Anybody hurt on the job or in the industry knows that a Work Place Injury can be career altering or career and life destroying.

Some questions to ask about WorkComp Safety Programs and Workers Compensation Insurance coverage and practices can be reviewed below.

Is being informed about the details of workers compensation and long term disability insurance coverage really any different than knowing about the medical, dental, vision, vacation or 401(k) ‘benefits’?

IF EMPLOYEES AND PROSPECTIVE EMPLOYEES DO THEIR DUE DILIGENCE BEFORE ANY INJURY, AND KNOW THE WORKPLACE PROCEDURES TO FOLLOW IN THE UNFORESEEN EVENT OF A WORKPLACE INJURY, MINOR OR CATASTROPHIC, BETTER OUTCOMES FOR ALL CONCERNED MAY TAKE PLACE.

How many Human Resources professionals are totally out of touch with the WorkComp processes and do nothing but hinder efforts for an injured worker to get medical care and benefits.  How few even send a get well card or say, “Feel Better. We hope you’re back to work soon.”  HOW FEW?

How many tell an injured worker, “Sorry, the legal department says we cannot talk to you or help you in any way.”  HOW MANY?

DID THAT MAKE IT THE MAINSTREAM ‘NATIONAL DISCUSSION ON WORKERS COMPENSATION’ AGENDA yet?

local work comp law firms on reputation of carrier.

Ask if HR is allowed to send a get well card or best wishes,
if hurt on the job.

Check also on the name, practices and ‘subrogation’ fine
print of any LONG TERM DISABILITY policy they may offer to
sell you with hire on package.

INVESTIGATE.

prepare to fight for your life!

Hi Linda,
My suggestions: From Day 1 – (If I had it to do all over again)
1. Buy a file cabinet (or empty one) for work comp, you’re going to need it.
2. Always ask for and receive copies of all Dr visit reports, and file every report. If they aren’t accurate – Demand they change them, or send a letter to correct the record and insist it be attached to the file.
3. File and save Every communication you receive from the insurance company.
4. Keep track of all mileage and medical expenses and submit for re-imbursement on the form provided at insurance company website. If items are not re-imbursed within 45 days, re-submit until they are.
5. Do not allow Drs to delay requesting needed MRI’s / CT scans / xrays  – They don’t request so they can continue to charge insurance & medicate patient, only. (If Dr will not request / demand needed testing – FIRE them and find another who will)
6. Do Not fall for the attorney lie….”You just concentrate on getting well and I will handle everything else.” Be active in your case, if your lawyer will not (within reason) communicate / update you – Get rid of him/her. They are doing you more harm than good.
7. Fight for the treatment you need, before it’s too late to correctly fix the problems from your workplace injury.
8. Call, visit, email, your political representatives and make (public) NOISE when they ignore your requests for assistance. If they are not helping you, they are NOT representing you. (That is what they are being paid to do.)

I could probably write a book on this subject but these are my starter points.

PS…I would NOT recommend asking prospective employer about their work comp practices, as it may appear a person is looking for a place to commit workplace injury fraud, which puts the injured worker at risk of attack from day one of injury. (Every lawyer should know that.)

An attorney did also respond [SEE ABOVE]  and said asking about a prospective employer’s safety program would be more desirable than asking about their work comp and Long term disability insurance carriers. I extended thanks and said it was duly noted and would be incorporated.

While I understand and respect your opinion and the attorney’s on that issue…I think getting the facts before they are needed is key to breaking the strangle hold of the intimidation and secrecy that perpetuates WorkComp fraud and abuses and hyper corruption.
 .

In fact, I think the question begs to be asked and can be included as simply as inquiring about heath, dental and vision insurance and 401(k) contributions, particularly in light of the ongoing National Discussions on Worker’s Compensation.

Currently employed people can dig deeper in their own firms!  We will provide some simple FAQs to ask!!

