With a nudge from DOL and DOJ, per the Congressional letter of October 2015, maybe the DAs can do a better job in 2016. Kudos for what they did do. They must do more. A hotline for Injured Workers to report suspected fraud could save millions….lives and dollars.

I received an inquiry from an investigative reporter in the UK…. topic? MAXIMUS. I suggested they will be busy writing investigative reports….likely for YEARS AND YEARS. I asked for a link to the documentary when it is done. I said it might save lives in the USA.

Injured Workers in CA seeking new legal counsel – Orange County and San Diego

CAN YOU RECOMMEND COUNSEL FOR INJURED WORKERS FIGHTING FOR LIFE WITH SEDGWICK IN California and/or Minnesota? Or a Mediator with successful fights for Injured Workers against Sedgwick?

As an Injured Worker and blogger with a case that reached resolution with quite little thanks to CAAA members, Injured Workers are reaching out to me for help.

All I can basically tell them is “blog like hell, and scream like your life depends on it, because it does.” And I can pass on advice given to my by doctors and lawyers, “Get out of the work comp system as fast as you can, by any means necessary. It will kill you.” Yeah, doctors and lawyers told me that, WorkComp doctors and lawyers. Can’t make that stuff up!

I had been invited to the CAAA 50th Anniversary dinner this coming Saturday, but the CAAA office staff made if quite clear, with great contempt and disdain, that INJURED WORKERS ARE NOT WELCOME and the registration was apparently lost, just like so many medical records in the WorkComp systems.. Alrighty then, when one thing doesn’t work, we do other things.

Today I received another call from a woman in her mid-40’s, a case eerily similar to the Charles Romano case. It is over 20 years old, and has gone from bad to worse. In recent weeks, I have been in communication with the family of a woman in her 40’s, eerily similar to the Charles Romano case.

Since I am unable to attend the #CAAA conference this week to hear Alan Gurvey’s “PUBLIC FORUM” on medical treatment for Injured Workers, and David DePaolo, Tom Martin and Keith More on The ProPublica/NPR Investigative Reports: Affecting change, I can meet with one of the the Sedgwick victims and show her and her husband how to blog. I may meet with the others via Skype and show them how to blog.

#WoW…. it’s indeed a War On Workers. It’s horrifying to listen to the tales of younger workers being maimed and their lives destroyed for the profit and greed and psychopathY of the few. They have been taught to blame Arnold. What a deception. It’s much deeper than any one politician. There truly seems to be little hope for the American working class.

Let’s see what, if anything, comes out of the CAAA convention…

I hope the gentlemen handling the panel on ProPublica and The Demolition of Workers Compensation discussions GIVE ‘EM HELL.

I don’t think David, Tom and Keith will sugar coat the horrors they are fully cognizant of in the California system.

Let’s hope next convention they open the doors to Injured Workers, whom they allege to represent. (The privilege I had in 2014 to visit in the CAAA Winter Convention Exhibit Hall… may have saved my life. I did meet some wonderful and powerful people of goodwill. Too bad no other injured workers will get that opportunity, at least not via CAAA.)

I think all providers need to do a survey of Injured Worker clients to get a reality check on ‘SATISFACTION” levels.

IMHO, CAAA has nothing at all to ‘celebrate’ as long as injured workers are being maimed and killed by legislated and supported fraud. Maybe they should create a self-help training course for self-represented Injured Workers…. more lives might be spared.

Nevertheless, they need competent legal representation. Can you recommend anybody in Orange County/ San Diego areas who can take over currently represented cases that have had the same attorney (respectively) for more than 20 years? The “2-attorney-rule” does not apply, so these Injured Workers must make a smart decision if they decide upon change.

Why does California demand that Orthopedic Surgeons be the primary treating doctors for BRAIN INJURED WORKERS?  Nobody in Sacramento has ever head of ACOEM and MTUS and NIH for guidelines on treatment?  Doesn’t California WorkComp have any PHYSIATRISTS either to refer brain injured workers to?

