With a nudge from DOL and DOJ, per the Congressional letter of October 2015, maybe the DAs can do a better job in 2016. Kudos for what they did do. They must do more. A hotline for Injured Workers to report suspected fraud could save millions….lives and dollars.

I received an inquiry from an investigative reporter in the UK…. topic? MAXIMUS. I suggested they will be busy writing investigative reports….likely for YEARS AND YEARS. I asked for a link to the documentary when it is done. I said it might save lives in the USA.

As an Injured Worker and blogger with a case that reached resolution with quite little thanks to CAAA members, Injured Workers are reaching out to me for help.

All I can basically tell them is “blog like hell, and scream like your life depends on it, because it does.” And I can pass on advice given to my by doctors and lawyers, “Get out of the work comp system as fast as you can, by any means necessary. It will kill you.” Yeah, doctors and lawyers told me that, WorkComp doctors and lawyers. Can’t make that stuff up!

I had been invited to the CAAA 50th Anniversary dinner this coming Saturday, but the CAAA office staff made if quite clear, with great contempt and disdain, that INJURED WORKERS ARE NOT WELCOME and the registration was apparently lost, just like so many medical records in the WorkComp systems.. Alrighty then, when one thing doesn’t work, we do other things.

Today I received another call from a woman in her mid-40’s, a case eerily similar to the Charles Romano case. It is over 20 years old, and has gone from bad to worse. In recent weeks, I have been in communication with the family of a woman in her 40’s, eerily similar to the Charles Romano case.

Since I am unable to attend the #CAAA conference this week to hear Alan Gurvey’s “PUBLIC FORUM” on medical treatment for Injured Workers, and David DePaolo, Tom Martin and Keith More on The ProPublica/NPR Investigative Reports: Affecting change, I can meet with one of the the Sedgwick victims and show her and her husband how to blog. I may meet with the others via Skype and show them how to blog.

#WoW…. it’s indeed a War On Workers. It’s horrifying to listen to the tales of younger workers being maimed and their lives destroyed for the profit and greed and psychopathY of the few. They have been taught to blame Arnold. What a deception. It’s much deeper than any one politician. There truly seems to be little hope for the American working class.

Let’s see what, if anything, comes out of the CAAA convention…

I hope the gentlemen handling the panel on ProPublica and The Demolition of Workers Compensation discussions GIVE ‘EM HELL.

I don’t think David, Tom and Keith will sugar coat the horrors they are fully cognizant of in the California system.

Let’s hope next convention they open the doors to Injured Workers, whom they allege to represent. (The privilege I had in 2014 to visit in the CAAA Winter Convention Exhibit Hall… may have saved my life. I did meet some wonderful and powerful people of goodwill. Too bad no other injured workers will get that opportunity, at least not via CAAA.)

I think all providers need to do a survey of Injured Worker clients to get a reality check on ‘SATISFACTION” levels.

IMHO, CAAA has nothing at all to ‘celebrate’ as long as injured workers are being maimed and killed by legislated and supported fraud. Maybe they should create a self-help training course for self-represented Injured Workers…. more lives might be spared.

Nevertheless, they need competent legal representation. Can you recommend anybody in Orange County/ San Diego areas who can take over currently represented cases that have had the same attorney (respectively) for more than 20 years? The “2-attorney-rule” does not apply, so these Injured Workers must make a smart decision if they decide upon change.

Why does California demand that Orthopedic Surgeons be the primary treating doctors for BRAIN INJURED WORKERS?  Nobody in Sacramento has ever head of ACOEM and MTUS and NIH for guidelines on treatment?  Doesn’t California WorkComp have any PHYSIATRISTS either to refer brain injured workers to?

The WCAB and defense teams seem to act like that’s a made up word when such is requested as a PTP!  WorkComp neurologists are essentially clueless about brains, not even knowing that vision and hearing are functions of the brain!  D’oh!  7th Grade Kids seem to know more about brains than California QME/QME “Neurologists” and CorVel/Maximus “doctors.”

WorkComp does seems to have it’s own rules, courts and subsidies, huh, operating outside the Constitution of The United States of America on multiple issues, doesn’t it?  Outside the California Constitution on multiple issues, as well.  
 
Is there a Civil Rights lawyer in the house?  Has the BIA – Brain Injury Association of America been consulted?  Have any Injured Workers been consulted? Was CAAA consulted?   How about the leading mouth-pieces for the industry?

