Yo!  Mr. Prez, it’s me again.  If it’s not one thing, it’s another!  Fukushima, Ebola, WorkComp, Central Asia!

I can’t get no satisfaction, and can’t get no medically necessary treatment from that big company, CNA (their CEO, Tom Motamed makes $10.7 million a year in a business that maims (and CAUSES PREMATURE DEATHS!) of America’s injured workers! D’oh!)  Earlier this year I even had to call Adult Protective Services due to the financial terrorism, and I copied the State Controller, too.  There was a remedy, but no resolution and it started again in July 2014, and I don’t know what to do next.

The State of California paid CNA a BONUS OF NEARLY $20,000 for CNA’S REFUSAL TO PAY TEMPORARY TOTAL DISABILITY PAYMENTS TO ME IN 2012/2013.  SOCIAL SECURITY SAYS A FUNCTIONING BRAIN IS NOT NECESSARY TO SELL TIMESHARE.  MY STORY IS SAD AND I KNOW YOU’RE BUSY, AND I HAVE TRIED TO GET HELP FROM LOCAL GOVERNMENT PEOPLE, AND QUITE FRANKLY, TOO FEW GIVE A DARN.

 RE:  ACCOMMODATIONS AND FEHA INTERACTIVE PROCESS REQUEST AND ISSUES FOR DOCTOR APPOINTMENT OF 10/17/14

I have not heard back from you regarding the Quality Assurance position in Indio, the training dates for sales in November, or any of the other recently posed questions, in regards to the spread sheet I made, at your request, regarding potential accommodations.  This information is required so that the primary treating physician assigned to my case, Dr. Darren Bergey, Orthopedic Surgery, can make proper recommendations for accommodations and return to work status on Friday, and as you know, he has also deferred to the medical opinions of Dr. Hilda Chalgujian.
 .
Dr. Hilda made it very clear in April that my needs for medical treatment were urgent and more than necessary.  CNA, Grancell, and Corvel seem to have acted in orchestrated collusion and in defiance of the Wyndham insurance policy and the laws of the land.   However they have done it, it has harmed me egregiously.
 .

Below is a map of proximity of Wyndham Avenue of the Arts and Coastline College and the Cognitive Rehabilitation Program that starts Monday, October 20, 2014. Orientation is Saturday morning, October 18th.   As part of the accommodations to be explored, will you kindly obtain authorization for complimentary stay at the Avenue of the Arts property for arrival Friday, October 17th, departure Thursday, October 23rd, in order for me to attend the orientation, and seek housing.

It is clear that the Wyndham insurance carrier and defense firm intend the continuous harm to me and it is time for Wyndham to come to the aid of this injured worker. While they continue to fail to authorize treatment for brain injury, they hope to help some of their independent doctors make book with extra evaluation dollars.  Stewart is working very hard to get an accurate medical list of records together and he insinuated that the WorkComp Judge authorized their fraudulent obfuscation of facts.  I didn’t read the order that way, but who am I to argue with a Grancell Partner/Shareholder.  If he says the Judge approves fraud, d’oh….I won’t touch that one.

That’s for higher authorities.  He didn’t use those words, but close enough to what I saw, but the refusal to correct the errors was based on skewed misinterpretations of a full day in Court when the other Grancell lawyer had to be ORDERED BY THE COURT to provide more than 300 pages of omitted medical records that had caused seriously incorrect medical reports by 2 doctors in Spring 2013, and then she did it again for the next evaluation in December 2013, alll with clear intent to deny medical treatment to a disabled injured worker due to disabilities, age, and profits.
 .
Clearly matters for higher authorities.   Stewart intends to continue the charade with the next evaluation. Does anybody else wonder why so many doctors have been paid to ‘evaluate’ me and none of their recommendations are acted on; all ignored or denied.  False prescriptions bills go unnoticed, and Stewart thinks that it’s ok to include in medical records that I saw a brain injury doctor from Casa Colina in October 2012, which I did not, and this is the same doctor who helped CNA override the attempts to revoke my driver’s license in 2012, and same doctor was seen, self-procured in Spring 2013, and apparently lost my file and refused to write a report, when in our evaluation, he said I was an ideal candidate for the Casa Colina Day Brain Rehab Program, and that he was very familiar with Work Comp and knew how to work the system to get me in without much fuss.  Then he lost my file and kept my money for the report that he never delivered and never returned my calls?
District Attorney stuff, let the government handle these boyz.

