizations have been approached, recommended, took time to evaluate the merit and financial possibilities of helping THIS injured worker?  You know my name now.  I have spoken with many of you.  Your declines to help have most always been cordial, except when they weren’t.  Just so y’all know, A BRAIN INJURY IS NOT THE SAME AS A BROKEN FINGER, NOR IS THE TREATMENT THE SAME.

Watch the upcoming movie “Concussion” and then ask yourself and your partners how legitimate could it be for an insurance carrier to refuse to pay TTD, provide medical care, and embark on a mission of terrorism and destruction to an injured worker, coincidentally, UPON DIAGNOSIS OF BRAIN INJURY.

The Defense Firm treats me like they pretend to have  I & A Officers and  Judges in their pockets, as my ADA rights are consistently violated at WCAB-Riverside, and my Civil Rights.

Think about how many of YOUR clients have been sent to merely Orthopedic Surgeons or Chiropractors for TRAUMATIC BRAIN INJURY?  See the current list of names all the 40 doctors I had been sent to, and all the CorVel and Maximus “physician advisors” and team members.  In the olden days, they might have all been called, “Sonderkommando”….   Don’t get me wrong, there are a few good doctors in that list of 40, and they will be nominated in the upcoming CompLaude Awards.  The others will be nominated to the naughty list for possible inclusion in the ProPublica national efforts.

MY EMPLOYER DOES NOT CARE.  DOES YOURS? DO YOU?

I have many of your polite Non-Engagement Letters and I am weary of bothering with your ilk.  You are as much a part of the WorkComp problems as are the criminal doctors and lawyers.  Perhaps Sophie Scholl is kinder in her description of your ilk:

Opinings by Injured Worker on how different the Outcome of the workplace injury may have been without WorkCompster interference.  Legitimate medical care, swift and expert, could have made the difference between return to work in 2012, and permanent disabilities and looking at Assisted Living and Memory Care for the near future.  WTF Wyndham, what’s wrong with you people?!

How many evaluations are required for how many years before an Injured Worker gets medical care for a Brain Injury and release for return to work? 4? 5? 10? 20? That sure is starting to sound like “never, we hope you die” plan, doesn’t it?   47 face to face evaluations, and approximately 20 CorVel employees and “Physician Advisors” on reams of regurgitation reports, written by what seems to be rapid-fire-copy-and-paste and make stuff up if not known, due to lost or omitted medical records.

Most all the doctors who have touched this case to date are listed, with the SSA exceptions.  Their “clinical psychologist” suggest that although neuro-optometrists reported severe vision processing issues, that I could consider a new career as a “crossing guard” (Goodness, would you want your kids helped across busy streets by a disabled person with auditory and vision processing issues, untreated issues?! Kid hater, huh?)   It’s shocking.  The list will be sorted soon by CompLaude nominees and ProPublic investigations nominees, for what it’s worth.

How important is an ENT evaluation when neurologists, neuro-optometrists, physiatrists, orthopedic surgeons and chiropractors and neuropsychologists have have all made very extensive reports with very comprehensive treatment recommendations for nearly 4 years?  File c-h-u-r-n-i-n-g…..?  It is a felony?

My patience is real thin these days, as so much more harm has been caused to me in the continuous pattern and practice of delay/deny/deceive in hopes that I die.  3D is what NFL families call such treatment.  I’m not sure what CNA calls it, “Business as Usual” or just  “Profits Before Lives By Any Means Necessary”?

I was recapping my story to someone today and said out loud, “You know, I would not be in this mess if it was not for Wyndham’s  Workers Compensation schtick.  Without it, I would have been able to see legitimate doctors, get legitimate evaluations, legitimate AND IMMEDIATE MEDICAL CARE, and the probability that I could have returned to work in 2012 was high.  One doctor, Ponton, as you may recall, tried to release me to work in October 2012, despite his failure to secure medical care and expert evaluations.

I remember the first neuro-pscyhologist said that with speech therapy with cognitive remediation, I’d probably return to work in a few months.   That was February 2012.

Instead of legitimate care, I have had to fight for my life, spend a small fortune on getting basic medical care for survival, and find the most vile legal chicanery I’ve never seen before in my life.