Let’s watch the unfolding drama. Investigations and Indictments seem to be in order. Will DOJ and FBI investigate these suspicious acts? We can continue to wait and wait and wait and hope.

California needs Federal Overseers of WorkComp practices to protect the Working Class, and we need it NOW!
 .
I am not too alarmed, however.  WorkComp doesn’t  seem to have any neuropsychologists to refer Injured Worker’s to anyway, for at least the past ten years, based on input from Injured Workers in Southern California.
 .
Orthopedic Surgeons seem to be the norm to be designated as treating doctors, and they joyfully report they have no knowledge of brain injuries.  
 .
(This seems to be a very weak link in their practices, since accidents with broken bones often can include head injuries…. their Society might take a closer look, or, like NFL, involve the cardiologists? D’oh!  )
 .
CAAA practices don’t seem to be much better or stronger when it comes to brain injuries; some of their members do as much harm as those paid to harm injured workers, through willful ignorance or ‘not enough money in it’ syndromes)
GRAVY TRAIN WRECK
 
Last year, one case, defense tried to send the TBI survivor to a neuropsychologist for yet another evaluation–one who admitted hadn’t treated brain injury patients for over seven years…  Just apparently real busy and profitable doing evaluations for Work Compsters.  [
 .
The three neuropsychologists who evaluated this injured worker (two in 2012, one in 2014) were all approved/authorized outside of the alleged MPN.  
 .
The adjuster apparently had no clue as to what type of doctor to send the Injured Worker to, and the EAP program (that IW was originally referred to a Clinical Psychologist) was a bit of good luck, as that CP doctor had tremendous brain injury knowledge, as his own son was recovering from a devastating brain injury, with the help of an interdisciplinary team of doctors and specialists.  
That clinical psychologist helped walked the rookie adjuster through the process, clearly describing the dangers and the needs for immediate and appropriate medical care.  The Injured Worker had to pay for the MRI’s recommended in both 2012 and again in 2014.  
 .
WorkComp peeps seem to dispute the location of the brain, and attempt to pretend it is not a body part.
 .
WorkComp seems to approve primarily Orthopedic Surgeons and Chiropractors for brain injury, with a little PT and 40 or so face to face evaluations, and countless re-evalulations by CorVel doctors—who also seem to know little to nothing about brains.  
 .
It took nearly 3 years for the mentioned Injured Worker to get to a speech therapist and occupational therapist (3-6 months treatment were required, 16 days were authorized, then extended another 8).  
 .
One of the WorkComp leased/owned neurologists suggested that since care had been denied for two years (at that time) and since the injured worker was female and over the age of 35, no treatment was deemed necessary, contrary to all medical evidence.
 .
The primary treating doctor since Feb 2013 has been an orthopedic surgeon, and the bulk of the denying Corvell doctors have been orthopedic surgeons. WorkComp neurologists and CorvVel and Maximus doctors seem to be simply clueless about head injuries…..or are they paid to just look the other way and write false reports to ensure denial of medical care.  
 .
Responses from DIR over the course will be located and  forwarded  to appropriate authorities.  Seems this situation may call for intervention, finally, by DOJ/FBI.

Initially, I suspected the poor treatment was simply that some of the people I was dealing with were simply stupid.   I discovered it is far worse than that.

Have you seen the movie, WOMAN IN GOLD?  Here’s the trailer.  I watched it this week.  I cringed and gasped repeatedly as I saw parallels between those atrocities, and the life destroying actions of the WorkCompsters around the nations.  It is time for more Doctor’s Trials, to include the complicit sonderkommando, wouldn’t you agree?

 

ENOUGH IS ENOUGH.

 

Watch it and see for yourself how the parallels can be drawn with the devastation and destruction by the Nazi’s in the 30’s and similar destruction of life in the 21st century—of disabled workers, older workers and other ‘economically undesirable’ or ‘unprofitable’ members of the working classes.  If you do watch it, pay particular attention to the cheering when the Nazi’s rolled in to Austria, and the terrors that followed and wonder about shareholders of the companies causing such atrocities. Today, they don’t roll in in tanks, it’s the sedans and stretch limos?  Yikes!

Let’s individually and collectively conduct interviews with doctors, lawyers and others who have “left the industry” so that real issues can be addressed, in a less threatening manner, with, perhaps, some amnesty provisions for early responders.

