…It simply is not enough to complain. Everyone has a complaint. A complaint without a solution is bulls**t. You may as well just dig a hole and hide because no one is going to pay attention.

Everyone knows that bad sh*t happens in work comp and that there are profiteers off of the injured. That’s no secret.

The contempt and disdain that masks the dangers to Injured Workers by the industry profiteers is undeniable and sounds pretty darn dangerous, doesn’t it?

They ‘might be right.’

I want to find a way to propose solutions to help Injured Workers escape the WC System with their lives.  The laws are unenforced and meaningless.

I have a collection of Injured Worker stories, most of whom prefer to be Anonymous.  Watch for them.  They include, but are not limited to, in progress tragedies apparently caused by Sedgwick and others.  Most have poor-to-no legal representation, advocacy, medical care or benefits.  Yes, in America! An AMERICAN DIRTY OPEN SECRET.

Too many lawyers just make stuff up to protect profits by any means necessary. The US Constitution is mocked by the WorkCompsters, and far worse, they get away with it.  You don’t look.  You don’t care. Till you’re stuck in the box car, heading for the death camps of WorkComp.  Enough is enough.

It will require teams of mediators and structured settlement people. Would you find that of any interest? Start with a plan to release all POW’s who have been in the WorkComp System 4 or more years…..within 12 months, with the help and supervision of the National Guard.

It requires “arming ” Injured Workers with the ability to blog and share their stories, heinous as most of them are.

I am also in the process creating a course for Injured Workers to empower them with Work Comp Survival and Virtual Combat Skills!  Watch for it!

I am wondering about the possibilities of a collaborative effort and ezine and possible Tele summit to unite voice of any good people in Workers Compensation with victims of WorkComp to lead legitimate national discussions “Of the People, By the People and For the People.”

I am one voice speaking on behalf of Injured Workers. There are a few of us.

Canadians and Australians seem more vocal about the same class atrocities. Perhaps they don’t fear their governments like so many American’s do?  Has our Constitution become so meaningless that an entire industry can profit by destroying a segment of the Working Class?   ‘When they come for you, there will be no one left to speak for you…’

Most injured workers are too terrified of the WorkCompsters and their legislated fraud and surveillance and threats, compounding denied medical care and benefits.  Doesn’t that truth make you shake your head and want to shout, “NOT IN THIS COUNTRY!!!”

The Injured Worker stories are the same — minor differences are names, body parts, and case numbers.  The outcomes are much the same too…with degrees of further maligned health,  income and job losses, botched surgeries, risk/cost shifts to taxpayers via Social Security and prison systems, ETC.

Some experts insist that the best injured workers can hope for in America is social security disability and an early death.   Really, some industry investigative reporting from the dark side, huh?

Others suggest that the best American’s can hope for is a program to provide ‘food for the poor injured workers’ rather than LAW ENFORCEMENT FOR MEDICAL CARE AND BENEFITS, indictments from criminal conduct of the WorkCompsters, and the protection by the National Guard for extreme CIVIL AND HUMAN RIGHTS VIOLATIONS IN EVERY STATE IN THE UNION.

Congress didn’t offer assistance with food banks for poor tortured and abused Injured Workers.   Here’s the October 2015 letter where the ten signers clearly offer assistance, that could indeed come in the deployment of the National Guard, since State agencies also fail injured workers, nationally.

“….and whether added authorities are needed to better ensure that the interests of injured workers and taxpayers are protected.”

We say, keep your bags of surplus food out of the legal functioning of WorkComp…ENFORCE THE LAWS THAT ARE IN PLACE TO PROTECT INJURED WORKERS, AND INDICT THE OFFENDERS THAT READILY COMMIT FRAUD WITH INTENT TO DENY MEDICAL CARE, AND WORSE.

If the laws are unenforceable, then there is no choice but to immediately demolish the workers compensation systems and commence trials for the crimes being committed against every Injured Worker in America, and taxpayers, and employers and legitimate service providers.  You could be their next victim.

I am a work comp survivor, who was extremely unsuccessful in finding competent legal counsel.  Nevertheless, in pro per, ‘the parties reached resolution, subject to confidentiality agreement.”  #BloggersSurviveWorkComp

Doctor and Lawyer pals advised to “get out of the workers comp system by any means necessary; it will kill you.”   Some later said that in their entire careers, they never saw anybody fight so hard to survive WorkComp.