The WCAB and defense teams seem to act like that’s a made up word when such is requested as a PTP!  WorkComp neurologists are essentially clueless about brains, not even knowing that vision and hearing are functions of the brain!  D’oh!  7th Grade Kids seem to know more about brains than California QME/QME “Neurologists” and CorVel/Maximus “doctors.”

I don’t think the Gov’s “Oath of Office” promotes Chivalry to Ms. Baker, DIR, WCAB, Insurance Industries before the Common Good, does it? I could be wrong…. WorkComp does seems to have it’s own rules, courts and subsidies, huh, operating outside the Constitution of The United States of America on multiple issues, doesn’t it?  Outside the California Constitution on multiple issues, as well.  
 
Is there a Civil Rights lawyer in the house?  Has the BIA – Brain Injury Association of America been consulted?  Have any Injured Workers been consulted? Was CAAA consulted?   How about the leading mouth-pieces for the industry?

Does ProPublica know about this?  Sounds like a PS to THE DEMOLITION OF WORKERS COMPENSATION!

Let’s watch the unfolding drama. Investigations and Indictments seem to be in order. Will DOJ and FBI investigate these suspicious acts? We can continue to wait and wait and wait and hope.

California needs Federal Overseers of WorkComp practices to protect the Working Class, and we need it NOW!
 .
I am not too alarmed, however.  WorkComp doesn’t  seem to have any neuropsychologists to refer Injured Worker’s to anyway, for at least the past ten years, based on input from Injured Workers in Southern California.
 .
Orthopedic Surgeons seem to be the norm to be designated as treating doctors, and they joyfully report they have no knowledge of brain injuries.  
 .
(This seems to be a very weak link in their practices, since accidents with broken bones often can include head injuries…. their Society might take a closer look, or, like NFL, involve the cardiologists? D’oh!  )
 .
CAAA practices don’t seem to be much better or stronger when it comes to brain injuries; some of their members do as much harm as those paid to harm injured workers, through willful ignorance or ‘not enough money in it’ syndromes)
GRAVY TRAIN WRECK
 
Last year, one case, defense tried to send the TBI survivor to a neuropsychologist for yet another evaluation–one who admitted hadn’t treated brain injury patients for over seven years…  Just apparently real busy and profitable doing evaluations for Work Compsters.  [
 .
The three neuropsychologists who evaluated this injured worker (two in 2012, one in 2014) were all approved/authorized outside of the alleged MPN.  
 .
The adjuster apparently had no clue as to what type of doctor to send the Injured Worker to, and the EAP program (that IW was originally referred to a Clinical Psychologist) was a bit of good luck, as that CP doctor had tremendous brain injury knowledge, as his own son was recovering from a devastating brain injury, with the help of an interdisciplinary team of doctors and specialists.  
That clinical psychologist helped walked the rookie adjuster through the process, clearly describing the dangers and the needs for immediate and appropriate medical care.  The Injured Worker had to pay for the MRI’s recommended in both 2012 and again in 2014.  
 .
WorkComp peeps seem to dispute the location of the brain, and attempt to pretend it is not a body part.
 .
WorkComp seems to approve primarily Orthopedic Surgeons and Chiropractors for brain injury, with a little PT and 40 or so face to face evaluations, and countless re-evalulations by CorVel doctors—who also seem to know little to nothing about brains.  
 .
It took nearly 3 years for the mentioned Injured Worker to get to a speech therapist and occupational therapist (3-6 months treatment were required, 16 days were authorized, then extended another 8).  
 .
One of the WorkComp leased/owned neurologists suggested that since care had been denied for two years (at that time) and since the injured worker was female and over the age of 35, no treatment was deemed necessary, contrary to all medical evidence.
 .
The primary treating doctor since Feb 2013 has been an orthopedic surgeon, and the bulk of the denying Corvell doctors have been orthopedic surgeons. WorkComp neurologists and CorvVel and Maximus doctors seem to be simply clueless about head injuries…..or are they paid to just look the other way and write false reports to ensure denial of medical care.  
 .
Responses from DIR over the course will be located and  forwarded  to appropriate authorities.  Seems this situation may call for intervention, finally, by DOJ/FBI.