I just want medical treatment and a place to stay while I’m getting it.  CAN YOU HELP ME NOW?   Fred’s suggestions about the ‘circle jerk’ of more rounds of appeals to Corvel, recently reported to have ‘quasi-black-market’ businesses practices, under investigation, are not acceptable.  1.5 years of that nonsense is enough to make anybody aggravated, with their out of state doctors and illiterate nurses skewing facts from the reports they do receive from CNA/Grancell.

The injury was witnessed, the manager helped me up from the ground after being there for what seemed to be about 5 minutes, and the initial failures that have exasperated my medical conditions started on 1/9/12 when I was not even offered a ride to the hospital.  [We had a sales meeting right afterwards, and everybody had a good laugh, and they said,  ‘Ewwwwwww, Linda has Fukushima rads from the snowflakes allll over her!!!’]
[I got ‘the talk’ the week before for a picture in the break room about the Fukushima nuclear meltdowns. The manager said it was ‘grim’. D’oh! Ya think! Triple Nuclear Meltdowns in progress since 3.11.11….. yeah, sort of grim for all of us.]
I get it that I have to contend with brain injury because of Wyndham, and because I did not get medically necessary treatment for going on 3 years, when anybody with a functioning brain knows that the first 90 days are critical for care, and that ongoing speech therapy with cognitive remediation, occupational therapy, vision therapy and psychotherapy are key components to such recovery.
 .
So, while CNA suggests I participate in their “circle j**k” by suggesting I submit yet another appeal to yet another bogus denial of treatment, I am asking you to elevate this beyond your comfort zone.  I am reaching out on LinkedIn to Wyndham employees globally.  There is a COUNT ON ME side to Wyndham, and you can continue to COUNT ON ME to ensure that these horrors are minimized and ultimately eliminated for other injured Wyndham Workers.

I look forward to returning to work and once again being a valuable and valued employee, despite my cognitive impairements.  If, however, Grancell’s legal opinion that suggests my injuries are minor, there’s not much more to talk about.  Let me know where to report to work, in what position, and I will request release to work with minimal accommodations from both Dr. Bergey and Dr. Chalgujian.  Without promise of any medical care, I do not know if they will accept the professional liability of releasing me, under such dangerous conditions.  Their responses will likely weigh heavily on your response, and the return to work offered in order to properly recommend accommodations and restrictions.

Your response is required by Thursday, close of business, 5 pm, or will be considered collusion to continue the egregious harm to me, and continued refusal to participate in the FEHA interactive process in order to help me return to work, meeting timeframes intensified by your refusal to meet in August or September of this, or in earlier Accommodation requests of 2014, 2013, and 2012.   I will also appreciate confirmation of complimentary reservations at Wyndham Avenue of the Arts property as stated above, with an offer for a longer term discounted rate for the first semester at Coastline, in order to allow me to find proper and adequate housing.

I was injured while working at WorldMark by Wyndham Big Bear in 2012; a witnessed slip and fall backwards on ice, causing a brain injury… I am stilll waiting for treatment, and the treatment by Wyndham’s insurance carrier and defense counsel has been horrific. Wyndham HR has simply shrugged with ‘not my job’ attitude when pleaded with for help.

A witnessed slip and fall with loss of consciousness at work.  Able to stand with assistance.  Complained of feeling “dazed and confused”.  Also, c/o headache and pain in back of head, neck, back and right ankle.  Was neither advised nor offered a ride to seek medical treatment by sales manager who had witnessed the fall and assisted with getting up off the snow covered ground.

 One unfortunate event led to another unfortunate event, which led to a series of unfortunate events with wrong dates, doctors, omitted records and misinformation and inconsistencies with misrepresentations.  The harm caused to the injured worker by these unfortunate events is irreparable.