Now I get to think about “assisted living” and “future medical” and “dementia” and “epilepsy”  since I didn’t get anything close to what legal guidelines for medical care for a clearly diagnosed head injury merits, and I’ve been bullied and badgered and threatened and abused by the “defense” and their leased/owned doctors who seem to lie on demand for the big bucks,  and zero help from the insurance carrier.  Even the CNA mis-statements of benefits to multiple agencies continues to cause me harm.

I spoke to Coastline Acquired Brain Injury Program  today, as today was the “drop out deadline”…. I cried a lot because I told them how excited I was that Sunday, 8/23/15, to be returning, then I got your email pretending like you never got the message that since I hadn’t heard from anyone, August RTW was out, and we were back on 12/14/15 schedule.  Then, because of more chicanery, and now the ENT evaluation court gig is pushed to October….. and ….. well, as you can see, if I had legitimate insurance coverage, I would have even had legitimate EEGs, MRIs, speech and occupational therapy, vision therapy and more… all in 2012, and back at work.  Wyndham employees –as you well know, have terrific benefits.

 

Coastline assured me I am welcome back any time, and we set a tentative goal of October 19th, so that I will have only missed a few weeks.  By then, the CNA/SSA/EDD skewed mess of who paid what may be sorted and I can resume what little hopeful strategies are next.  Since another two weeks have gone by that you couldn’t repond, and it looks like anther week or more for anything tangible to be addressed….I’ll aim again for return to Coastline 10/19 and return to work 12/14/15.   I am not sure if your communication response times meets guidelines of reasonable, but I see there is nothing I can do about that either.

My life has been destroyed because I tried to help my co-workers get in to the office when we were locked out during a snow storm?   Nearly 4 years of my life gone…. and the future looking quite grim.

I hope, Tina, you have learned something from the harm that has been caused to me.  The FBI agent asked, out loud, how can they sleep at night. as I told some of the horrors I have experienced at the hands of the Wyndham Worldwide mockery of a work comp program.  I just told the agent, “Well, psychopaths have no trouble sleeping.  No compassion, no empathy, and they simply pretend to be human.”

Another holiday weekend coming up for all complicit in harming me….. and I have yet another empty weekend in limbo, wondering what’s next.

Will someone from some Law Enforcement Agencies kindly review this complaint, and send it to the DIR et al for further investigation?  DOJ probably needs a copy for ongoing RICO violations?  Don’t be scared of the insurance industry thugs…. they seem to be mostly cowards and psychopaths, who take delight in harming injured workers.  They would never last in a penitentiary.

Super Lawyers in California say this case is not unusual, AT ALL.  MY MY MY.  Hardly seems legitimate, does it?  Be sure to read the letter to Human Resources below, that explains how if there was WORKERS COMPENSATION maze and hoops to jump through, legitimate medical care may have resulted in return to work within months, not the ongoing charade of file churing that has been continuous for nearly 4 years.  With legitimate health insurance, the process would have been simplied to:  1) see a doctor 2) see specialists as recommended 3) get treatment 4) return to work.

Current status is yet another delay, with ADA violations and Civil rights violations for a Court Hearing on a Petition for an Order to Compel yet another evaluation, this time by an ENT doctor.  Note, Injured Worker objects to yet another evaluation, with more than 200 pages of medical records omitted with apparent intent to continue to deny medical care, inaccurate placement of medical records create a false impression of an EEG with clearly diagnosed brain injury as of “2010” and…..misleading statements by defense firm to continue the misleading statements and false allegations perpetrated by the Defense and supported by certain AME/QME doctors and the Information and Assistance Officer.

False/incorrect statements of disability benefits have apparently provided by the carrier to agencies such as EDD and SSA. EDD rewarded the carrier with a bonus of nearly $20,000 for cost shifting and for refusing to pay TTD and for refusing repeatedly to provide medical care.  Penalties for failures to pay in accordance with the law have not been received, and the WCAB – Audit unit has a swath of complaints against all parties, as Injured Worker has had to pay more than $43,000 for medical miles, medical evaluation (including MRI and EEG) and medical TREATMENT.

Take a look at the list of doctors.  Can you tell which have been naughty, and which have been nice, and which will likely rely heavily on the 5th Amendment of the Constitution of these United States of America.  The “officials list” of possibly complicit parties is also available to ‘proper authorities’.