Years ago, I volunteered in a goodwill effort with and for Convicts in America’s Maximum Security Penitentiaries. It was called “PRISONERS UNANIMOUS — EMBRACING ALL PLANETARY PRISONERS”  Maybe you heard of it?

Check FOIA, they probably have several CDs including my visits to penitentiaries across America, and my communications with a handful of government officials, goodwill organizers, friends and families of prisoners, and approximately 1,000 Convicts across America.

I think I was the second woman “in history” to “walk the ranges” at USP Marion Federal Penitentiary, back in the days when it was deemed ‘the worst of the worst” prisons, surpassed today by, so I hear, the likes of Pelican Bay.  It was after allegations of a “full scale Nazi-type of retaliation attack” on the entire Convict population.  I was corresponding with several of the Convicts listed in that dreadful “Public Report.”  I sent copies everywhere, including Amnesty International in Vienna, where they allegedly WATCH for human violations in the Americas.  Hmph.

The Guys and I established an “8 o’clock, local time” prayer network when they educated me about how deplorable America’s “Corrections” system is.  Now, privatized prisons are a bigger part of the “PROFITS BEFORE LIVES” industries.  Some of us still link up, no doubt.

The guys told me how bad things were, and said I was very brave.  They said the prison systems in America are very dangerous, and that I had better think long and hard about touching it.

They told me, “Lady, you better know what you’re willing to die for, because you might well be asked to do so if you get involved in attempting to facilitate change.”

They further advised, “Lady, we Convicts are not the problems in your country. We are the end result of the problems in your country.  If you want change, you have to go Washington.  That’s where the problems are.”   (There is something far more polite and respectful from a Convict calling a correspondent “Lady” than the pretentious “Ms. Ayres” used by defense and psychopaths, wouldn’t you agree?)

Those words reverberate in my head as if they were yesterday. I have never forgotten those haunting words.  As a Survivor of WorkersCompensation today, I know ever more how true they are.

IT’S A GRAVY TRAIN!

ONWARD:

#WorkCompsters have made that choice easier today.  They have already taken my life. 

Too often, Injured Workers make poor choices in efforts to retain competent legal counsel, much to the detriment of the Injured Worker.

This is often not discovered by injured workers until the 2nd, 3rd or 4th attempt to retain competent counsel.

Including THIS warning in every employee new hire packet, and every Human Resources orientation in California could save lives.

Till then, tell your friends and neighbors, and tell them to tell theirs. WorkComp Kills, without consequences to anybody but the Injured Workers and their loved ones.

Many Injured Workers have even sought the help of ACLU and NLG, to no avail.

We are, however, grateful for the organization, NAIDW.org, National Association of Injured and Disabled Workers, for the encouragement, resources and support they provide, and having been providing for many years. “No Injured Worker Left Behind” Semper Fi, Y’all!

We like a few of the industry bloggers who do their best to do their best for the highest good of all concerned.   Cognitive Dissonance seems to be kicking some butt in that arena, wouldn’t you agree?

Bravo to ProPublica for being a catalyst for discussion and possible change. Bravo to WorkCompCentral for relentless efforts at education and inciting legitimate discussions about the need for national discussion and change.

Let’s get beyond “PROFITS BEFORE LIVES”…. let’s incarcerate a few psychopaths for maiming and  killing injured workers, too, shall we?

It matters not if the killers are making $250K a year, or $10.7 million or more a year.  With proper trials first, of course.  FBI and DA and DOJ  need to better orchestrate their efforts, ya think?

Crime is Crime, and CRIME SHOULD NOT PAY IN AMERICA.

For personal assistance in my own, but common,  horrific case on non-stop abuse of a permanently disabled-by-untreated-brain-injury-and-various-acts-of-legal-chicanery-and-file-churning, older female worker, a local crisis center sent a Marine to help me last year.  The Marine Social Worker, kind, fierce and very helpful.