She continued with “usual work” (sales meeting followed by sales presentation) with above symptoms, including severe confusion, until approximately 10 am, when administrative manager approached with work comp form stating “you can see any doctor that takes work comp insurance”even though the form had no insurance information on it.  Again, she was not offered a ride to the Emergency Room nor was she advised to seek immediate medical treatment.  She continued with above S/S, including confusion and dizziness.  She left work at approximately 2 pm, (approximately 6 hours post fall) with her manager’s knowledge of an approximate 1 hour drive home – 20 miles down steep snowy mountain road, 40 miles of flat desert road.

 

She continued with headache, confusion, dizziness, head, neck back and right ankle pain.  She drove directly to the chiropractor who had been seeing her periodically (every 1-2 months) for maintenance.  Upon arrival, the office staff commented on her state of confusion and general “dazed” appearance.  She informed the chiropractor about the slip and fall at work, her LOC and immediate and persistent pain, headache, confusion and dizziness.

 

The doctor’s office attempted to contact her employer for needed information regarding a work comp claim.  Messages were left but employer did not return calls.  (See email from Dr. Whitlock to Daniel Elliott dated Tuesday, 2-28-12, CNA Adjuster, and return email authorizing more chiropractic visits #14)

 

1-11-12 injured worker presented self to Avalon Urgent Care due to increase in confusion  and pain and headaches.  (See 1st Report of Occupational Injury).

 

Injured worker was not contacted by employer for follow up.  Not given a list of MPN authorized providers.

Was given an incomplete Work Comp form filled out by employer.  Personal health insurance (CIGNA) billed for Work Comp by Avalon Urgent care due to lack of infomration on Work Comp DWC-1 form.  Attempted authorization by Urgent Care.  No response from emkployer or Work Comp Insurance.  Injured worker had to pay out of pocket for co-pay and medical tests including Xrays (request for MRI).  This office was not a member of alleged MPN at the teime, but apparently later became a member.

 

On 1-11-12 injured worker contacted EAP provided by employer due to continued confusion and concern thereof.  Continued lack of support by employer.  She continued to update employer  No authorization for medical treatment.

On 1-13-12, Injured worker was seen by Dr. Daniel DeGoede, Clinical Psychologist,  referred by employer EAP (Employee Assistance Program).  See handwritten referral dated 1/13/12 from Dr. DeGoede  to Dr. Esmael Sebti, Neurologist for scheduled appointment on 2/7/12.  Was refused evaluation and referral when appearing for appointment by Dr. Sepbti due to non acceptance of work comp patients.  It was later discovered that this doctor’s two offices were a part of the alleged MPN network.

 

On 1-21-12 Retained attorney due to lack of medical treatment and appropriate authorizatin for treatment of head injury and was scheduled for an appointment on the next day by the law office with an Orthopedic Surgeon. Dismissed law firm with cause shortly thereafter, at the recommendation of a retired Judge, and worked directly, in-pro-per,  with Adjuster to coordinate a team of providers, with Dr. DeGoede, Clinical Psychologist as lead doctor and designated PTP.

 

On 2-4-12, sustained further injuries after two falls at home from LOC due to head injury on 1-9-12 with undetermined periods of loss of consciousness, suspected to be less than 30 minutes each, but unknown.  (See attached Hi-Desert Hospital ER report of Dr. Lambros, NO EEG DONE.

On 2-6-12  MRI Brain (one month post initial injury, 2 days post subsequent 2-4-12 injuries).  MRI not authorized by WorkComp Carrier even though it was recommended by 1st treating doctor in Urgent Care prior to subsequent fall on 2-4-12.   The MRI WAS authorized by employee health care provider, CIGNA, with a large co-pay due at time of MRI.

On 2-22-12, Authorized referral (non-MPN) to Dr. Eileen Kang, Neuropsychologist, by Dr. Daniel DeGoede, Clinical Psychologist (EAP referral, and ultimately authorized (non-MPN) at PTP.  Dr. Kang performed a battery of neuro-psychological tests and recommendations for further treatment were ignored by insurance carrier.

On 3-6-12, was referred by office of Dr. Kang  to Dr. Stephen Waldman, Neurologist  (2 hour drive from home; non-MPN provider, no TBI expertise; field of expertise epilepsy and fybromyalgia)  after several failed attempts to find a neurologist on the alleged MPN list.   Without medical evidence, Dr. Waldman recommended ‘precautionary epilepsy medications with mood elevator’ and attempted to have driver’s license revoked for decline of offer of unfounded medications.  A second neurologist was requested, but denied by carrier.