Worth yet?  You should see how Injured Cops and Firefighters are treated in California. Shameful, indeed!  Reams of Denials via CorVel for ADJ8181903! (Chronoloical Order, 2013 to present….notice a pattern of expertise of denying parties?)  CorVel reports tend to be convoluted regurgitations of disorganized and incomplete medical records, violations of HIPPA rights, and inappropriate reviewers for types of injuries.  Readers may opine that the submitting RNs wrote the reports, poorly and incoherently, for the most part.   (Regurgitated and Obfuscated Reports are an apparent pattern and practice of CorVel teams)

If YOU make it to the “NAUGHTY LIST”  all thanks go to CNA and defense firm, Grancell Stander et al, and of course, to Wyndham Worldwide for corporate irresponsibility and callous disregard for the life of an injured worker, in a serious breach of human right and ethics, extreme discrimination of injured workers with disabilities, not excluding age and gender discrimination issues.   They could have made a difference. They chose not to.  Bummer.

Will someone let DIR Director Christine Baker know what happens where there are only illegitimate practices and legal chicanery in brain injury cases? Everybody planning to watch #Concussion?

Find Physiatrists and Neuropsychologists and their inter-disciplinary teams for helping Injured Workers with brain injuries, and stop relying on Orthopedic Surgeons who admittedly know little to nothing about brain injuries, although along with chiropractors who are the first doctors often seen after a slip and fall or foot ball injury or car crash.  Most experts will not play the killing games of Workers Compensation, as they took an OATH TO DO NO HARM.  Did you?

Also, encourage investigations into who writes these regurgitations called reports, without benefit of legitimate medical evaluations, and how much money is wasted. Investigate why/how defense firms can have the pattern and practice omission of hundreds of pages of medical records with intent to deny medical care.

Governor Brown, could you kindly have the Attorney General Investigations of corruption at the highest levels of Workers Compensation, and encourage Governors across the USA to do like-wise, and dispatch the National Guard to protect injured workers from these WorkCompsters? Orders are face to face medical exams for the first set of chronological providers, separated by year by an underline….starting in 2012. (Blatant disregard of ACOEM/MTUS guidelines, but that’s for another blog.) Second set are CorVel and Maximus regurgitation reports, apparently written by RNs or others and signed by a variety of doctors, citing guidelines for necessary treatment, and somehow denying it anyway.  Plenty of expensive bla bla bla.  DO THE MATH. FOLLOW THE MONEY. ASK MORE QUESTIONS?

For now, let’s just make the list.  Is your name on it?    “Let’s get started.”  Remember, all of these people have made money for seeing/knowing the Injured Worker.  Did they all provide “care” or “medical treatment”?

In contrast, Injured Worker was denied benefits, denied medical care, forced to file for welfare with Social Services and rely on the charity of friends and the Salvation Army—-proving that with Wyndham Timeshare, there are “No Free Gifts” and there is blatant and callous disregard for lives of injured workers and customers.  A friend shared this link with more news on how Wyndham Worldwide behaves in the global marketplace.

While WCAB seems to deem “evaluation after evaluation after evaluation” as evidence of InjuredWorkers receiving medical care, the Information and Assistance Officer, last resort for help for unrepresented Injured Workers, is not a doctor, nor a lawyer, and practice without those licenses is questionable indeed.

The dubiousness appears compounded when good doctors properly make legitimate and conservative recommendations for immediate and necessary care, only to have the recommendations denied by attorneys and adjusters in 2012, then, aided and abetted by Team CorVel.  Advising an Injured Worker to “have better control” of counsel when represented is a joke—if CAAA can’t police their own members, how can a Worker with a Brain Injury be expected to know when representation proves to be totally incompetent, dangerous, and worse?

CAB Commissioners and DIR seem complicit in the Gravy Train, at least in this case, which so many Super Lawyers indicate is ‘just how it is’ — happens to everyone — very common case, or maybe they just don’t know.  More on attorneys in another blog.

Follow this blog for more details that everybody knows but has kept the dirty secrets behind closed doors, while American workers and taxpayers pay and pay and pay—-with life, liberty and justice for none attacked by the Workers Compensation maiming killing brigades.

By the time you finish reading this blog, you will have a better idea of why Workers Compensation Survivors call it a GRAVY TRAIN WRECK.  (Some of these doctors were paid by CNA, some were paid by CIGNA, some were paid by the Injured Worker (unreimbursed medical expenses and miles to date exceed $43,300 – failures to receive adequate treatment have caused permanent and irreparable damage to IW.

