Doctors told stories of Injured Workers who fought for years, then got peanuts in settlements, then dropped dead from the stress and despair.

That person who allegedly ran for insurance commissioner a hundred or so years ago accused me in 2014 of being an industry shill because one of her drones lied to her and said that she never talked my ear off on June 14, 2014 at 5:36 pm for 57 minutes and 47 seconds (my Smart Pen keeps track of things for me…and it was new to me at the time…). She and her pals sent threatening emails to me and more about me at that time, too.
They repeated that process in May 2016, and continued the threats, defamation and attacks via emails and right over there on LinkedIn, making it real easy for the investigative reporters who are friends of Injured Workers to say;
‘Whoa, don’t need this sh*t…. that chick is nuts! That’s why hardly anybody will bother to write about Injured Workers; time wasters’
Back to that gal who allegedly ran for insurance commissioner and her drones— they ruined yet another opportunity for a few investigative reporters and other influencers to learn more about injured workers and interact one on one. They were invited guests to my thread, and they have since been blocked on LinkedIn and here on Facebook. You can see their incoherent ramblings on a few of the industry blogs….one goes on about the Confederacy or some such ‘conspiracy’ that broke workcomp.
They just can’t fathom that the WORKCOMP system is NOT BROKEN, it is working AS IT WAS DESIGNED TO WORK. GET OVER IT, AND GET OUT OF IT, OR RIP.
Could this prank or threat be more of their work… Siri said the IP was a corporate account…??
[Did you see that movie, “Hackers” – I think was the name, a documentary that said hackers are more dangerous than nuclear warfare. It was a heavy flick, It was mostly about government and corporate hackers… you know, the real dangerous crowds. I can’t say I agree with that, nuclear annihilation is pretty terminal…I will have to watch it again if I can find it… I saw it in 2014 or 2015]
Most all that disinformationists’ team were evicted from my groups, to the best of my knowledge, but who knows how many people they are running around telling that I work for the industry? The industry probably cringes at that thought, too! DePalo wrote in another of his articles before his apparent new benefactors hit the scene:

But they, whoever they may be,  may have crossed a line with this screen shot, if it was them. Whoever it was, if you’re part of that crowd, your stories of learned helplessness are not the point of the collection of stories…. the anonymous collection is for people who value freedom and health and civil rights and human rights, and want theirs back.
It’s not for people perfectly content to die lives of quiet desperation on their knees, begging for government intervention and rescue. For those, there is no hope. Have interesting lives in the great outdoors.
The laws are already in place. No trail blazing required there.
LAW ENFORCEMENT IS SADLY LACKING, AND CORRUPTION AND MALFEASANCE AND FELONY FRAUD SEEM TO BE THE REAL ISSUES, STILL GUARDED BY THE PROFITS BEFORE LIVES CROWDS.
REMEMBER, WORK COMP IS NOT BROKEN…IT’S A MEGA BILLION DOLLAR INDUSTRY…INJURED WORKERS ARE SIMPLY FUEL AND FODDER. Get that, and get on the road to getting your human rights back.
Over on LinkedIn I have connected with some people of influence, and I will see what I can do to check out the real threat of these issues further. Enough is enough.
The only other peeps I know of who are in a tizzy about those questions in What’s YOUR WorkComp Story are the Sedgwick peeps…they kicked me out of their LinkedIn group, “Sedgwick Institute” after I submitted the questions to them, and asked if they might want to add any questions that could support their purported intentions to improve WorkComp processes.
By the way, my first set of questions were simpler and nicer. The final draft was based on INJURED WORKER SUGGESTIONS to hit hard with tough questions. So there you have it.
As you know, WorkComp Central started with their national piece, “Assume Responsibility” disparaging diatribe in early May 2016, that included links to several of my blogs and did a whole bunch of name calling (big words I had to ask Siri to look up definitions… See my blog on ‘Accused Vociferous WorkComp Militant Opinings..’ ) DePalo’s peers had some good chuckles at his over the top/over the edge attacks on me and others in the Injured Worker communities. My professional friends laughed out loud!