One such ‘fan’ suggested that I create a ‘coaching program.’  From that simple encouragement, I began working on a new blog, MyWorkCompCoach.com and an eCourse, Surviving Work Comp and Virtual Combat Skills on Teachable.

Personal ‘rebranding’  post-WorkComp is difficult when hearing fresh horror stories, while being continuously assaulted by industry trolls and their ilk.  It can, however, be accomplished, with a little help from our friends.

I have been a strong advocate for the CompLaude Awards 2014-2015 and I used my resources to also share in the social media communities about the recent 2016 best blogs contest.

A search of the website, AskAboutWorkersCompGravyTrains.com results in pages of and pages of posts about the Comp Laude event.  Ditto for the ‘Best Blogs’ event.  Call it ‘drivel’ if they will.  Sticks and Stones…..

We also shared news of the Sedgwick Institute Linked in group, for what it’s worth, after reading weeks before of the mega-funded SEDGWICK INSTITUTE, allegedly established to investigate the ‘issues’ of WorkComp.  Search my blogs for further info.  Google it.

I blog extensively, to the best of my abilities, as I recover from Worker’s Compensation and brain injury.  My anti-nuclear efforts have suffered tremendously due to WorkComp battles, but it has helped to see the parallels between the ‘PROFITS BEFORE LIVES’ nuclear and insurance industries, and the ‘swaths’ of 21st Century Sonderkommando.

I live near Joshua Tree National Park in California, USA. I am much nicer than I may appear in my blogs, and while my ability to speak is still impaired and challenging, I can speak but written communications are much easier for me, post-injury. They all seem tasked with a propaganda launch to attempt to mitigate the truths exposed in 2015 by ProPublica and NPR efforts that just exposed the tip of the iceberg.  They are apparently having a ‘secret’ national discussion in May…. we’ll see what comes of that, won’t we.  So far, not so good in the open-ness and transparency arenas.  Attacks on Injured Workers seem to be escalating, and tales of WC Nurses posing as employees at doctors offices have been reported to be threatening, intimidating and terrorizing injured workers at doctor’s appointments.  SMH…. thinking, ‘NOT IN THIS COUNTRY!!’

Recent news indicates it will be a secret meeting of a handful of industry influencers, undisclosed location and participants, and may include two ‘injured workers’ and results only will be provided with the public at large.  It seems to be taking place someplace ‘in the Heartland’ (Let’s hope they check Your Radiation This Week for updates on the radiation levels in their city of choice, and that HEPA filters are provided in the meeting room, at the very least! It’s a litigious crowd, they might create a class action for the dangers they are being invited to participate in!)

Do the 21st Century Sonderkommando ‘come in limousines, not tanks!?’  Will they do a preliminary national poll to include all parties involved and knowlegeable about the horrors of American WorkComp practices, or will they ‘shuck and jive’ amongst themselves, just like they do at those expensive high-end conferences at the best joints in America?  Total cost per attendee is factored in to somebody’s bottom line?   Rooms at what, $300/nite plus per diems?  All they can eat and drink?  With a few panels and chats that could reach more ONLINE?

INJURED WORKERS ARE PROHIBITED ALWAYS FROM ALL INDUSTRY EVENTS?   Can’t learn/Can’t teach.  Hmmmmmm.  Talk about segregation and discrimination?   One work comp industry organization actually openly and disdainfully prohibits injured workers of any kind at their events, and allows attendees to bring a guest ONLY if the guest is a SPOUSE?  WOW!  Ain’t that nothing!   Do they do marriage certificate and bed checks, too?

The doctor’s story is common.  The attorney story is HEROIC!   Steve Gursten, Esq.  is an American Hero, and facilitated a win for the First Amendment, and for his truck driving brain injured client. California attorneys could learn a great deal from Steve, and how to truly protect a client, instead of serving them to the insurance industries for a ‘few pieces of silver.’    Maybe Steve should be invited to the Secret Tribunal…. he’s a Michigan PI attorney, obviously not leased/owned by any insurance companies.  The ol’ WorkComp crowd will likely be heavily invested in CYA studies. Will the National Discussion Secret Meeting simply be a polite get-together to suggest that Michael Grabell, Howard Berkes and the teams at NPR and ProPublica were — WRONG?   I’ve read every article in the Demolition of WorkComp series and I have yet to see them seriously straight up address the FRAUD AND CORRUPTION.   Insinuation, yes, but nothing to take to the District Attorneys, yet.  Maybe soon!