 

In March 2012, was referred to another  attorney, who was retained until November 2012 .

On 4-23-12, was then referred, again by another attorney, to a clinical psychologist, Dr. Marcel Ponton, in Pasadena (3 hours from home) who’s colleague, Dr. Gunn, re-administered a similar battery of neuro-psychological tests and recommendations for further treatment and evaluations were ignored by insurance carrier and in fact, TTD benefits were terminated on 4/30/12 in bad-faith action by carrier.

Dr. Marcel Ponton then referred injured worker to a second Orthopedic Surgeon, Dr. Kahlid Ahmed for a second consultation, and to a physiatrist, Dr. David Patterson, Medical Director at Casa Colina Rehabilitation Centers, for DMV eval to disprove Dr. Waldman request to revoke driver’s license.    Recommendations for further treatment and evaluations were ignored by insurance carrier.

Dr. Hilda Chalgujian, Forensic Neuropsychologist: May 2014 –

‘…recommend this patient be monitored neurologically in light of the above-noted cognitive issues; patient will benefit from a neurologist with experience int he treatment of traumatic brain injury; … recommend patient continue with individual therapy to help develop better insight into her functioning and increase her coping skills, and minimize external stressor;… supportive individual psychotherapy will help her develop strategies to help her…;  recommend she receive speech therapy to directly address her current difficulties with communication, including verbal fluency, as well as attentional issues…; recommend she is evaluated and monitored by a neuro-ophthalmologist to assess her ongoing and longstanding complaints of impaired vision, and explore vision therapy…; she may also benefit from occupational therapy to address ongoing visual concerns; this treatment should also address how to best compensate for situations that would be most relevant for her return to work in the future; …defer to her treating physician for her physical therapies; she should be re-evaluated in six months following her treatment regimen to assess her permanent and stationary status….’

 

ALL IN ALL, TO DATE, SHE HAS SEEN:

 

34 specialists, and has had 2 MRI of the head, one of the Cervical Neck, and one of the Right Shoulder.  Several of the doctors were referred by attorneys, her legal representation or by treating doctors.

 

She has been seen by neurologists, psychologists, psychiatrist, neuro-optometrists, neuropsychologists, physiatrist, 4 orthopedic surgeons, multiple therapies, including speech, physical for neck, acupuncture, vision and cognitive rehabilitation evaluation (please refer to attached list)

 

Retained and dismissed 4 attorneys due to incompatible goals; Injured worker has been represented approximately 14 months out of the 2 years 5 months since date of injury.   Each attorney did increasingly greater harm compounded by further failures to facilitate medical treatment than prior representatives.

 

The most care/evaluations were authorized when injured worker was in-pro-per after dismissing law firm #1. (Treatment with Dr. DeGoede, Dr. Kang and Dr. Whitlock Jan-Apr, 2012)

 

Due to brain injuries, and consequent communication and cognitive deficits, injured worker has been unsuccessful in retaining competent legal representation, knowledgeable about proper handling of a brain injury claim and necessary treatments and treating team, in accord with ACOEM guidelines. ADA requests for accommodations at WCAB – Riverside have been repeatedly violated.

Treatments of chiropractic, acupuncture, neuro-optometry, neurology, functional neurology, speech therapy evaluation, on-line brain-training, EEG, and Brain MRI’s were medically necessary, as requested by multiple doctors, and in light of the medical necessity, and continuous bad-faith actions of employer and it’s insurance company and defense counsel, have been self-procured and more than approximately $23,500 in outstanding medical costs remain unreimbursed since 2012.

 

To date, authorized treatments have only included:

2012 – 14 chiropractic, 17 psychotherapy

2013 –  6 physical therapy

2014 –  6 chiropractic, 12 acupuncture (right shoulder only for first 6, second set of acupunture requested as “959.01, 784.01 Multiple Head Injury, Multiple Neck Injury, Multiple Upper Extremities, Upper Back Area” and was modified by non-doctor to “959.01, 784.0 Multiple Neck Injury, Upper Back Area”  

[All urgent medically necessary treatments have not been authorized, many denied by non-physicians, and in 2013, Corvel became involved in further denials, primarily not-authorized by their Orthopedic Surgeons denying further evaluations and treatment by specialists in Traumatic Brain Injury.  Distortions by QME/AME doctors, compounded by Defense pattern and practice of omission of medical records have further contributed to the lack of medically necessary treatments. The 38 page April 2014 evaluation by Forensic Neuropsychologist has been objected to by Defense, apparently in order to further delay treatment and cause further harm.]

