Back in 2012, one doctor suggested that I write about my work comp experiences after a witnessed slip and fall backwards, big, hard, conk on the head, little-to-no medical care over the course, in order to help me process what was happening to me with the lack of medical care, legal chicanery, and fight for my life.

It took until the summer of 2013 to make it a blog…..the earlier writings were to WorkComp people — doctors, adjusters, lawyers, human resources. Initially, I suspected the poor treatment was simply that some of the people I was dealing with were simply stupid.   I discovered it is far worse than that.

Have you seen the movie, WOMAN IN GOLD?  Here’s the trailer.  I watched it this week.  I cringed and gasped repeatedly as I saw parallels between those atrocities, and the life destroying actions of the WorkCompsters around the nations.  It is time for more Doctor’s Trials, to include the complicit sonderkommando, wouldn’t you agree?

 

ENOUGH IS ENOUGH.

 

Watch it and see for yourself how the parallels can be drawn with the devastation and destruction by the Nazi’s in the 30’s and similar destruction of life in the 21st century—of disabled workers, older workers and other ‘economically undesirable’ or ‘unprofitable’ members of the working classes.  If you do watch it, pay particular attention to the cheering when the Nazi’s rolled in to Austria, and the terrors that followed and wonder about shareholders of the companies causing such atrocities. Today, they don’t roll in in tanks, it’s the sedans and stretch limos?  Yikes!

If you’re in the industry, Y’all already know what’s happening. DO SOMETHING TODAY.  MAKE A POSITIVE IMPACT.  “ADOPT AN INJURED WORKER” AND HELP THEM ESCAPE FROM THE “assembly lines of death” and OPEN AIR DEATH CHAMBERS!

If not you, then who?  If not now, then when?

Let’s individually and collectively conduct interviews with doctors, lawyers and others who have “left the industry” so that real issues can be addressed, in a less threatening manner, with, perhaps, some amnesty provisions for early responders.

These WorkComp challenges and atrocities are Universal —- perhaps the USA, Canada, UK and Australia have similar organizations — like WorkCompCentral + ProPublica + National Association of Injured and Disabled Workers and everybody can join forces to save/extend lives.

We’ll probably need some educational events to address BEST PRACTICES for Whistle Blowing, in all quarters, wouldn’t you agree?

It has been somewhat comforting over the past year to see discussions about the many horrors of WorkComp, along with the high profits for the insurance carriers. Romano Trust Vs. Sedgwick seems to have paved the way for carriers to “wish and hope you die” if you are an injured worker —-it’s an cost effective strategy, in perfect alignment with PROFITS BEFORE LIVES business models, also used by the Nuclear Industries?

A recent DePaolo World blog shared another story with the same trend….. Profit Before People rather than the carrier paying for transitional living facilities at approximately $40K a month, likely with the help of some nasty pharmaceutical, that injured worker’s ‘suicidal ideations’ and attempts could save that carrier a bundle…..  and have “Happy Shareholders”??  Yikes!  See also Guilty Without Charge

Well, recently a recommendation from another doctor/coach suggested I write about my WorkComp experiences.  I shyly reported, “Well, I have a little blog already, but I do want to write a book.”   Unimpressed (and previously unaware of my blogs) it was suggested that before our next meeting that I “write an Introduction and a Chapter Outline.”  😀   THIS IS THE INTRODUCTION!   HERE COMES THE OUTLINE!

DATE OF Initial INJURY: 1/9/2012 – Repeated failures to provide medically necessary treatment. Designated primary doctor Orthopedic Surgeon–FOR A HEAD INJURY!

DIAGNOSIS: CLOSED HEAD INJURY, CONCUSSION, TBI, PTSD, ETC.  [see blogs for more details on diagnosis and denied medical care]

Thousands and thousands of dollars spent on reports and evaluations; malicious, callous and willful DEFENSE AND CARRIER disregard of repeated requests for medically necessary treatment. Repeated failures to pay TTD in 2012 and 2013, and in 2014, carrier settled with State for EDD paid disability at a severe discount, leaving injured worker to rely on Salvation Army and continuing attempts for Social Security Disability assistance, while exhausting all personal resources for life-saving treatments and devices…. more than $30K out of pocket spent, and continued refusals to participate in interactive process for possible Return To Work, and employer failures/refusals to demand #ClaimAudit…. File churning, delays, denials seem the norm, Allegations of age, gender, disability, civil rights and ADA violations by extensive network of fraudsters also. Has anybody else been to a doctor who practices ‘functional neurology’? It’s very scientifically based… no guesswork, no drugs.

