Future blogs will go deeper, and highlight some of the more prominent groups, pages, videos and profiles.   Even a cursory view of these links will prevent you from ever saying again, “OMG, WE DID NOT KNOW!”     That’s how the American Workers Compensation National Discussion seemed to deal with the Injured Worker Petition with nearly 6,000 signatures.   See the link and the blog about it here.   Did those industry bloggers call that ‘HYPERBOLE’ also?

Many of you are familiar with the 2015 excellent investigative reports of INSULT TO INJURY:  THE DEMOLITION OF WORKERS COMPENSATION that was a collective effort of ProPublica and NPR, and most likely countless others.   They detonated several ‘bombs’ on the battlefield of Workers Compensation Profiteers and Injured and Disabled Survivors of Workers Compensation, exposing many of the widely known, but not widely discussed dirty OPEN SECRETS of the mega billion dollar industry.

HOW CAN WE SAVE LIVES AND FREE THE HOSTAGES OF WORKERS’ COMPENSATION?
 .
It is our hope, collectively, that an encore and intense follow up is building for the continued reporting on progress with The Demolition of Workers’ Compensation and exposure of the Insult to Injury patterns of practice.  It is our hope that the investigations will continue to include a wider range of improprieties and probably serious crimes that include members of the Social Security Administration.
 .
It is further hoped that the ongoing  investigations incite CEASE FIRE upon Injured Workers, while TRIAGE TEAMS of smart attorneys, skilled in negotiations for resolutions vs file churning, and neutral outside mediators, and structured settlement teams convene to bring thousands, if not millions, of Workers Compensation cases to immediate resolution.

This may also serve to free the Injured Workers who are clear hostages and victims of this diabolical organized system of PROFITS BEFORE LIVES, functioning under a Cloak of  Arrogance, Psychopath, Secrecy, Obfuscation of Facts, and relies heavily on general apathy and the “7 National Crimes.”

If you’re an injured worker with a blog, you might find some inspiration for your blog with the questions presented in What’s Your WorkComp Story. Feel free to submit your story, that will be compiled and shared ANONYMOUSLY in the foreseeable future, with or without help from an editor and epublishing expert.  It might just become a free-pdf, we’ll see how it evolves.  Content over Form is more important.

Efforts to retain an editor to help with anonymous story assembly failed, as the party simply could not fathom and connect the dots of the atrocities being committed.

The typical propagandized public opinion prevailed, and convoluted the otherwise robust thought processes to only portray Injured Workers as helpless, hopeless victims.  This caused recommendations that were not suitable for creating a MOVEMENT TO FREE THE WORK COMP HOSTAGES, or even more simply, help Injured Workers ESCAPE from WorkComp, one person and one mediation and fair and reasonable structured settlement and negotiation at a time.

First, my take on the malicious organized personal attacks by certain members of the Workers Compensation community, then the threads, FOR WHAT IT’S WORTH.    

Hint:  ‘Smiling Silent Injured Workers do NOT get medical care, competent legal representations and benefits either.’    It’s all about the money.

That notion and disinformation to smile and be quiet to get medical care or charitable supplies is pure insurance industry disinformation/propaganda, IN ORDER TO PROTECT PROFITS BEFORE LIVES, touched with sexist thoughts (akin to the cycle of domestic violence)  that women should be seen and not heard, unless they toe the company line, then they may speak, as scripted only. 

Take note of how many women are involved in the ‘WorkComp National Discussion’ and the various panels of their regular high-end conferences and parties, ‘All of This Because Somebody Got Hurt at Work.’

U.S. Lawmakers Call for More Oversight of Workers’ Comp

In response to a ProPublica and NPR investigation, members of Congress are urging the labor secretary to come up with a plan to protect injured workers and taxpayers.

The pockets of ProPublica and NPR are apparently too deep for organizations like WorkComp Central and WorkersCompensation.com and their ilk to do battle with — so the WC boyz want to continuously attack one of the very few Injured Worker Survivors who blogs in order to help her fellow Americans, despite a brain injury?  Really?