PS  For suggesting impartial mediation and structured settlement negotiations, the same group of ‘Injured Workers’ accused me of ‘getting kickbacks’ from the Structured Settlement Industries.  Here’s a quick screen shot from one Mediator’s site…   Stupid Injured Workers cannot, apparently, be saved.  Focus on those who want their health and freedom back, and help them get out of the system by any means necessary.  Find a way to reach them.  Start with their attorneys…. who clearly have minimal negotiating skills across the USA.   If you’re in HR, learn about mediation and structured settlements and human rights.

Anybody hurt on the job or in the industry knows that a Work Place Injury can be career altering or career and life destroying.

Some questions to ask about WorkComp Safety Programs and Workers Compensation Insurance coverage and practices can be reviewed below.

Is being informed about the details of workers compensation and long term disability insurance coverage really any different than knowing about the medical, dental, vision, vacation or 401(k) ‘benefits’?

IF EMPLOYEES AND PROSPECTIVE EMPLOYEES DO THEIR DUE DILIGENCE BEFORE ANY INJURY, AND KNOW THE WORKPLACE PROCEDURES TO FOLLOW IN THE UNFORESEEN EVENT OF A WORKPLACE INJURY, MINOR OR CATASTROPHIC, BETTER OUTCOMES FOR ALL CONCERNED MAY TAKE PLACE.

How many Human Resources professionals are totally out of touch with the WorkComp processes and do nothing but hinder efforts for an injured worker to get medical care and benefits.  How few even send a get well card or say, “Feel Better. We hope you’re back to work soon.”  HOW FEW?

How many tell an injured worker, “Sorry, the legal department says we cannot talk to you or help you in any way.”  HOW MANY?

DID THAT MAKE IT THE MAINSTREAM ‘NATIONAL DISCUSSION ON WORKERS COMPENSATION’ AGENDA yet?

sell you with hire on package.

Hi Linda,
My suggestions: From Day 1 – (If I had it to do all over again)
1. Buy a file cabinet (or empty one) for work comp, you’re going to need it.
2. Always ask for and receive copies of all Dr visit reports, and file every report. If they aren’t accurate – Demand they change them, or send a letter to correct the record and insist it be attached to the file.
3. File and save Every communication you receive from the insurance company.
4. Keep track of all mileage and medical expenses and submit for re-imbursement on the form provided at insurance company website. If items are not re-imbursed within 45 days, re-submit until they are.
5. Do not allow Drs to delay requesting needed MRI’s / CT scans / xrays  – They don’t request so they can continue to charge insurance & medicate patient, only. (If Dr will not request / demand needed testing – FIRE them and find another who will)
6. Do Not fall for the attorney lie….”You just concentrate on getting well and I will handle everything else.” Be active in your case, if your lawyer will not (within reason) communicate / update you – Get rid of him/her. They are doing you more harm than good.
7. Fight for the treatment you need, before it’s too late to correctly fix the problems from your workplace injury.
8. Call, visit, email, your political representatives and make (public) NOISE when they ignore your requests for assistance. If they are not helping you, they are NOT representing you. (That is what they are being paid to do.)

I could probably write a book on this subject but these are my starter points.

PS…I would NOT recommend asking prospective employer about their work comp practices, as it may appear a person is looking for a place to commit workplace injury fraud, which puts the injured worker at risk of attack from day one of injury. (Every lawyer should know that.)

An attorney did also respond [SEE ABOVE]  and said asking about a prospective employer’s safety program would be more desirable than asking about their work comp and Long term disability insurance carriers. I extended thanks and said it was duly noted and would be incorporated.

While I understand and respect your opinion and the attorney’s on that issue…I think getting the facts before they are needed is key to breaking the strangle hold of the intimidation and secrecy that perpetuates WorkComp fraud and abuses and hyper corruption.