MMI neuro-psychologist report recently received (and posted!)  says my future medical needs include similar support, with probability of needs for assisted living and ‘memory care’ for my shortened life span, shortened due to WorkCompsters and corruption, involving many unclean hands. Hmph, Some “Grand Bargain, California!”

Legitimate doctors in 2012 made legitimate and conservative recommendations for medical care, denied. Had treatment not been denied by the defense counsel (not doctors, just defense lawyer and adjuster for 2012, till 2013 came along for the extreme profits of CorVel to obfuscate facts with intent to deny medical care.)  return to work might have happened in 2012.

After threats from defense counsel, then PTP released me to work with accommodations, which were denied in October 2012.  Things got worse from there, without medical care.  I have been fighting to return to work for years, to no avail.

I have endured being penny-less, relying on The Salvation Army for utilities,  filing for social welfare due to carrier arrogant practice of denials of payment of TTD, “because they could” (and they were rewarded handsomely by EDD for refusing to pay in 2012/2013 and for refusing to provided medical care.  Now, SSA is involved in the charades and chicanery, and trying to sort it all out.

Is it a felony for carriers to provide SSA and EDD with false evidence of benefits paid with intent to deny SSA benefits?  Seems to be part of a set of RICO violations, wouldn’t you think?

Yet evaluations upon evaluations upon evaluations have been performed by approximately 38 doctors (ca-ching, no care, just primarily report regurgitations written  by non-medical staff, signed by doctors, paid the big bucks).

While we are at it, omission of medical records and obfuscation of facts seems facilitated by the silly “chronological” ordering of medical evidence, rather than by specialty, then by chronological order.   Carrier in my case gets charged by most doctors 4-8 hours for “organizing the records”…. and maybe it’s not all the signing leased doctor’s fault their non-medical staff do things like change the date of injury to a year forward, then use first year medical evidence to falsely opine “pre-existing” symptoms.  D’oh.  Number of hours spent during an evaluation are often “inflated” and far worse, totally fabricated!

The majority of Lawyers don’t seem to care.  They  shrug say ‘their hands are tied” (and “their lips are sealed?!!!”)  Others have told me “Too much fraud in your case, it’s over my head” and “Too many people didn’t do their jobs, there’s no money in it for me”….

One interviewed actually had the audacity to ask, after pages of questions had been answered, “One more question, tell me, why did you wait over 2.5 years for medical care for a brain injury?”  D’OH!   That didn’t even merit a final response, and that attorney came HIGHLY RECOMMENDED.

Here’s my story, again.  Date of witnessed slip and fall backwards on ice, resulting in Concussion/Traumatic Brain injury 1/9/12 while working for Wyndham Worldwide.

The blogs. ASK ABOUT WORKERS COMP GRAVY TRAINS, began in the Summer of 2013, and continue as the only means available to fight for my life against the widely known corruption of the national WORKERS COMPENSATION SYSTEMS.

What kind of system do YOU profit by that requires someone with a brain injury to represent herself because your colleagues (4 of them) could be found guilty of ABA Ethics Violations and Incompetent Representation?

Due to your accepted CA  legislated fraud regulations, and your “2 attorney” superstitions, Injured Workers bear the brunt of the lack of expertise of your crowd/CAAA memberhips.  This also allows Defense Firms to claim the title ENEMIES OF INJURED AMERICAN WORKERS.

How many injured workers retain and dismiss multiple attorneys, as the corruption is tolerated by those retained to protect injured workers? How many injured workers in California, and in America, must represent themselves due to the failure of the ABA crowds?  Some have said that more than 15% of Injured Workers are InProPer…. probably as a last resort, not a first.

Why do your various profit centers/industries refuse to work with InProPer Injured Workers, and why do your industry leased/owned doctors seem so puzzled, baffled and perplexed by the legality of an Injured Worker self-representing? Why do the medical office staffs believe they can ONLY TAKE ORDERS from the Adjuster or Defense Firm?