These are the THOUGHT INFLUENCERS, attacking and disparaging injured workers/workcomp survivors are shaping public opinion on what’s desperately wrong with the epic fail and shell game of Workers Compensation????????? REALLY?  C’mon, Americans are not that stupid, are we?

If you can still think you might re-read the October 2015 letter from 10 congressional representatives to the Department of Labor Secretary, on the alarming issues of Workers Compensation.

So much for the National Discussions on Workers Exterminations, huh?  How are the “Secret Discussions” coming along in the Heartland? D’oh.

FOLLOW THE MONEY, ALWAYS FOLLOW THE MONEY.

Hint:  You won’t find it near the Injured Workers of America, Canada or Australia.

The first diatribe was from David DePaolo himself, first as an email (which was ignored) and then it was embellished and became a blog called ASSUME RESPONSIBILITY.   It’s not David’s best work or shot, it’s fraught with sexist innuendo and  but the comments from Injured Workers will be enlightening to all who read them.

The structure and content is not David’s typical nearly perfect delivery with concrete, critical thinking.  In fact, it hardly looks like his writing at all.  Was there duress that caused such an attack, seemingly organized to do even more harm? Who knows.  Maybe too much time in the air, in the rads.  He knows about Wigner effect, etc. He’s a pilot.  He has to know.

Injured Workers ask me why David is attacking me, and inciting further attacks.   All I can say is, “‘I dunno and don’t care.  The behavior sure seems like that of a psychopath.’

Others chime in that they are just trying to silence me.  I’m just trying to help discover and implement some win/win/win resolutions that allow Injured Workers to survive, escape WorkComp, get medical care and get on with their lives.

Many Injured Workers want to see incarcerations for the criminal conduct they have been subjected to.   A nice compromise is, upon swift resolution of all cases over 4 years old, for starters, wishing the criminal elements of Workers Compensation very interesting lives in the great outdoors, and no reminders to #DodgeTheRads.

I thought David respected the Constitution, particularly the First Amendment, even if the Fourteenth Amendment means little to him and his.  I guess I was wrong there, too.

Rosemary, author of the most recent diatribe below,  facilitates, among other things, bags of food for poor, impoverished, injured and disabled Workers in Australia who have been abused and tortured by a similar WorkComp system that is allowed to operate without fear or caution, maiming and killing as they go.  Apparently she has been providing basics for Injured Workers for nearly 20 years.

 

David DePaolo seems mad at me because I am not interested in promoting ‘bags of surplus food’ to America’s injured workers.  It could be something else.  I used to work for an attorney who always said, “REMEMBER, PEOPLE WILL NEVER FORGIVE YOU FOR THE WRONGS THEY HAVE DONE TO YOU.”

 

Organizations already exist that help Injured American Workers abused, tortured, impoverished by the scofflaws of the WorkComp systems.  The Salvation Army is one such organization that helps injured workers keep heat and power, and they also have food banks.

I SAY, DAVID AND PALS, YOU’RE IN THE LEGAL WORLD.  WHY ON EARTH WOULD YOU ATTEMPT TO FUND AN ORGANIZATION TO PROVIDE FOOD TO AMERICANS IMPOVERISHED BY THE EPIC FAIL OF THE DESTRUCTIVE, DEBILITATING AND LETHAL SYSTEM OF WORKERS COMPENSATION INSTEAD OF DEMANDING LAW ENFORCEMENT?!!

I received a call from a LinkedIn member who alleged he wanted to help empower me to advocate for Injured Workers.  I accepted the phone call.  He wanted to talk to me about creating a local food bank.

I politely told him to go to hell, because we have a BILL OF RIGHTS AND A CONSTITUTION IN THE COUNTRY, and if States refuse to protect injured workers and citizens, Congress has offered to send in law enforcement.  WE NEED A NEW CIVIL RIGHTS COMMISSION, NOT BAGS OF SURPLUS GMO FOOD.

Effects must surely be addressed, and I too, had episodes of no money where I had to rely on charity because of Workers Compensation, and it was a very humbling and frightening experiences, compounded by a brain injury.  I have always been about addressing causes, knowing full well that in so doing, EFFECTS TAKE CARE OF THEMSELVES.