 

 

THEREFORE:  

#1  Wyndham Worldwide and it’s agents neglected to provide medical treatment and proper evaluations since date of injury.  Managers at Wyndham Worldwide resort – WorldMark by Wyndham at Big Bear – were negligent and apparently untrained in proper handling of an industrial injury, particularly one including a head injury.  The failure to have transported the injured worker to the closest Emergency Room or advise injured worker to seek immediate medical treatment to avoid further injury is extreme negligence.

#2 Not given proper Workers Comp info on MPN Providers and List of Providers and 1st report insurance information was lacking, causing need for use of  employee CIGNA insurance through February 2012.

#3 Allowed to “drive self home” six hours after Wyndham managers saw her fall and lose consciousness.  Allowed her to continue working even though she complained immediately of confusion, pain in her head, back and neck and right ankle.

#4  No immediate treatment authorized for head injury / MRI / EEG.

#5  Continuous negligence from lack of authorized treatments sent on a path of self-procured medical treatments (requested by multiple providers, ignored by carrier).  Out of pocket expenses for doctors, appointments, treatments and equipment needed for prognosis and ongoing care of brain injury and rehabilitation, and orthopedic injuries.

 

SEEKING IMMEDIATE RESOLUTIONS

A) Monetary reimbursements of medical mileage, treatments, and equipment.

B) Lump Sump Settlement for life-time medical treatments including certified Brain Injury Rehabilitation including but not limited to cognitive rehabilitation for high level Loss of Executive Function of Hi-IQ TBI survivor, vision therapy, vestibular therapy, speech therapy, vocational rehabilitation and retraining, with compensation for extreme loss of future earning capacity,

If the ‘injuries are so minimal’…. does it make sense that this injured worker would be off work for nearly 1,000 days… ‘for a headache and poor anger management skills when subject to intimidation, terrorism, and systematic bad faith and negligence?”

The theory of the Wyndham Defense Firm seems to be solidly perched in complicity in  fraudulently created medical reports by 3 of their doctors.  Out of 35, their 3 paid-‘doctors’, without expertise in brain injury, minimize the extent of the injuries, brain and orthopedic, and suggest ‘over the counter analgesics’ a MTUS recommended guidelines for diagnosed injuries, with clear intent to deny medically necessary treatment and to expedite death.

Does WorkComp insist on sending brain injured workers to ‘podiatrists’ for evaluations??    Ought to be some law enforcement, huh?

It sounds like more than 30 doctors will have to be investigated for #WorkCompFraud if the 3 insurance company owned doctor’s reports are not pure FRAUD… IF THERE WAS NO INJURY TO THIS WORKER, OR IF IT WAS MINIMAL, WHY HAS SHE NOT BEEN RETURNED TO WORK, WITH OR WITHOUT ACCOMMODATIONS, FOR NEARLY 1,000 DAYS???!!!!

Or…..for a more efficient legal investigation, perhaps a review of the 3 insurance doctors and the defense counsel and insurance adjuster  is in order by the Office of the District Attorney, as they have been most instrumental in the failure to provide medically necessary treatment.  Oh, let’s be sure to consider CORVEL, Crowe Paradis and MAXIMUS collusion as well.   WORK COMP IS A BILLION DOLLAR INDUSTRY…..LOTS OF OPPORTUNITIES TAKEN FOR ACTS OF FRAUD, WITH PLAUSIBLE DENIABILITY, HUH?

After the session at Workers Comp Court, my ‘frontal lobe’ felt like a SCREACHING train wreck happened in it, and I slept 18 hours since returning home from the Court events, and I woke up with these thoughts.  TBI  might be compared to being in a WALKING-COMA, trying to communicate racing thoughts, misfiring through injured neurons and tweaked pathways, for lack of professional descriptions.19006204-occipital-lobe--female-brain-anatomy-lateral-view
Could you kindly fax all medical records of treatments and notes directly to me today, or Monday at the very latest and/or email them to me?? I will forward to the defense attorney, or you can kindly fax them directly to both of us.  
 