Sedgwick pays $1.13 million to settle California comp violations

Will they be discussing the “Lessons Learned By Sedgwick”?   Romano Trust was not enough?   It’s become Romano-Syndrome, hasn’t it?    #Blog4TheCure!  We’ll talk more soon on the Sedgwick Institute and the grants being handed out to long time WorkComp people to keep the merry go round turning?

Maybe a hotline for dying Injured Workers on the rest and wait and wait and opiate program, handled by a third party could be discussed at the Secret Tribunal?

No injured worker under the Sedgwick plan I have been in touch with has any faith whatsoever for any hope for any good faith actions after years and years and years of abuse.  Most have retained more than one attorney, none of whom were able to get reasonable medical care sufficient for return to work, or any other protections.  WHO WILL PROTECT INJURED WORKERS IN AMERICA?!

What do you tell an injured worker who says, “My attorney said he makes so little money on my case, he told me that it doesn’t matter if he returns my calls or not.  When it’s over, he’ll still get the same little bit of money, so he has lots of files and can’t give my case any attention.”  HOW IS THAT ETHICAL OR EVEN HUMANE?  It certainly does not pass any ‘competency’ tests!

When will the attorney groups begin to monitor the horrors they facilitate by such behaviors, and worse?   How about the attorney who says, “Fraud? I haven’t heard that word since law school.  I wouldn’t have a clue how to proceed in exposing that!”   Or the attorney who says, ‘Romano Trust vs. Sedgwick gave the industry the green light to withhold medical care from all injured workers, across America, and risk merely a fine of a maximum of $100,000.  It’s cheaper than medical care in most cases.’

 

How about the Super Lawyers who know about “the issues” that permeate the WorkComp system and shrug and call say “The System Is Broken” ……    Talk about Dodging The Facts!  Sounds complicit to most injured workers!  

How about the attorneys who bank only on ‘high profile cases’?  If that’s the case, it is incumbent on every Injured Worker to CREATE A HIGH PROFILE, BY ANY AND EVERY MEANS NECESSARY.    As Michael Grabell of ProPublica was recently quoted, he said words to the effect that most people don’t give a hoot about WorkComp till they are in the system, and fighting for their life to escape the horrors.  I’ll find the article and post it when I do.

Anybody in the business more than 10 years is surely considered part of the problem? Anybody in the business more than 5 years is surely considered part of the problem.  Heck, ANYBODY IN THE BUSINESS IS SURELY CONSIDERED PART OF THE PROBLEM OF MAIMING AND DISABLING AND YES, KILLING INJURED WORKERS ACROSS AMERICA, FOR PROFITS.   Those who have remained silent, or just left the industry are quite as culpable, wouldn’t you agree?

Will they discuss real issues like fraud, collusion, malpractice?  Will they look at how fake-doctor reports are factored in to the ‘rising medical costs’ in long drawn out WorkComp Cases?  Will they address how paying off an on-the-take doctor to use a bit of slight of hand and deceptions with a touch of plausible deniability to ensure denial of medical care for the $7,000 range, verses necessary immediate medical treatments in the tens of thousands, and life medical in the millions, per case?
FOLLOW THE MONEY. Will they look at the butchery by the “Angels of Death” — Josef Megele-like ‘surgeons’ leased/owned by the WorkComp industries and complications caused by left over foreign objects?

WILL THE NATIONAL SECRET TRIBUNALS DISCUSS THE ISSUES?

Will they discuss the torturous practices of leaving foreign objects behind in a surgery, then cutting off pain meds without corrective surgeries?  Will they look at failures to treat complications after botched surgeries? Will they look at cost-shifting to Welfare and Social Security Disability, and the the trickery of the Long Term Disability Providers and apparent collusion there, also?

I am compiling information on all the non-recommendations and claims evaluations since date of injury, 1/9/12. Apparently I do not have the 2013 correspondence, from CorVel, as much of it was sent by your company to the former defense counsel, after you had been properly noticed to cease and desist. Some of it, if I ever received it, I may have simply misplaced. The pieces I have found do not show proof of service to me. You may recall my emails regarding violations of my HIPPA rights and continued anyway.

If you will kindly send me everything for 2013 I would appreciate it so I don’t have to sort it with the pieces I do have.

Will you please email me Friday morning the complete Non-Recommendations and Modifications and Claims evals for all of Dr. Darren Bergey’s requests for treatment in 2013. Everything from Ballard Brain Rehab, to chiropractic, to accupuncture, to neurology, psychology, neuro-psychology, neuro-optometry and more.