IS THIS SIMPLY ANOTHER CASE OF “FOLLOW THE MONEY?”

When incompetent and worse attorneys can be allowed to be rewarded for causing harm to an injured worker, how can that be good for anybody?

If WorkComp Mill attorneys  have a “case load of 300 clients”…with wishing and hoping that somebody drops dead for some ultimate pay-off for the attorney, how does that help an injured worker get medical care, benefits, return to work and settlement?

Why do employers condone such malicious unconscionable behavior of denials of medical care, benefits, and bullying and all sort of acts of terrorism, experiments, surgeries, poisoning and worse by insurance companies? What good can a WorkComp attorney do?

I even asked a WCAB Judge for permission, as stated is possible on the WCAB recommended reading, to retain an attorney to consult with, on an hourly basis.

Alas, not only did the Judge tell me he would not hear the F-words in his court room, (Felony Fraud with intent to deny medically necessary treatment), he sentenced me to fighting for my life with every ounce of courage and strength and stamina I can muster, fighting organized crimes that EVERY ONE OF YOU ARE FULLY AND COMPLICITY AWARE OF.

But wait, the Team of Four don’t have all the blame.  Defense counsel says it’s all my fault.  Hmph.  He even suggested I consider a Court Appointed Conservator since I am having such difficulty maneuvering the WorkComp system, with denials of medical care, fraudulent reports, unresponsive law enforcement and more.  The Carrier’s Fraud Department called, as most of you know, last Fall and made it very clear he did not care one iota that I had not received medically necessary and recommended care, and the conversation concluded when he said, “So, tell me Linda, when ARE you going to die?”

Some things I read on LinkedIn indicated the Employers are responsible for the bullying and terrorism of their vendors. Wyndham Worldwide was immediately apprised of the horrific bad faith and breach of fiduciary responsibility, and outright disgustingly mean thing to say. ( Intent of the caller? A “medicated worker” might have been compelled to irreversible action by such ‘poor customer service’, wouldn’t you agree? )

How many members of your CAAA organizations have been approached, recommended, took time to evaluate the merit and financial possibilities of helping THIS injured worker?  You know my name now.  I have spoken with many of you.  Your declines to help have most always been cordial, except when they weren’t.  Just so y’all know, A BRAIN INJURY IS NOT THE SAME AS A BROKEN FINGER, NOR IS THE TREATMENT THE SAME.

Watch the upcoming movie “Concussion” and then ask yourself and your partners how legitimate could it be for an insurance carrier to refuse to pay TTD, provide medical care, and embark on a mission of terrorism and destruction to an injured worker, coincidentally, UPON DIAGNOSIS OF BRAIN INJURY.

The Defense Firm treats me like they pretend to have  I & A Officers and  Judges in their pockets, as my ADA rights are consistently violated at WCAB-Riverside, and my Civil Rights.

Think about how many of YOUR clients have been sent to merely Orthopedic Surgeons or Chiropractors for TRAUMATIC BRAIN INJURY?  See the current list of names all the 40 doctors I had been sent to, and all the CorVel and Maximus “physician advisors” and team members.  In the olden days, they might have all been called, “Sonderkommando”….   Don’t get me wrong, there are a few good doctors in that list of 40, and they will be nominated in the upcoming CompLaude Awards.  The others will be nominated to the naughty list for possible inclusion in the ProPublica national efforts.

Why are my posts going through moderation in my groups?

While we rely on group management to determine the appropriate level of moderation for discussions in their groups, we also support an auto-moderation feature that helps group members and managers minimize unwanted content such as self-promotion in their own and other groups. By monitoring how people respond to contributions, we can gauge the likelihood of unwanted content being repeated from group to group.