As it stands now, there is only one entry on the Medical Index and it gives the deceptive illusion that I saw Dr. BrainMaestro only once, based on the December report.  Aside from the vision therapy I have recently self-procured, treatment with Dr. BrainMaestro is the ONLY BRAIN INJURY TREATMENT RECEIVED TO DATE (at an out-of-pocket expense of $11,750.00 plus tanks and tanks and tanks of gas for hundreds of miles).   What is urgently needed from you now is the Doctor’s records for each visit.

I am scheduled to see another insurance company QME neurologist the end of the month.  The last insurance company neurologist said I’m fine, nothing wrong except a little headache now and then, for which the treatment plan suggested was ‘an over-the-counter-analgesic’.

He was supposed to be my new ‘secondary treating physician’. Bummer.  No help whatsoever, and plenty of harm. Maybe it’s not all his fault; he didn’t get all the records from the Wyndham defense counsel and adjuster, and wouldn’t accept them from me.  The Judge fixed that.

We’ll see if he makes things right now.  Stay tuned for updates.  I am filing a fraud complaint on that doctor and a few others to encourage right action, and to perhaps help ensure no other brain-injured worker has to go through what I am going through now.

I understand that my medical records were subpoenaed by someone, but the defense attorney in my Workers Comp industrial injury matter alleges she does not have them, and I dismissed Attorney #3 who did not provide them with returned documents; my medical records were not included in the files he sent (although medical records of another of his clients were included, but apparently privacy breaches in Workers Comp matters are overlooked as everything is ‘public’ according to Attorney #2, and based on that legal input, I am increasingly comfortable BLOGGING.)

I have heard that this next evaluating doctor, a neurologist, has integrity and is not ‘owned’ by the insurance company, and that he has a moderate understanding of traumatic brain injury, at the very least.  It is possible that he may wish to ask Dr. BrainMaestro questions about his findings.  I can only hope he will.

I am getting “vision occupational therapy” for my ‘occipital lobe’ (I guess) at Casa Colina Rehabilitation Center ….. they recommended twice a week, but it’s too far to drive twice a week, and too hard on my body and brain. They have a day-program that seems to incorporate many of the scientific techniques used in your offices, and I am awaiting an evaluating report from their medical director,  a physiatrist and serious brain specialist.

As you stated in our treatment sessions, my balance has also been adversely impacted by the untreated injuries.  At Casa Colina, they have a whole department to deal with ‘vestibular disorders’ disorders as well and I am awaiting evaluation and treatment in that system as well.  I hope to have that report for the neurologist as well.

It is my prayer that the Judge, once he is provided with the horrific evidence of violations of law and injured worker abuse and fraud by several providers, that the Judge will compel the Insurance company to authorize immediate treatment at both Casa Colina Rehabiliation Center for intensive immediate care and your Center for ongoing long term care.

With treatment, I understand I could have returned to work within 6 months or so after the injury.  So who did denial of medical care serve?  Did it uphold the Spirit of the Law???  I THINK NOT.

By the Grace of God and a Court Order of the Judge yesterday, the defense attorney has been ordered to include all omitted medical records which have been omitted from various requests for doctor evaluations over the course since at least October 2012.

At the Court offices, the attorney and I reviewed lists of records and I provided her with duplicates of ones I had previously provided, and she came up with another list of ones she also allegedly did not/does not have, including Dr. BrainMaestro’s.   That’s the event that triggered this communication, and it just keeps going.

Defense Attorney’s assistant is repeatedly challenged with accuracy on PROOF OF SERVICE dates and issues of perjury, so it’s possible several of the omitted records were ‘lost’.  That’s just another item for my fraud complaint file, and is collecting evidence.    NOTE:  If the NOTICE OF EXPEDITED HEARING for 7/11/13 didn’t reach the other parties in time (my copy arrived late in the day, on the date of the hearing, and it clearly states,

The harm and deceptions continue.  The #3 attorney failed and refused to ensure that the complete medical records were provided to the insurance company evaluators and was extremely abusive to me in other ways as well. It took me till now to get in front of the Judge who then compelled the defense to include all records.