Blogging and Vlogging are other ways we can tell our stories…. Here’s a video from 2012, after some excellent ‘functional neurology’ treatments in Palm Desert, California. Of course, the defense firm threatened the doctor and told him to stop treating me, and continued to refuse to provide any medical care for the first 2.5 years, finally got some speech therapy, vision therapy, and occupational therapy via work comp for a few days, when months were requested…. For you info…. document your stories….. we’re all fighting for our lives, and those who follow…. Carry on!

Acupuncture has also been extremely helpful since August 2013, along with neuro-vision prism lenses and therapies, no thanks to the insurance carrier.

Currently, I am most grateful for the Coastline Acquired Brain Injury Program in Newport Beach…. an incredible organization with experts in the field of brains and compensatory strategies.

December 2012: Orthopedic Surgeons designated repeatedly by WorkComp to treat Traumatic Brain Injuries? Work Comp repeatedly refused to designate a Physiatrist, Neuro-Psychologist, or Neurologist as PTP…. and work comp neurologists are not current on brains… and don’t even know that vision is with the brain, not the eyes; defense firm and work comp info and assistance officer struggle with the fact that the brain is a “body part” in the head region.  D’oh!

    I’ve been working since 1969….never before touched by this vile system of WorkComp until 2012…. Alrighty then:

    It has nearly destroyed my life since a witnessed slip and fall of January 9, 2012 that resulted in a traumatic brain injury, while thousands and thousands and thousands of dollars were ‘spent’ on evaluations that resulted in little-to-none medically necessary treatment. The file still churns. I’ve spent more than $30,000, and lost more than that since I haven’t been able to return to work (despite valiant attempts at accommodations, trials, pleas!)  trying to stay alive and dodge these WorkCompsters….

    It’s time for change.   Any of you who believe the propaganda that InjuredWorkers are “on the dole”… TRY LIVING WITHOUT AN INCOME FOR A COUPLE OF YEARS…. BECAUSE THE STATE LET’S THE INSURANCE CARRIERS GET AWAY WITH  NOT ONLY FAILING TO PROVIDE MEDICALLY NECESSARY TREATMENTS, BUT ALSO WITH REFUSING TO PAY TTD, THEN GIVES THEM BIG BONUSES UPON NEGOTIATED RESTITUTION…. 

    Maybe David and pals can create a “WorkCompCentral – INJURED WORKERS FORUM”….  In the interim, do check out NATIONAL ASSOCIATION OF INJURED AND DISABLED WORKERS …. all over social media…  NAIDW.org

    I can assure each of you, I’m not the only one with an axe grind and a deeply felt wish for Doctor’s Trials to include complicit vendors, including lawyers.

    It was experience in the first 2.5 years post-injury that those who profit by worker injuries are afraid to speak to us….. as it causes severe cognitive dissonance for them.

    I, myself, have been subjected to some pretty vile verbal attacks by both attorneys, info and assistance officers, industry leased/owned doctors, and by long-term alleged injured workers, who act more like industry trolls than peers in a Fight for Freedom as Prisoners of WorkComp Wars.

    Meanwhile, #InjuredWorkers ARE Uniting…we know ‘where the bodies are’….and we have clues to “who dunnit”…

    Let me know if I can be of any assistance in creating more a communication flow between both sides…. after all, we’re Americans, right? HOME OF THE BRAVE….and WE ARE THE MEDIA NOW… till last gasps….

    Let’s keep track of industry peeps who are naughty and nice in 2015!  SUBMIT INFO FOR COMP LAUDE AWARDS – 2015!    Save the Date – December 5, 2015…… Maybe we’ll see YOU at an InjuredWorkers Table!