Without WorkersCompensation, legitimate insurance would have facilitated care that would have been immediate, expert, reasonable, beneficial and IW may have returned to work within months, back in 2012. Without care, Injured Worker has been advised to make plans for Assisted Living in light of risk of dementia, with a need for personal assistance now.  Thanks WorkCompsters!

Open Letter to CAAA Members — Why you cause such harm to Injured Workers? You no make enough money?

Years ago I asked an ol’ Sicilian Godfather type character, “Will you tell me, please, what is the secret to making lots of money?”  He said, “I will tell you.  It is very simple.  You find a need, then you fill it.”

What I have discovered about the majority of the members of the California Applicant Attorney’s Association membership is that they are generally burnt out, angry, disgruntled, overworked, screwed out of a decent wage by the chicanery of the Defense firms, and the end result is more casualties in the American Work Force. I’ve talked with plenty of you, from here to Northern California.  Most of you have been polite and cordial, but compassion is a rare quality in your ilk, isn’t it?

In my case, people say, ‘Oh.  She had 4 attorneys.  She must be hard to work with.’  BLAME THE VICTIM, THAT’S HOW YOU SLEEP AT NIGHT?

Because the majority of CAAA attorneys seem impotent in the Art of Negotiation, and seem to feel condemned to working for what probably figures out to be about $10.00 an hour?   The end result is badly managed work comp cases, workers that don’t get medical care, and as one of the four retained and dismissed in my case advised:

“Most of my clients don’t get medical care, they lose their jobs and their homes; it’s just how it is.”  

That one attempted to coerce me to accept a premature settlement offer for a 1/9/12 brain injury for the ol’ $100,000, less legal fees, in November 2012, without benefit of having seen the specialist doctors recommended repeatedly, and denied not by UR but by the adjuster and the defense counsel.

He advised that, “Nobody will believe you have a brain injury. Work comp is a small community….”   I told him I was injured not stupid and that if nobody would believe it  was only because he didn’t do his job and get me to brain injury doctors, as repeatedly recommended by all the evaluating doctors I had been sent to.  How much money did the approximately 40 evaluating doctors plus CorVel & Maximus peeps make off my life so far?  How much do the defense attorneys make by continuously harming me?  And how about those adjusters and their fraud department that backs them up?

I’ve spent close to $50,000 on medical expenses trying to Survive WorkComp, and to clean up the legal messes CREATED BY YOUR MEMBERS, and have lost professional credentials and earning capacity, and I haven’t worked since 1/9/12.  Just because I can type doesn’t mean my brain injury healed on the rest and wait and wait and wait and wait CNA plan.

If CAAA members learned a bit about negotiations, they might find it reasonable to find alternatives to scavenger, bottom feeder type holds with liens when prior counsel has done nothing but harm the injured worker by doing a poor job, or no job at all.

One  attorney’s I retained, when I advised his office they were being retained because the defense has a nasty pattern and practice of omitting hundreds of pages of medical records with intent (and success) to deny medical care, I was assured I would not be sent to any evaluations until the matter was resolved.  Was that ever a whopper, committed by non-supervised “case manager’ practicing law without a license, another pattern similar to the QME/AME  doctor reports written not by the doctors, but by the non-medical staff.

Then, in writing, he battered me and accused me of desperately needing mental health care, and arrogantly stated that “There is no conspiracy to omit medical records in your case.”  He sent me to a very dubious AME eval, without medical records, and I am still paying for his incompetence.  By the way, it took nearly 8 hours in Court to get the Judge to order the Defense to send the omitted records to the two involved doctors (of the time) and to request a supplemental report.  Well, she sent them all right, not separately, not identified, but just in a new disorganized box and suggested the doctor find them and see if they made any difference in the conclusions. Then she did it again with the next QME, in December 2013. That’s 2 attorneys and highlights of their arrogance and incompetence.

The first one hardly counts, as it was not an attorney at all, it was a 60 second meet and greet with the attorney, then turned over to the Office Manager, who chanted, “There is no psych component to a WorkComp case” and promptly (next day) had me scheduled with an Orthopedic Surgeon on El Paseo in Palm Desert — FOR A BRAIN INJURY.   I got lost trying to find the front door, and entered through the employee entrance in the back — nobody but me found that odd.    The last one, rather than read the files I sent, and deal with the mess created by #3, merely agreed to yet another Orthopedic evaluation in late 2013.