Here are some of the most common reasons your posts are being moderated:

  • You promoted the same message in multiple groups at once. If you try to share the same link (or links from the same domain) with multiple groups, the system may prohibit the link from being shared. This is because the same information is not typically relevant to numerous groups.
  • You shared a job as a general discussion as opposed to listing them under the Jobs tab. You can only share content to a group as a discussion when using a 3rd party sharing widget. We recommend you post jobs to individual groups by selecting Job as the discussion type. This will make sure it’s placed on the correct tab.
  • Your discussion promotes your site or other sites. For example, your discussion contains a URL to a commercial site that tries to sell a product or service. We recommend you select Promotion as the discussion type when your post promotes events, blogs, real estate opportunities.
  • Your discussion had inappropriate words or content and was not professionally oriented.

Based on the feedback trends, some members may become subject to moderation in their groups for a period of time. If your posts are being moderated, here are some things to know:

  • During the moderation period, your posts won’t display immediately and must pass through your group’s management team before they appear publicly.
  • The moderation period can last from a few days to a couple of weeks. The duration of this period and the number of affected groups can vary depending on the number of occurrences.

If YOU make it to the “NAUGHTY LIST”  all thanks go to CNA and defense firm, Grancell Stander et al, and of course, to Wyndham Worldwide for corporate irresponsibility and callous disregard for the life of an injured worker, in a serious breach of human right and ethics, extreme discrimination of injured workers with disabilities, not excluding age and gender discrimination issues.   They could have made a difference. They chose not to.  Bummer.

Will someone let DIR Director Christine Baker know what happens where there are only illegitimate practices and legal chicanery in brain injury cases? Everybody planning to watch #Concussion?

Find Physiatrists and Neuropsychologists and their inter-disciplinary teams for helping Injured Workers with brain injuries, and stop relying on Orthopedic Surgeons who admittedly know little to nothing about brain injuries, although along with chiropractors who are the first doctors often seen after a slip and fall or foot ball injury or car crash.  Most experts will not play the killing games of Workers Compensation, as they took an OATH TO DO NO HARM.  Did you?

Also, encourage investigations into who writes these regurgitations called reports, without benefit of legitimate medical evaluations, and how much money is wasted. Investigate why/how defense firms can have the pattern and practice omission of hundreds of pages of medical records with intent to deny medical care.

Governor Brown, could you kindly have the Attorney General Investigations of corruption at the highest levels of Workers Compensation, and encourage Governors across the USA to do like-wise, and dispatch the National Guard to protect injured workers from these WorkCompsters? The FBI stands ready to help and maybe even the District Attorneys.   Thanks a bunch!

CORVEL TEAM SINCE 2013, 3D Practices — They even harm Cops, right Mayor Betsy?  Did the Unions get to the bottom of the bad behavior by Corvel out in Ft. Worth yet?  You should see how Injured Cops and Firefighters are treated in California. Shameful, indeed!  Reams of Denials via CorVel for ADJ8181903! (Chronoloical Order, 2013 to present….notice a pattern of expertise of denying parties?)  CorVel reports tend to be convoluted regurgitations of disorganized and incomplete medical records, violations of HIPPA rights, and inappropriate reviewers for types of injuries.  Readers may opine that the submitting RNs wrote the reports, poorly and incoherently, for the most part.

Orders are face to face medical exams for the first set of chronological providers, separated by year by an underline….starting in 2012. (Blatant disregard of ACOEM/MTUS guidelines, but that’s for another blog.) Second set are CorVel and Maximus regurgitation reports, apparently written by RNs or others and signed by a variety of doctors, citing guidelines for necessary treatment, and somehow denying it anyway.  Plenty of expensive bla bla bla.  DO THE MATH. FOLLOW THE MONEY. ASK MORE QUESTIONS?

For now, let’s just make the list.  Is your name on it?    “Let’s get started.”  Remember, all of these people have made money for seeing/knowing the Injured Worker.  Did they all provide “care” or “medical treatment”?

In contrast, Injured Worker was denied benefits, denied medical care, forced to file for welfare with Social Services and rely on the charity of friends and the Salvation Army—-proving that with Wyndham Timeshare, there are “No Free Gifts” and there is blatant and callous disregard for lives of injured workers and customers.  A friend shared this link with more news on how Wyndham Worldwide behaves in the global marketplace.