If the crises of hyper-corruption that facilitates the impoverishment and egregious harm of America’s injured workers is eliminated, food banks for that population will become unnecessary, along with advocacy and legal aid and all public assistance.

SIMPLE – DEMAND THAT THE INSURANCE CARRIERS FULFILL THEIR OBLIGATIONS TO PROVIDE IMMEDIATE, REASONABLE AND APPROPRIATE MEDICAL CARE, WITH RETURN TO WORK PREPARATORY ACTIONS, and stop torturing and abusing injured workers.  STOP WITH THE LIES THAT WORKCOMP CASES GONE WRONG ARE THE EXCEPTION — DEMAND THE COMPLETE DEMOLITION OF WORKERS COMPENSATION AND HOLD THE ‘BAD ACTORS’ ACCOUNTABLE FOR THE RAMPANT LEGAL CHICANERY AND UNLAWFUL CONDUCT.

HOW ABOUT TAKING SOME LEGAL ACTION TO SEE THAT LAWS ARE ENFORCED, FRAUD IS PROSECUTED, INJURED WORKERS ARE PROVIDED WITH MEDICAL CARE AND OTHER BENEFITS IN ORDER TO RETURN TO WORK.

WHY DON’T YOU JOIN US IN ESTABLISHING A NATIONAL MOVEMENT TO PUT A CAP ON HOW LONG A FILE CAN BE CHURNED IN WORKERS COMPENSATION LAW FIRMS??

IF TEMPORARY TOTAL DISABILITY PAYMENTS CEASE AT 2 YEARS, THEN SUFFICIENT MEDICAL CARE SHOULD BE DELIVERED WITHIN THE TWO YEARS TO FACILITATE RETURN TO WORK.

IF IT IS NOT, THEN THE CASE SHOULD BE MEDIATED WITH STRUCTURED SETTLEMENT AND RESOLVED. THE CURRENT INCENTIVES TO PROVIDE MEDICAL CARE AND CLOSURE DO NOT EXIST FOR THE EMPLOYERS OR CARRIERS.

IT IS COMMON KNOWLEDGE THAT IT IS MORE COST EFFECTIVE TO DENY MEDICAL CARE AND HOPE AN INJURED AMERICAN DIES BEFORE A JUDGE CAN ORDER MEDICAL CARE.

I will not deny that I have stood and delivered eulogies at the funerals of injured workers who have taken their own lives; now will I deny that I run the only emergency food relief project {Bags of Love} for injured workers and their families; I will not deny that I have sat in the reception areas of claims agents to collect overdue monies for injured workers. I will not deny any of what I have done over the last 20+ years as firstly an injured worker and secondly as an advocate for injured workers.

    My name has been dragged through the mud, my name has been used in a form of a witch hunt, I have been accused of getting into bed with the system and getting unaccounted for payments from the system- to the point where I gave permission for an investigator to search my bank details and my tax information.

    As an advocate I speak up and I speak out against all forms of injustice.
    I write letters to inform the Boards of major companies just what is happening in the lives of their injured workforce.
    As an advocate I have offered to lodge claims against case managers using the very same legislation that they use against injured workers.
    As an advocate I speak loudly for the injured workers who do not believe that anyone will care or any one will listen.
    As an advocate I have studied legislation, I have studied policy and procedures and I have studied the various systems.
    As an advocate I have had to learn and learn fast what can be done, what is achievable and how to bend the legislation but never break it.
    I also learnt a long time back that carping and complaining changes nothing.
    I also was told that if I didn’t like the system, then I had to change it.

    I do hope you will encourage your son to specialize in Mediation, with a strong understanding of Structured Settlements. He seems to be a very bright young man with great compassion and will-to-good.

    There’s a grassroots movement in the works to create such a national operation here in the USA to help Injured Workers escape the Workers Compensation system. This is America. WE FIGHT FOR FREEDOM, AND FREEDOM ISN’T FREE. ASK ANYBODY IN OUR MILITARY. ASK ANY PATRIOT.