Primary treating doctor has been an Orthopedic Surgeon (from 2/2013 through 12/2014 — I have had NO PTP since 12/2014—hardly matters, as there has been little-to-no care, just excessive evaluation upon evaluation, in true WorkComp Gravy Train fashion.

That’s 4 attorneys — #1 for 30 days in 2012, #2 for 9 months in 2012, #3 for 90 days in 2013 and #4 for 45 days in 2013/2014.  When I have asked them to release their liens so that I can find an attorney to help me, they just say no.

The office of #3, in an attempt to console me, said, “Oh, it makes no difference to you that he won’t release the lien  You get the same in any event.  It doesn’t matter if you have 1 or 5 or 10 attorneys, they divide up the 15%.”  I said, but you don’t understand, each of the 4 did more harm to me than the other, and I have a brain injury, and I can’t figure this crap out, there’s no integrity, fraud is NOT prosecuted, and the defense just makes stuff up and the WCAB supports it, and I can’t find competent counsel to represent me.

I’ve been told everything from “there’s no money in it” “previous attorneys didn’t do their job”  “the medical records were not properly developed” “there’s too much fraud—it’s over my head” “you’ve already had 1 attorney”  “you’ve already had 2 attorneys”  “you’ve already had 3 attorneys”  “you’ve already have 4 attorneys”  “nobody will be #5”

I asked one Judge to authorize me to pay someone hourly to help me. I can’t even find legal aid or a paralegal to help me. It seems that the WorkComp rackets have everything locked down.  There are even federally funded brain injury advocacy groups THAT REFUSE TO HELP AN AMERICAN WITH BRAIN INJURY IF THE INJURY HAPPENED AT WORK!

I have a brain injury plus it’s work comp.  The Information and Assistance office has clearly given me erroneous information SINCE FIRST MEETING IN 2012, and badgered me, abused me, violated ADA and civil rights,  and made it quite whose side she works for.  In Injured Worker circles, the experience of most I & A Officers is the same, so I don’t take it personally.  But, know that when you tell injured workers to see the I & A officer, you’re condemning them to more harm, and your credibility is further reduced.

WHAT IS A SOLUTION?

I tell you this because it’s identifying a need, that you can fill, and I can only scream about.  Your industry vendors are even afraid to work with/for an Injured Worker, in Pro Per.  Your industry doctors, playing hot shot, even return properly served medical records and threaten to sue an injured worker for daring to properly send such documents. Your vendors make it clear that they only take directions from “the adjuster” or  “The Defense”.

I even asked at WCAB for a list of possible attorneys in 2013.  I found one who answered his own phone.  Trouble is, he no longer works for injured workers.  He works for The Defense.  I got quiet and asked, “Tell me, why did you go to the Dark Side?”” He got quiet and said, “Because that’s where the money is.”

So, for starters, if you are approached by an injured worker with a brain injury, if you know nothing about brain injury, give them immediately a letter of non-engagement, and a referral if you can.

Then, set up some training sessions for your members for negotiations, and start with studies of Psychopaths…ie. DEFENSE AGAINST THE PSYCHOPATH.  It will help your members understand the Defense, and may reveal similar traits that may cause them to just head over to the Dark Side.

Watch it again, and tell your friends and neighbors.

Then, in each of your offices, set up an InProPer division, or something similar, with a Paralegal component, and an hourly fee, with a provision to take over the case when attorney liens are withdrawn.

DO SOMETHING TO HELP CLEAN UP THE MESS THAT YOUR INCOMPETENT COLLEAGUES CREATE, AND GET THEIR FANGS OUT OF THE LIENS THAT RESULT TO NOTHING FOR ANYBODY.

OH YEAH, OPEN YOUR FANCY CONFERENCES TO INJURED WORKERS, PARTICULARLY YOUR EXHIBIT HALLS.  IF YOU WON’T REPRESENT US, HELP US FIND THE RESOURCES TO REPRESENT OURSELVES.

Do some client follow up…… you may find gross dissatisfaction with your industry by injured workers and doctors.  You can blame injured workers all day long for your own shortcomings, but…in the end, you know the truth.

I will never forget the attorney who called me back around 8 o’clock one evening, screaming and swearing that he was working so late, and when I explained my case, to the best of my abilities, he called me “one of those work comp pariahs” and that he knew the defense counsel.  He assured me that ‘fraud’ was not a possibility; “incompetence, yes, but she is not capable of fraud”…. (That was his opinion; evidence points in the other direction.)