Prior to Dr. Bergey, 2/2013, all failures to provide medical care were handled directly by both the defense law firm and the adjuster, both non-physicians, cleverly avoiding a paper trail. The information and assistance office was of no help to me, and in fact, when I inquired how to deal with the grossly inaccurate and possilby fraudulent reports (per DIR definition of Fraud with intent to deny medical care) ( of Dr. Zardouz, Dr. O’Brien, and Dr. Kent, I was advised to simply write a note saying,”I object to these reports.” I did as instructed, but the fraud was never addressd, and these faulty reports are continuously used as weapons of continuous and egregious harm to me. That is being dealt with shortly, as there are interested Tasks Forces in the Offic of the DA, not the office number Dr. O’Brien dared me to report him to. It’s been over 3 years and I am continuously denied the right to be heard by a WC Judge on my right to medical care. I’m not the only injured worker self-represented. That must change, and it may take Congressional intervention. At least their looking now, huh?

By copy, if Fred Sachs, adjuster, has medical evidence of 2012 denials of requests by Dr. Daniel DeGoede,, Clinical Psychologist I was sent to by the Wyndham Worldwide Employee Assistance program who was the initial PTP and worked closely with Daniel Elliott to organize the first neuro-psychology exams and then briefly Dr. Uppal, appointed by the first law firm I retained, and then the requests by Dr. Marcel Ponton, Clinical and Neuropsychologist, appointed by the Court after a hearing in June 2012 exposing that the MPN was never properly served, and seemed not to exist at all.— PLEASE SEND ME THE 2012 DETERMINATIONS OF DENIALS OF MEDICAL CARE… Doctors didn’t deny, it was non-doctors, but there has to be a process to deal with such matters as well.

The adjuster and I worked very closely in February 2012, trying to find providers in the field of neurology and neuropsychology. Daniel cheated Dr. DeGoede out of several agreed upon and authorized sessions, and left me without any support whatsoever. Had care been authorized in 2012, I would not be writing this email today, and I would not have lost the last 3+ years of my life to such a vile system. Oh well, it is what it is, huh?

Investigative Journalists have taken a further interest in my dilemma, and with all the buzz about CorVel and ProPublica etc….. I want to be able to provide them with all the facts, so people can draw their own conclusions about my case, and the discrimination of injured workers with disabilities like mine, my age, and my gender. . I need the materials also because my civil rights are being further violated by the defense, and the Department of Justice has invited me to share more information, which I will gladly do.

By copy to the Defense firm, while you have repeatedly advised that you have no expertise in ADA and employment law, continued harm caused by your firm will be handled by the proper authorities in due course. Google FEHA, ADA, and Brain Injury.

Ok, pretty please send those 2013 CorVel non-recommendations that I am not copied on and don’t have to me electronically, and was not provided by the PTP, so I didn’t learn much about Maximus till recent corruption articles.

BTW, many of your superiors seem to have quite an appreciation for my LinkedIn profile. Please let them know there is no reason to stalk my wall, I accept all invitations to LinkUp…. friends and enemies alike. The Defense attorney and the Wyndham Risk Manager seem to have a relationship that goes ‘way back’ and I am now fearful that such a conflict of interest may be a factor in the continuous harm to me, and that department’s repeated failures to communicate with me and it’s failures to conduct a long over due claim audit. Michael would never even help me when I asked for help with reimbursements and TTD payments. Awful. That New Jersey politician is taking some serious heat for promoting the CorVel allegations of employee fraud being “40%”…. I suggested it might be an internal statistic, on the low side. Corporate fraud is of extreme interest in the news today. Let’s give them the facts on my case and let the public draw it’s own conclusions, shall we?

I hope most of you never have to experience the extreme horrors this WorkComp charade has put me through.

Do you think this means that because CNA refuses to get me training and treatment so I can return to work (it’s been over 3 years now) that they are breaking this law? And making my employer, WyndhamWorldwide a party to such a law breach?

Looks like disabled people are allegedly already protected… hmmm….just found some things on FEHA while looking for other things…. I have no interest in going to law school to save my life, but surely they can see the value of the state run program, COASTLINE ACQUIRED BRAIN INJURY PROGRAM….they have been helping people with Brain Injuries return to the community and work for over 25 years. All CNA can approve is some chiropractic, acupuncture and evaluations for over 35 doctors…. for brain injuries? D’oh! ain’t that nothing!