While WCAB seems to deem “evaluation after evaluation after evaluation” as evidence of InjuredWorkers receiving medical care, the Information and Assistance Officer, last resort for help for unrepresented Injured Workers, is not a doctor, nor a lawyer, and practice without those licenses is questionable indeed.

The dubiousness appears compounded when good doctors properly make legitimate and conservative recommendations for immediate and necessary care, only to have the recommendations denied by attorneys and adjusters in 2012, then, aided and abetted by Team CorVel.  Advising an Injured Worker to “have better control” of counsel when represented is a joke—if CAAA can’t police their own members, how can a Worker with a Brain Injury be expected to know when representation proves to be totally incompetent, dangerous, and worse?

CAB Commissioners and DIR seem complicit in the Gravy Train, at least in this case, which so many Super Lawyers indicate is ‘just how it is’ — happens to everyone — very common case, or maybe they just don’t know.  More on attorneys in another blog.

Follow this blog for more details that everybody knows but has kept the dirty secrets behind closed doors, while American workers and taxpayers pay and pay and pay—-with life, liberty and justice for none attacked by the Workers Compensation maiming killing brigades.

By the time you finish reading this blog, you will have a better idea of why Workers Compensation Survivors call it a GRAVY TRAIN WRECK.  (Some of these doctors were paid by CNA, some were paid by CIGNA, some were paid by the Injured Worker (unreimbursed medical expenses and miles to date exceed $43,300 – failures to receive adequate treatment have caused permanent and irreparable damage to IW.

Without WorkersCompensation, legitimate insurance would have facilitated care that would have been immediate, expert, reasonable, beneficial and IW may have returned to work within months, back in 2012. Without care, Injured Worker has been advised to make plans for Assisted Living in light of risk of dementia, with a need for personal assistance now.  Thanks WorkCompsters!

Dear Fred Sachs, CNA Adjuster:  

I AM UNABLE TO RETURN TO COASTLINE ACQUIRED BRAIN INJURY PROGRAM TO COMPLETE THE PROGRAM DUE TO CNA/GRANCELL/WYNDHAM WORLDWIDE.  I don’t have the money.  CNA refused to pay benefits and refused to provide medically necessary treatments since the date of injury.   File churning seems to be all the defense can do, along with obfuscation of facts, and out right making stuff up, and pretending their efforts are “the law”…..
I have spent nearly $50,000 trying to recover from the brain injury of 1/9/12 at the WorldMark By Wyndham Big Bear California resort, where no workers compensation policy, process or procedures were in place or known about by even Tina Jordan, who has apparently been promoted to even higher levels of incompentence.  I have spent funds on medically necessary treatments that CNA failed to authorize, many failures based on clearly fraudulent activities of the law firm, Grancell Stander etc. in ommission of hundreds of pages of medical records, and false and misleading statements to evaluating doctors— cost incurred to survive the atrocities of Wyndham’s pathetic, vicious, cruel,  and what appears to be diabolical and criminal workers compensation program.  What’s next?
 
Just wait and wait and wait?  OK…. If’s that’s the plan, that’s the plan.  I SURRENDER TO THE COMFORT OF MY HOME AND WAR ROOM.

Stewart gets a little annoyed when I copy what he calls “supplemental people” but since he says he wants to “work with me” yet does everything contrary to making it possible for me to return to work and life, well, I just thought it best to include a few people more “supplemental people” who have also viewed my LinkedIn Profile so we can all be on the same page as we work this out.  I hope all the email addresses are correct. 1. I need a print out of the moneys CNA allegedly paid to me; SSA is having some confusion about what appears to be fraudulent mis-statements of facts. 
2. What’s up with mediation and EAP???
What you people have done to me, you’re doing to otherss, and quite frankly, I think it’s time for it to stop.  Dr. James O’Brien, Forensic Psychiatrist who was apparently paid handsomely to do the bidding of Grancell Stander “by any means necessary” suggested if I have human right complaints that I be told to TAKE IT TO THE HAGUE.
Ok.  We’ll put that on the list.  Might not happen before I expire, but the Millenials will rise and shine.   They’re special that way, aren’t they.  Boomers can offer the support that our years can provide.
 