GIVE IT SOME THOUGHT…… IF YOU CAN’T HELP INJURED WORKERS, EITHER FIND SOME WAYS TO HELP THE IN PRO PER POPULATION, OR BE ASSURED, WE WILL DO ALL WE CAN TO GET YOU OUT OF THE EQUATIONS TOTALLY, and FIND WAYS TO HOLD YOU AND YOURS ACCOUNTABLE FOR THE HARM YOU CAUSE TO THE INJURED WORKER POPULATIONS IN CALIFORNIA, AND YOUR COLLEAGUES IN ALL STATES OF THE UNION.

US Constitutional 5th and 14th Amendments immediately come to mind, and the secret police type reports Grancell encourages to protect fraudulent medical reports of their payees seems to violate Article 14 of the California Constitution, for starters.

As defense is attempting to falsely claim this accident did not occur at work, is Wyndham Worldwide committing fraud, or is it just the Defense Firm personnel and the doctors they have involved in their chicanery via omission of medical records and misleading cover letters?  Now, if they say I did fall backwards on ice and hit my head real hard, as the DWC-1 statement on date of injury so indicates, and is signed by the Admin Manager, and they know I haven’t worked or been right since, then Wyndham appears to be only guilty of collusion to keep the dirty secrets, and human rights failures to come to the aid of an injured worker, and failures to hold their vendors accountable for bullying and egregious harm to an Injured Wyndham Worker.

Back in 2013, I asked a Judge to authorize me to pay an hourly consult to a WorkComp lawyer, as indicated in the Christopher A. Ball book for Injured Workers, recommended on the WCAB site.  It is called California Workers’ Comp HOW TO TAKE CHARGE WHEN YOU’RE INJURED ON THE JOB.  The Judge declined; said it was against the law.

I have dismissed 4 law firms that seemed very confused about the difference between a broken finger and a brain injury, so not a good fit for attempting to get medical care. I have accomplished more than all 4 of them on my own., and I have accomplished quite little.  So, that leaves me without legal counsel, with a brain injury, fighting organized crime, armed with the will to survive and the ability to type and blog.  Ain’t that nothing, America!

As you know, on January 9, 2012, in efforts to help my co-workers get inside the office, during a snow storm, in which we were locked out, I told my manager I thought the window at my table might be unlocked, and we walked over to check the window.  It was locked.  My manager made it back to the side walk safely;  I slipped on ice and fell backwards, and hit my head very very hard.  I laid on the ground for I don’t know how long, my keys went flying and when my manager asked, “Are you ok?” I said, “No, I’m not.  I hit my head reallly reallly reallly hard.” Somebody took my briefcase inside the office but I had to go outside later to find my keys, that I do remember, because they were not in my handbag.

After a little while, he helped me up.  I’m in sales.  We are ‘trained’ to leave our troubles at the door.  I dusted all the snow off of me, and went inside to attend the Sales Huddle.  My colleagues had a good laugh.  I forget who said it, but someone said, “Ewwwwwww, Linda has Fukushima Rads all over her now!”  (I had shared with them how radioactive snow is, as the snowflakes latch on to the radioactive isotopes like scavengers, and encouraged dodging the snow flakes, by any means necessary.)  I got “in trouble” for sharing this picture in the break room in 2011… I was told it was not very positive; it illustrates the impact of radiation poisoning.

Later, the Administrative Manager asked if I was going to see a doctor, and I said yes, and I asked, “Do I have to see any special doctor?”  He said, “Just see any doctor that accepts workers comp insurance” and he gave me an incomplete “DWC-1” form — he signed it, but it had no insurance company information on it, and no doctor could accept it, and the office did not return the doctor’s calls.

Remember, Wyndham staff did not offer to call 911 or even bother to take me or offer a ride to Urgent Care or an Emergency Room. Previously, I dropped everything and took a co-worker to Urgent Care as she was complaining of chest pains to everybody.  HR had no plan in place for dealing with such issues, either.  Perhaps staff is “too young or too stupid” to make life affirming decisions.

My guests, at the first wave tour, knew I was clearly dazed and confused, and they got their “gift” without any hard-sell….just gratitude that they were understanding about my confusion, as I told them I had slipped on ice and hit my head real hard that morning.