    I have to tell you, Injured American Workers were wondering who the next attacker would. We guessed it would be Joe Paduda and someone else from the Best Blogs of 2016.     David had suggested that Injured Workers rewire their mind set in this thread with a post, I think, you know, ‘don’t worry, be happy, forgive and forget the most vile of crimes committed against Americans and rebuild on dust, or, like one of his reporters recommended, ‘best to hope for is Social Security Award and an early death’ to one injured worker.

    Linda Ayres David was very mean and untruthful in Assume Responsibility, but I think he may have been egged on by bad influencers. Over the years, David had always been kind to me, and generous with his expertise. He got real mad at me when I told him I was going to a meeting “with an open heart, an open mind, and an empty brief case.” He ranted harshly that nobody would help me because I was too angry. When all was said and done, even the Defense Attorney and several doctors applauded my survival efforts; some, in fact, suggested I begin to coach others. David forgets how many blogs I shared promoting CompLaude in 2014 and 2015, and totally forgot, apparently, how many blogs I did about the new Sedgwick Institute linked in group. And ol’ Bob Wilson could only be insulting and demeaning and whining that not too many people nominated for the Best Blogs — but I also did my best, despite my personal opinions of Bob and his work, for the greater good, I shared his darn links around social media.

David wrapped up with suggesting I read “HOW TO WIN FRIENDS AND INFLUENCE PEOPLE” and I got a good laugh out of that, as did many of many dear friends. Initial reaction to that suggestion was, ‘yeah, sure David, and you might open Sun Tzu’s THE ART OF WAR to any random page…. but it helps to study the whole book.

    Linda Ayres So, since this seems like a highly suspicious organized attack to ‘Silence the Blogger’ and since I think I read that David is claiming that these national discussions are involving input from Injured Workers, I’m ‘puzzled, baffled, bewildered, perplexed’ at such a comment.

    Injured Workers are puzzled that the Boyz think that you, an Australian if I am not mistaken, are the only injured worker capable of telling it like it is along with Bob’s ‘key executive’ who also survived WorkComp many years ago.

    My blog, ASK ABOUT WORKERS COMP GRAVY TRAINS was started in Summer 2013, and the reach is well over 30,000 now. You might find some value in studying it. Influencers have.

    As of the first of this year, the shift took place away from my personal case to addressing the national crises in WorkComp that causes such egregious harm to too many Americans.

It appears to be necessary, in most states.  So, ‘SEND IN THE NATIONAL GUARD, AND ENSURE THEY ATTEND THE ‘SECRET’ NATIONAL DISCUSSIONS in the works for May, somewhere in the ‘heartland.’

The matters of unbridled profits for the insurance industries on the backs of injured workers, along with costs shifting to same injured workers, to State and Federal coffers, is also discussed.  It’s hoped that the ‘national discussions’ include the most destructive and dangerous practices first, vs. hand wringing and “CYA” practices to protect PROFITS BEFORE LIVES.

Back in 2012, one doctor suggested that I write about my work comp experiences after a witnessed slip and fall backwards, big, hard, conk on the head, little-to-no medical care over the course, in order to help me process what was happening to me with the lack of medical care, legal chicanery, and fight for my life.

It took until the summer of 2013 to make it a blog…..the earlier writings were to WorkComp people — doctors, adjusters, lawyers, human resources. Initially, I suspected the poor treatment was simply that some of the people I was dealing with were simply stupid.   I discovered it is far worse than that.

Have you seen the movie, WOMAN IN GOLD?  Here’s the trailer.  I watched it this week.  I cringed and gasped repeatedly as I saw parallels between those atrocities, and the life destroying actions of the WorkCompsters around the nations.  It is time for more Doctor’s Trials, to include the complicit sonderkommando, wouldn’t you agree?

 

ENOUGH IS ENOUGH.

 

Watch it and see for yourself how the parallels can be drawn with the devastation and destruction by the Nazi’s in the 30’s and similar destruction of life in the 21st century—of disabled workers, older workers and other ‘economically undesirable’ or ‘unprofitable’ members of the working classes.  If you do watch it, pay particular attention to the cheering when the Nazi’s rolled in to Austria, and the terrors that followed and wonder about shareholders of the companies causing such atrocities. Today, they don’t roll in in tanks, it’s the sedans and stretch limos?  Yikes!