In fact, I think the question begs to be asked and can be included as simply as inquiring about heath, dental and vision insurance and 401(k) contributions, particularly in light of the ongoing National Discussions on Worker’s Compensation.

YOU IGNORED IT? DOES THAT MAKE YOU COMPLICIT IN THE CRIMES AGAINST THE WORKING CLASS FOR THE PROFITS OF THE FEW?  READ WHAT YOUR CONGRESSIONAL REPRESENTATIVES HAD TO SAY IN OCTOBER.

The response from the Secretary of Labor essentially said the department’s hands are tied, too bad, how sad, deal with it.  That response needs a re-do and needs to include a request to send in protection for Injured Workers and Other Taxpayers across America. There is essentially no law enforcement and there appears to be substantial collusion and many unclean hands in high places.

I, personally, have been personally disparaged in diatribes – publicly and nationally – by  senior members of the Workers Compensation communities in what can only appear to be an attempt to SILENCE me and others by ANY MEANS NECESSARY.  These attacks have been by professionals, carefully crafted with clear intent to harm and silence – by ‘leading experts’ in the field.

HOW RUDE IS THAT!  As a member of a further protected class, thanks to “WorkComp,” I do what I can to help Injured Workers ESCAPE the system with their lives and what is left of their destroyed health.   Einstein reminds that ‘Those who have the privilege to know have the DUTY to act.”  I KNOW. I ACT.

As many of you may know, even a ‘hurt shoulder’ can result in an excruciating long drawn out death for an Injured Worker in America and beyond. 

I am an older American woman with Disabilities, a TBI and I AM a WorkComp Survivor.  I BLOG, THEREFORE I AM A WORKCOMP SURVIVOR.  I ENCOURAGE OTHERS TO BLOG, TOO!  BLOG TO REGAIN CIVIL RIGHTS AND HUMAN RIGHTS and to protect the Constitution of these United States of America.

(The WorkCompsters are having a ‘Workers Compensation National Discussion’ and seemed to need a gentle reminder that a ‘circle jerk’ is NOT A NATIONAL SUMMIT.   Attacking injured workers for invoking First Amendment rights in efforts to silence may send WorkCompsters straight to the 5th Amendment, wouldn’t you imagine?  It will certainly not serve identifying real problems and coming up with real solutions, will it. In fact, the attacks appear to be based in mysognism and psychopathy.  (Read the attacks and draw your own conclusions.)

The perpetrators’ credibility has been totally destroyed by their own failures. Those poorly executed attacks include appearances of failures to fact check, omissions with intent to deceive to protect illicit profits, ‘masked bandits’ media images, clandestine meetings ‘in Dick Cheney’s garage’ and  ‘smoke and mirrors’ attacks on the population impoverished and harmed by the WorkComp industries, giving the few ‘the good life’ — WHILE DESTROYING THE WORKING CLASS.

Sadly, in California, most attorneys seem to roll over and quietly serve their clients to the insurance industries on a tarnished platter for a few ‘pieces of silver!’ Perjured reports are greeted with a shrug and ‘that’s just how work comp is’….. if questioned, they shrug again and say, ‘The System is broken!” HOGWASH!

Have you been following the Steven Gursten Esq. situation about IMR’s in a Brain Injury Case?

While it’s not WorkComp, this PI attorney could certainly teach @CAAA and other State’s legal and insurance crowds a thing or two about how to protect an Injured Worker and how to protect the Constitution of the United States of America! It’s a heart warming story!

IMR/QME/AME perjury and other fraud issues are a huge dilemma in California, and seems to be a ‘protected’ action…. Ask any Injured Worker for details!  Will the well-connected doctor in the blog face legal consequences? How is patient?  Will he get medical care now?

Without swaths of similar reports, the rest of the WorkComp process might actually begin to include actual reasonable and appropriate medical care, and legit providers might even have better luck at getting paid to provide care, injured workers might get improvements, might be able to return to work, and save taxpayers “swaths” of monies being shifted from carriers to governmental agencies, etc.