I went to the doctor after work, God only knows how I drove down that icy mountain road.  For some reason, I don’t know why, an hour trip took over two hours.  When I saw the chiropractor (I thought I just needed a little adjustment for my neck and back) but the doctor said I had a concussion.  I didn’t know what that meant.  He suggested I would feel like I’d been hit by a truck in a few days, but in a few weeks I’d probably be fine  He was right about feeling like I’d been hit by a truck.  I vaguely remember having to use both hands to lift my head up from bed, and I slept a lot –

I went to the Urgent care a few days later, since someone told me people can die from head injuries; they could not take the DWC-1 form, but they kindly accepted the CIGNA employee health insurance (which CIGNA had to fax to them, since I couldn’t find the card).  I got lost going to that doctor’s office, then lost again going home waiting for CIGNA to fax them the card, and disoriented on return.  Defense likes to say that doctor said I wasn’t dizzy, disoriented or confused.  D’oh!  The office is less than 5 miles from home, in rural Yucca Valley.

I had already called the EAP – Employee Assistance Program — because I was so confused, couldn’t think, and was having trouble talking, and my words were slurring.  I haven’t had a drink or drug in over 28 years.  People said I sounded drunk.  Not a good sign.  EAP connected me with a clinical psychologist who referred me to a local neurologist (who refused to see me since it was work comp, at a scheduled appointment; his office perjured and said I failed to appear for appointment; I begged for help or at least a referral when they turned me away.

As many of you know, I am currently enrolled in the Coastline Community College State run ACQUIRED BRAIN INJURY PROGRAM.  It is a one to two year program, and it helping me tremendously, in learning compensatory skills, and in ‘resocialization’ — being in a community with other brain injury survivors is remarkable, and yes, we compare notes on the chicanery of the legal and insurance psychopaths—the stories are all quite similar.  We do need Nuremberg type trials, and this time, include the lawyers and their ilk.

I am learning a new software to compensate for cognitive impairments…. including loss of working memory…. I haven’t quite figured out how to get the images out of the software into the blog, so I have resorted to copy and paste.  I think you can see the big picture of what I am currently dealing with.  Future blogs may have better presentation, as I am currently studying how this software can make up for my loss of working memory.  It really helps me to see the ‘big picture’ again.

We are also learning about learning styles, and how our brain injuries impact our need to focus on strategies to be more “concrete sequential” in our new approach to life.  This software, with several other apps and devices, serves as cognitive aids.

Bottom line, it’s just more dreadful fraud and legal chicanery.  I could just spit at the vileness of it all.  Anyway, If you have any suggestions on how to best approach the Judge.  I don’t really believe I can be compelled to participate in felony fraud in an ongoing workers compensation scam by  the defense firm and insurance carrier representing my employer, Wyndham Worldwide.

As many of you know, the medical care I have received, I have had to pay for myself, now exceeding over $43,000.  CNA refused to pay TTD benefits in 2012, shifted the cost burden to the State, then finally paid the State back in 2014, at a dramatic discount.  They said it’s legal because EDD “negotiated” a $49k payback to $31,000 payback.  I don’t think the State Controller knows, but lawyers and EDD tell me it “happens all the time.”  As a consequence, instead of “104 weeks of TTD” payable by Work Comp Carrier, followed by ” up to 52 weeks of State Disability” I got cheated out not only medical care that would have possibly facilitated return to work, but I had no income for months and months and months (translation; had to rely on Salvation Army for help!) but I got cheated out of the EDD “up to 52 weeks” and those funds went back to CNA for bottom line profits.

It’s a brain storming tool, and helps compensate for impaired loss of working memory.

It’s a little embarrassing that I cannot figure out how to ‘export’ or ‘transfer’ this info as the software is designed to, but it does serve as an example of my creative work-arounds and compensatory strategies.   The outline text is below.

 

Remember, in my pre-brain-injury life, I was a Database Queen, I served years ago as an Executive Assistant to some serious Captains of Global Industries, and it took smarts and serious speed and cognitive functions to keep them organized, and my work included intense logistics, keeping them on meeting schedules, to private planes, yachts and limos, political events and more.  

So, when I read some of the fraudulent statements of some well paid insurance industry doctors, you might imagine how I could just spit at the audacity of these little thugs.  One government agent, as I told some of the tales of the corrupution and horrors I have been exposed to, asked, “How can they sleep at night?”  I said, “Psychopaths have no sleep problems.”