It’s been over 3 years and 7 months since my injuries and since I worked…. YOU DON’T PAY BENEFITS OR PROVIDE MEDICAL CARE.  THE WYNDHAM BOARD SHOULD HAVE  AN EMERGENCY SESSION, AND CARL ICAHN GROUP SHOULD BE PRESENT….

1.   Benefits Print Out – please send me an updated copy….. SSA is confused about what CNA actually paid; I said it’s more fraud, experts tell me to wait and see;
2.   Mediation Status – are we going forward with Judge Siemers now or in January 2016 or later?
3.   Any luck in finding a primary treating doctor for me, with brain injury expertise to replace Dr Bergey who left the case in December 2014? Stewart says it’s not his job to find a doctor; Stewart also says he has nothing to do with medical treatment; Stewart sure seems to bend the rules as he makes stuff up, doesn’t he? SO WHO IS RESPONSIBLE FOR FINDING AND AUTHORIZING A TREATING DOCTOR AT THIS POINT?  KIM MALL AND VALERIE JAMES PICKED DOCTOR BERGEY WHEN THEY DIDN’T LET ME ME SPEAK TO THE JUDGE IN DECEMBER 2012…. Do you realize in over 3 years and 7 months I have been unable to be seen/heard by a Judge regarding my right to medical care?  Yeah, All court time has been pretty much legal chicanery about hundreds of pages of medical evidence being omitted with intent to deny medical care, and this year the joke du jour is attempting to get the Judge compel me to see an ENT – EAR NOSE AND THROAT doctor for a BRAIN INJURY.  IT’S A LITTLE SMARTER THAN KIM’S INSISTENCE ON AN ORTHOPEDIC SURGEON FOR SAME, BUT NOT BY MUCH.
Because of the failures of so many people involved in my case, and the refusals to communicate with me, (or to send polite but empty responses like Tina Jordan’s Sunday morning email suggesting she missed the emails about return to work in December (not August) and the need for a doctor to sign off, I have nothing left to do but blog. I have approximately 90 draft blogs since summer 2013.  Watch for them.  Perhaps your organization willl learn something about the horrors of America’s workers compensation “EXCLUSIVE REMEDY”
These  patterns of continuous harm continue.  As you all knew, Coastline Acquired Brain Injury program reconvened August 24, 2015. I DON’T GET TO RETURN.  SO I GUESS I AM BACK ON THE REST AND WAIT AND WAIT AND WAIT AND WAIT PROGRAM.  ANYTHING ELSE WE NEED TO ACCOMPLISH BETWEEN NOW AND DECEMBER 14,2015?  ANY MEDICAL CARE? The Social Security Administration is investigating monies paid to me since date of injuries.  It seems that that the numbers reported by CNA to various places are inconsistent and have caused tremendous burden to others in sorting it out.  Seems to be a bit like a magical ‘shell game’.
Will you kindly send me a fresh print out of the 104 weeks of payments allegedly made, with dates and payees.  Too many people also seem to think that CNA has been paying me approximately $4,000/month since May 2014…  Wow, do your records show that, too?  Where on earth is that money going?  You did not pay me too many weeks in 2012, and … I have pages and and pages of trying to sort out when costs were shifted to EDD, and how reimbursements were figured, and the weekly amounts you paid and allegedly paid are all over the map.
PLEASE SEND ME A FRESH PRINT OUT OF INDIVIDUAL PAYMENTS MADE TO ME FOR DISABILITY BENEFITS ASAP.  THE APPEALS DEADLINE IS APPROACHING.  I SAY IT’S MORE FRAUD, BUT TELL ME TO LET THE ACCOUNTANTS WORK IT OUT.