It has been somewhat comforting over the past year to see discussions about the many horrors of WorkComp, along with the high profits for the insurance carriers. Romano Trust Vs. Sedgwick seems to have paved the way for carriers to “wish and hope you die” if you are an injured worker —-it’s an cost effective strategy, in perfect alignment with PROFITS BEFORE LIVES business models, also used by the Nuclear Industries?

A recent DePaolo World blog shared another story with the same trend….. Profit Before People rather than the carrier paying for transitional living facilities at approximately $40K a month, likely with the help of some nasty pharmaceutical, that injured worker’s ‘suicidal ideations’ and attempts could save that carrier a bundle…..  and have “Happy Shareholders”??  Yikes!  See also Guilty Without Charge

Brain cognitive interruption What do you recommend for injured workers, who may have lost jobs, or been on leave of absence without pay for 2, 3, 4+ years after a work place injury, wherein the employer’s vendors refuse to provide medically necessary treatments, causing also losses of homes, health, and creating permanent disabilities, with refusals to allow return to work, with or without accommodations? Just a quick comment, such as:

It’s a market ‘niche’ of more than 50 million people in the USA alone, if they survive WorkComp. Many are forced to become ‘Freedom Fighters’ and ‘InjuredWorker Advocates’ while fighting for survival against some very sneaky and formidable foes. It hardly fits a ‘consultant’ or ‘volunteer’ capacity, and such legal atrocities often leave workers with permanent disabilities, unable to perform a fraction of prior abilities. Medical treatment, disability benefits, and reimbursement of medically necessary expenses have been denied (approximately $30K unreimbursed expenses to date, and rising) since date of injury, January 9, 2012.

One unfortunate circumstance, a witnessed slip and fall backwards on ice at the WorldMark by Wyndham Big Bear resort, has been compounded by a series of increasingly harmful circumstances, with callous disregard for my life.

The past three years have been filled with legal, medical, financial torture and abuse and patterns of continuous harm, without any Corporate intervention or responsibility, despite repeated pleas for help by this brain injured worker.

Shame on Wyndham, CNA, and Grancell… and the doctors complicit in failures to provide immediate, reasonable and appropriate medical care, in compliance with California Labor Codes and the Constitution of the United States of America.

DUTY TO ACT

The loss of cognitive abilities is unfathomable to anybody but another TBI Survivor.  TBI is called an INVISIBLE DISABILITY.

WorkComp doctor, in 2013, suggested that because I am over 35, female and disabled, I am not entitled to any medical treatments since it was not provided in the first two years either. Several QME/AME doctors might find themselves in Nuremberg type trials in America sooner rather than later.

The fraud and following of orders of defense firms is straight out of a bad movie, from changing dates of injury to use prior year medical records to allege ‘pre-existing’ injuries, to simply writing what a defense attorney asks them to write, to ‘secret submission’ asking doctor to review but not summarize medical records, in true SS fashion, and in full violation of CA Constitution Article XIV and the US Constitution in entirety.

Where is the ACLU and the National Lawyer’s Guild and the “LawyersDen” when it comes to experimentation and exterminations of injured and disabled people? More importantly, WHERE ARE THE DISTRICT ATTORNEYS AND WHERE IS THE DEPARTMENT OF JUSTICE AND HOMELAND SECURITY???

Defense firm asks why I believe I am entitled to any medical care or disability benefits. The insurance carrier, after calling and listening to whining about denied medical care, asked, “…when ARE you going to die?”

WorkComp is a mega billion dollar industry. Timeshare/Hospitality is also a mega billion dollar industry, therefore;

Who else makes the big bucks, and has conferences in some of the nation’s fanciest joints, and has drinks after a little education and pondering the state of dying injured workers and diminishing profits for some, and opines about the plight of the po’ injured workers of AMERICA? Average salary in WorkComp is probably close to $100K? Those commissioned insurance reps and structured settlement peeps are probably in the $250-$500K ranges?  What are the ‘bonuses” based on? Kill rates?