These WorkComp challenges and atrocities are Universal —- perhaps the USA, Canada, UK and Australia have similar organizations — like WorkCompCentral + ProPublica + National Association of Injured and Disabled Workers and everybody can join forces to save/extend lives.

It has been somewhat comforting over the past year to see discussions about the many horrors of WorkComp, along with the high profits for the insurance carriers. Romano Trust Vs. Sedgwick seems to have paved the way for carriers to “wish and hope you die” if you are an injured worker —-it’s an cost effective strategy, in perfect alignment with PROFITS BEFORE LIVES business models, also used by the Nuclear Industries?

A recent DePaolo World blog shared another story with the same trend….. Profit Before People rather than the carrier paying for transitional living facilities at approximately $40K a month, likely with the help of some nasty pharmaceutical, that injured worker’s ‘suicidal ideations’ and attempts could save that carrier a bundle…..  and have “Happy Shareholders”??  Yikes!  See also Guilty Without Charge

Do all the “Medicare Part D” providers ask the same question before quoting a policy price? When I called AARP a few months ago, apparently for United Health Care, the first question asked me to confirm that I don’t have “renal failure” –I have a brain injury.

I said something like, ‘Ok,, so no, no renal failure, I’m pissed off about Workcompsters and how they are profiting by making so many people permanently disabled and prematurely dead, but thank you, my kidneys are working just fine today, How much is the Part D deal?’…. (It was a “today” purchase, with penalties if I didn’t decide on drugs right away.)

HOWEVER, that caused me to wonder what are the popular drugs peddled by the Big Pharma groups that CAUSE renal failure; I have lost a few friends who were on the ‘drug and kill ’em’ plans…

They helped me see that I can easily do tasks with TWO – STEPS. That third step can really kick butt…. like making coffee: 1) put coffee in maker 2) turn pot on 3) wonder why coffee is spilling all over the counter; find pot in dishwasher; try again; 1) put fresh dry coffee in maker; put pot in maker 3) wonder why coffee isn’t done yet….. unsure emoticon

LINDA: I slept most of the first year. COGNITIVE FATIGUE is a real butt kicker. Sometimes after a long drive to a doctor’s evaluation, I had to find a safe shopping center to park and rest. Sometimes I still have to find a safe place to nap while travelling here and there. I carry a blankie. unsure emoticon

One idiot neurologist actually wanted me to drive 100 miles each way to his office WITHOUT SLEEP and only HIS office with HIS technician for a ‘sleep deprived EEG’ that second month.

Wow, I told the lawyer I was injured not stupid, and requested a smarter neurologist. The response? Termination of benefits, and begin of the ‘kicking to the curb.’ ‘Curb kicking’ went into full motion, with other bullying and terrorism practices by ‘the Defense’ upon clear diagnosis of brain injury, and hasn’t stopped yet; ongoing since January 9, 2012. Yeah, in America! Ain’t that awful.

WorkCompsters apparently only treat brain injury in California with the ‘rest and wait and wait and wait and wait till you’re kicked to the curb, they hope you die’ program.

Wyndham has paid the big premiums for that sort of WorkComp Insurance Policy for it’s injured workers from CNA aka America’s Casualty insurance firm. It’s pretty similar in other states and nations. Same crowd of #WorkCompsters?

My friend and teacher, Michelle Wild, just recently released an Apple app for the brain injured population. It is called Manage My Fatigue.  YOU could write a great article about Michelle Wild and her 25 plus years of work helping people with brain injuries develop compensatory strategies… She also has a website called making cognitive connections… I think the address is ID4theweb.com. There is a wealth of information there… Worth checking out.

I am compiling information on all the non-recommendations and claims evaluations since date of injury, 1/9/12. Apparently I do not have the 2013 correspondence, from CorVel, as much of it was sent by your company to the former defense counsel, after you had been properly noticed to cease and desist. Some of it, if I ever received it, I may have simply misplaced. The pieces I have found do not show proof of service to me. You may recall my emails regarding violations of my HIPPA rights and continued anyway.

If you will kindly send me everything for 2013 I would appreciate it so I don’t have to sort it with the pieces I do have.

Will you please email me Friday morning the complete Non-Recommendations and Modifications and Claims evals for all of Dr. Darren Bergey’s requests for treatment in 2013. Everything from Ballard Brain Rehab, to chiropractic, to accupuncture, to neurology, psychology, neuro-psychology, neuro-optometry and more.