The insurance adjuster and attorney prevented me from having a primary treating doctors with expertise in brain injuries, sending me to Orthopedic Surgeon after Orthopedic Surgeon, while denying any and all further test evaluations for head trauma.  The current Primary Treating Doctor, an Orthopedic Surgeon, has requested, repeatedly, referral authorization to a neurologist, to a physiatrist, to a speech therapist, a chiropractor, a psychologist and more.

An MRI of my right shoulder was just authorized, and apparently there is a huge tear that the doctor is recommended for surgery, not by him, but to a specialist based on the severity of the tear.

I advised the defense attorney in Court yesterday of the discovery and without compassion concern or question, she simply said, “Of course you realize that will be denied.  It’s not accepted body part” (or words to that effect.    The 3D plan of the insurance company to maim and kill me is progressing.

Defense attorney also said the referral to the physiatrist was withdrawn by the insurance adjuster, since the referring physician is an Orthopedic Surgeon, not a brain doctor, and their leased/owned neurologist alleges there is no evidence of any injury to me or my brain.

 The adjuster said the authorization to be treated by a physiatrist, and injured workers’ request to have the physiatrist as the primary treating physician was withdrawn because the insurance company neurologist said there’s no objective evidence that he could figure out, so take an over the counter analgesic and don’t come back.

I guess they forgets I pleaded, repeatedly, on my own and to legal representatives, for a doctor with brain injury expertise all along, since the first diagnosis.

In December 2012, after they terminated my treatments with your Treatment Center, I asked then that the physiatrist be designated as my Primary Treating Physician.   The Workers Comp information officer apparently didn’t know what such a doctor is, and that it is the ACOEM guidelines treating doctor for brain injuries, so I had to get another Orthopedic Surgeon or the ill-reputed neurologist, without knowledge of TBI,  I ended up with anyway.

Since the WCAB Information Officer seemed unfamiliar with the ACOEM guidelines, and did not have a copy to share, nor was the IO able to recommend where to access such information, other than paying approximately $800 for it for a quick reference…..alternate resources were investigated regarding basic brain injury treatments both at the NIH and commerical levels:

Medical Disability Advisor states:  “A PHYSIATRIST CAN BEST ASSESS THE DEGREE OF MENTAL AND FUNCTIONAL DISABILITY FOLLOWING BRAIN INJURY…… participation in the rehabilitation program can include physical, occupation, speech and recreational therapists, social workers and vocational counselors.  A coordinated treatment approach from a team of healthcare professional is necessary for treatment to succeed…. In rehabilitation of a head injury, the therapist must sequence activities from easy to more difficult.”

DOES ANYBODY IN THE WORKERS COMP CROWD KNOW THE DIFFERENCE BETWEEN A ‘PSYCHIATRIST‘ and A ‘PHYSIATRIST‘?????  ONE CAN HELP WITH TRAUMATIC BRAIN INJURY….. and the Psychiatrist Crowd (particularly of the ‘forensic’ variety) can sincerely aggravate a High-IQ TBI Survivor…… even when the brain trauma has diminished IQ by 15-20 points and caused cognitive impairments…… D’oh!!!

Isn’t it curious that I have seen so many orthopedic surgeons and it took approximately a year and a half for them to identify the shoulder injury, although loss of range of motion and complaints were noted in several reports?  I am grateful the current Primary Treating Orthopedic Surgeon requested the MRI.   I have complained about shoulder pain all along, but my orthopedic complaints have always been secondary to the brain impairments, and I have been hard-challenged to even communicate the extent of my injuries, and few of the doctors have asked appropriate questions, or inquired further at articulated complaints.