As many of you also know, I lost professional credentials due to the untreated brain injury.  I lost my Hawaii Real Estate Sales License, California Real Estate Broker’s license, and California Notary Commission.  While I have not hope to be able to restore my Hawaii license, I was able this year to reinstate my California Real Estate Broker’s license, and just yesterday, I took my Oath for my California Notary Commission.   Yes, I take my Oaths seriously, always have, always will:

Bottom line to the question of LinkedIn and Anonymity? ‘Anonymous Precedes Unanimous.’ When in doubt, ask another question, WHAT WOULD SUN TZU do?

My posts and blogs are definitely perceived, by some, as a ‘whistleblowing threat’, and by others, as hope and encouragement, and validation of the 1st amendment and a reminder that ‘We do not have the right to remain silent in the face of domestic atrocities either.’

LinkedIn Premium, as you no doubt know, provides a wealth of information about profile viewers and potential connections. I have been blessed to connect with some pretty wonderful people over the months.

It also provides a microphone to reach those who might never hear the truth about Workers Compensation (or Fukushima, for that matter). People with much to ‘lose’ by publicly acknowledging the truth of some of our 21st Century horrors can sometimes best work behind the scenes, hence their use of Anonymity. Maybe we’ll hear from some of them? I’ll ask, too.

Side note: I used a ‘pen name’ on Facebook for years, until the FB Thought Police demanded ‘papers’ for identification, and I was locked out of my account until I resumed using my legal name.

The Anonymous views on my profile are relatively few, and often come in groups of views by insurance, law practice, marketing and advertising, hospital and health care, and hospitality industries, by people with job titles such as lawyer/judge, founder/partner, journalist, consultant, salesperson, non-profit board member, business/corporate strategist… primarily from locations in LA, NYC, Chicago and Orlando, and secondarily from San Francisco, Boston, Orange County and Atlanta.

Where are the doctors? Maybe they are in the Anonymous Groups? One industry leased/owned doctor said that ‘if she has human rights complaints, tell her to take it to The Hague’ and suggested I not [just] threaten to file complaints with District Attorney, and provided a direct line to the DA in his jurisdiction.

I am an Injured Worker, callously and egregiously harmed by my employer’s WorkComp insurance carrier and related vendors.

Super Lawyers have advised me that as sad as my tale is, it is quite common. Several lawyers have declined to represent me, stating that ‘there is entirely too much fraud’ involved; others have said, they ‘have not had to deal with issues of fraud since law school and wouldn’t know where to begin’. Doctors have told me they see such failures to treat all the time, and encourage me to scream as loud as I can.

Although I have had a LinkedIn account for several years, I have only in recent months began to use it. Premium allows maximum velocity. Workers Compensation is a mega billion dollar industry, which has a business model of Profits Before Lives, and they are killing Americans everywhere. Thanks to LinkedIn opportunities, I have been able to find more good people in the industry; there are a few. Most are unwilling to risk to expose the truth, but they also encourage learning to whistle.

My activism reaches the nuclear world also, as I have been posting about the global disaster of Fukushima Daiichi since March 2011.

Some legal news last months included ‘threats’ that Social Security will be using Facebook posts in determining benefit awards to disabled people. LOL…. I tell my friends and neighbors that the audience is widening, blog on! #OccupyVirtually!

On Facebook, “Anonymous” has a different ‘spin’ than on LinkedIn. When industry trolls and other paid provocateurs attack those who share the harsh realities about nuclear disaster and other domestic and international threats, said provocateur ‘profiles’ are often found to be totally secured, with few ‘Friends’ and no real background.

Over the years, there have been ‘urban myths’ on Facebook that there is an “app” that allows one to see who has viewed their file. I have gone back to Facebook with delight and reported that: ‘Hey, that app that lets us see who has been viewing our profiles is over there at LinkedIn. It’s tooo coool! C’mon, Are you LinkedIn yet?’

The internet levels the playing field in the fight for survival. Since my head injury of 1/9/12, and the carrier’s failures and refusals to provide medically necessary treatment, I had been house bound for nearly 2.5 years, only going out to doctor evaluations, used as weapons to deny recommended treatments. I am injured; not stupid. I am now enrolled in a 1-2 year program for Brain Injury compensatory strategies and transition back to the work world, hopefully. If not work, then a volunteer position is in my probable future. I’m hopeful for return to work.

I like to ‘repurpose’ writings, so I will include this in a LinkedIn blog, directing people back to your wonderful post! It’s how we encourage more critical thinking, isn’t it?