Prior to Dr. Bergey, 2/2013, all failures to provide medical care were handled directly by both the defense law firm and the adjuster, both non-physicians, cleverly avoiding a paper trail. The information and assistance office was of no help to me, and in fact, when I inquired how to deal with the grossly inaccurate and possilby fraudulent reports (per DIR definition of Fraud with intent to deny medical care) ( of Dr. Zardouz, Dr. O’Brien, and Dr. Kent, I was advised to simply write a note saying,”I object to these reports.” I did as instructed, but the fraud was never addressd, and these faulty reports are continuously used as weapons of continuous and egregious harm to me. That is being dealt with shortly, as there are interested Tasks Forces in the Offic of the DA, not the office number Dr. O’Brien dared me to report him to. It’s been over 3 years and I am continuously denied the right to be heard by a WC Judge on my right to medical care. I’m not the only injured worker self-represented. That must change, and it may take Congressional intervention. At least their looking now, huh?

By copy, if Fred Sachs, adjuster, has medical evidence of 2012 denials of requests by Dr. Daniel DeGoede,, Clinical Psychologist I was sent to by the Wyndham Worldwide Employee Assistance program who was the initial PTP and worked closely with Daniel Elliott to organize the first neuro-psychology exams and then briefly Dr. Uppal, appointed by the first law firm I retained, and then the requests by Dr. Marcel Ponton, Clinical and Neuropsychologist, appointed by the Court after a hearing in June 2012 exposing that the MPN was never properly served, and seemed not to exist at all.— PLEASE SEND ME THE 2012 DETERMINATIONS OF DENIALS OF MEDICAL CARE… Doctors didn’t deny, it was non-doctors, but there has to be a process to deal with such matters as well.

The adjuster and I worked very closely in February 2012, trying to find providers in the field of neurology and neuropsychology. Daniel cheated Dr. DeGoede out of several agreed upon and authorized sessions, and left me without any support whatsoever. Had care been authorized in 2012, I would not be writing this email today, and I would not have lost the last 3+ years of my life to such a vile system. Oh well, it is what it is, huh?

Investigative Journalists have taken a further interest in my dilemma, and with all the buzz about CorVel and ProPublica etc….. I want to be able to provide them with all the facts, so people can draw their own conclusions about my case, and the discrimination of injured workers with disabilities like mine, my age, and my gender. . I need the materials also because my civil rights are being further violated by the defense, and the Department of Justice has invited me to share more information, which I will gladly do.

By copy to the Defense firm, while you have repeatedly advised that you have no expertise in ADA and employment law, continued harm caused by your firm will be handled by the proper authorities in due course. Google FEHA, ADA, and Brain Injury.

Ok, pretty please send those 2013 CorVel non-recommendations that I am not copied on and don’t have to me electronically, and was not provided by the PTP, so I didn’t learn much about Maximus till recent corruption articles.

BTW, many of your superiors seem to have quite an appreciation for my LinkedIn profile. Please let them know there is no reason to stalk my wall, I accept all invitations to LinkUp…. friends and enemies alike. The Defense attorney and the Wyndham Risk Manager seem to have a relationship that goes ‘way back’ and I am now fearful that such a conflict of interest may be a factor in the continuous harm to me, and that department’s repeated failures to communicate with me and it’s failures to conduct a long over due claim audit. Michael would never even help me when I asked for help with reimbursements and TTD payments. Awful. That New Jersey politician is taking some serious heat for promoting the CorVel allegations of employee fraud being “40%”…. I suggested it might be an internal statistic, on the low side. Corporate fraud is of extreme interest in the news today. Let’s give them the facts on my case and let the public draw it’s own conclusions, shall we?

I hope most of you never have to experience the extreme horrors this WorkComp charade has put me through.

Do you think this means that because CNA refuses to get me training and treatment so I can return to work (it’s been over 3 years now) that they are breaking this law? And making my employer, WyndhamWorldwide a party to such a law breach?

Looks like disabled people are allegedly already protected… hmmm….just found some things on FEHA while looking for other things…. I have no interest in going to law school to save my life, but surely they can see the value of the state run program, COASTLINE ACQUIRED BRAIN INJURY PROGRAM….they have been helping people with Brain Injuries return to the community and work for over 25 years. All CNA can approve is some chiropractic, acupuncture and evaluations for over 35 doctors…. for brain injuries? D’oh! ain’t that nothing!