The experts in brain injuries have a very different set of questions, and don’t dismiss all the complaints under a simple and inaccurate category called, headaches’ like both the insurance company neurologist and his Orthopedic Surgeon referring buddy have done in my case. The physical therapist recently demanded I do exercises leaning in to an open door….which I tried.  When I advised, “that makes me feel like my shoulder is going to break” the assistant snapped and said, “Oh! Don’t be ridiculous. Your shoulder is NOT going to break!”…… I guess I was wrong, ‘TEAR FURTHER’ would have been more accurate word finding.  o.o

The adjuster has recently (July) authorized a final 6 chiropractic sessions and, like last year, is unable to find a local chiropractor on the alleged MPN list.   The local chiropractor is unwilling to deal with the aggressive bad-faith and failures to pay by adjuster of CNA Claims Plus and no longer accepts workers comp patients at all.
 
The chiropractor was the first doctor seen after work, when employer responded to the question at approximately 10 am on the date of the injury….….
INJURED WORKER:  “Do I have to see any special doctor?”

The insurance company insists that was proper notification of their alleged MPN network.  Go figure, huh? 
 
The first doctor I ever saw for these injuries is willing to treat me at a discounted cash-pay basis as long as I like.  It’s not a BRAIN fix, but it does help alleviate orthopedic pain and other symptoms, but that doctor said there is nothing he can do for the shoulder injury, particularly since it has been so long in being diagnosed via MRI.

One chiropractor was found about an hour away, and she was not sure she was on the MPN list, as she hasn’t taken a work comp case in a long time, but it took her 5 phone calls to me, with incessant demands that I call the doctor back for this, the adjuster for this, Corvel Corp for that, do it again, and would not even give me her street address, and insisted I write down directions, TWICE, from two different perspectives, and could not grasp the impact of the brain injuries on my abilities to take in and process info audibly….even though I told her so.

She declined to treat.  They may find another chiropractor, but I will not hold my breath.  The last authorization for chiropractic care was terminated without cause in April 2012, along with benefits…. all in violations of law, without consequence to the perpetrators of said violations….yet.  
One attorney I chatted with in the elevator at the Courts building was encouraging that Justice does prevail.  I hope he is right.

I am screaming my head off now, like my life depends on it, because I feel my life has been totally threatened by these willful and malicious breaches of law and bastardization of the intent of Workers Comp law and benefits and about these violations of humane treatment in Workers Compensation system, for what it’s worth.

A doctor-friend recommended I channel my outrage more positively than on the deaf ears and blind eyes of the doctors and lawyers and corporations complicit in the fraudulent denial of reasonable and appropriate medical care for injuries sustained January 9, 2012 and further injuries sustained with denials of medical care, and interruption of self-procured medical care.  I can follow clear directions, if they are simple and don’t have too many pieces to them…… “rote’ is the word I think one doctor suggested of my current skills in tasking and sequencing tasks.

I have been penalized further for cognitive impairments that gullibyl allowed me to retain 3 different attorneys, each who confirmed they could help get medical care for a brain injured, who evidently, in retrospect, were unable as they are without knowledge of brain injury cases, and without ‘conscience, empathy, emotion, guilt, remorse or soul’.  I have been reduced to relying on the Workers Comp Information Officer, who has, since December 2012, apparently provided me with faulty and blatantly deceptive information, in favor of the insurance company, evidenced in my requests on how to request a hearing for medical care, how to request reimbursements for medical expenses and miles, even while I had case law cited ….. I just needed help on the processes to comply with Court guidelines.    I trusted these lawyers and law firms I hired when I could hardly speak, let alone think.

I am asking the Judge to withdraw/remove their liens for their failures to perform in a reasonable manner to adequately represent me, and that their liens add to the harm already caused to me, as a further obstruction to justice and harm to this injured worker.   Based on the inaccurate information provided on 3 occasions by the WCAB Information Officer, I am requesting this week an EXPEDITED HEARING to have lawyer liens removed from my case immediately, with due cause and evidence.  Had the lawyers simply been truthful of their lack of expertise in brain trauma cases, they could have saved much aggravation, and possibly my life. They have been unwilling to withdraw their liens upon polite request.   Polite requests are done.  As the Judge reminded me, ‘this train has already left the station’……

Some may label my communications and lists and spreadhsheets as ‘compulsive writing’ but for those who know nothing about TRAUMATIC BRAIN INJURY, TBI  might be compared to being in a WALKING-COMA, trying to communicate racing thoughts, misfiring through injured neurons, causing thinking to feel like ‘a screaching train wreck in the frontal lobe’ further distorted by vision impairments.