Watch out for those pretending to give a hoot about you and your story…. if they can offer no suggestions for actions, that should be a red flag to you. If they discourage you at every step you take, that should be a red flag to you.
Even in some injured worker group I have seen people try to discourage people from taking action, complaining that nothing has worked for them over the years. Perhaps it’s a content and strategy issue?
If they destroy every opportunity to incite communications and change, THAT SHOULD BE BELLS AND WHISTLES AND A RED FLAG TO YOU.
Beware of people ‘out there’ and ‘in here’ who will attempt to discourage you from saving your own life and finding way to get out of the system.
If it talks like a troll, acts like a troll..it’s probably A TROLL.

Some are so full of themselves, that they knowingly destroy open communications with, for example, the Investigative Journalists of ProPublica and NPR, as well as TV investigative journalists.
Sadly, I included a such few people in some private LinkedIn threads with such reporters in hopes of forging links of further communications.

Those certain initially referenced  individuals destroyed the opportunity for meaningful interaction with those professionals AGAIN with insane rants, totally off topic, and concluded with saying they were going to seek legal action against me for inviting people to share their workcomp story with me without having provided a complete business plan on how I would be able to sort the stories, get them rendered anonymous, edited, published and shared around the globe.

Not all stories submitted would make the cut, but as previously stated, all stories are being prayerfully and conscientiously considered while I seek experts to help put a book together. .
In light of these current threats — the eBook goes on the back burner till I feel like dealing with it again. WorkComp strugles are for the long haul… if you have shared your story with WorkCompLinda, be assured, it is safe. If you haven’t and want to, take a break and answer the questions.
The questions are to guide the story and like one of the ProPublica Reporters said on a podcast… it’s a real drag to do injured workers stories because they go on and on and on and make little sense. Part of that is surely consequences of being a POW and some Stockholm Syndrome.
It, however, IS NOT CONDUCIVE TO INCREASING COMMUNITY AWARENESS.
Only a troll would make such threats and use a professional thread to disparage me, in my humble opinion, and send private messages about how cool it is when industry bloggers demean and disparage injured workers…yet they speak the truth on some other things.

Only a troll member would back it up, and make all injured workers look like drug addicted incoherent idiots. Can’t fix stupid, truly you cannot.
The funniest part is, their submitted stories made as little sense as their destructive off-topic rants on the threads.
So, my story is already out there,and because of that, in part, the parties in my case “reached resolution subject to a confidentiality agreement”

It’s a loss for all of us, and I take full responsibility for having not have the good sense to leave them out of the conversations.
I truly believed they had Injured Worker’s interests at heart, and some people, sadly, are just too damaged by the system, or they are simply paid trolls. It doesn’t really matter which they are—their results are the same.

The response from the Secretary of Labor essentially said the department’s hands are tied, too bad, how sad, deal with it.  That response needs a re-do and needs to include a request to send in protection for Injured Workers and Other Taxpayers across America. There is essentially no law enforcement and there appears to be substantial collusion and many unclean hands in high places.

I, personally, have been personally disparaged in diatribes – publicly and nationally – by  senior members of the Workers Compensation communities in what can only appear to be an attempt to SILENCE me and others by ANY MEANS NECESSARY.  These attacks have been by professionals, carefully crafted with clear intent to harm and silence – by ‘leading experts’ in the field.

HOW RUDE IS THAT!  As a member of a further protected class, thanks to “WorkComp,” I do what I can to help Injured Workers ESCAPE the system with their lives and what is left of their destroyed health.   Einstein reminds that ‘Those who have the privilege to know have the DUTY to act.”  I KNOW. I ACT.

As many of you may know, even a ‘hurt shoulder’ can result in an excruciating long drawn out death for an Injured Worker in America and beyond.

The perpetrators’ credibility has been totally destroyed by their own failures. My work injury was January 2012 and I did not begin to blog about it until Summer 2013. Believe it or not, I was pretty timid and I sure as heck didn’t want people to know I was fighting with a brain injury. D’oh. “I’M INJURED, NOT STUPID!” Nor did I want my nuclear ‘whistle-blowing’ compromised.

The more I learned about WorkComp, the more I saw the similarities in the PROFITS BEFORE LIVES, CALCULATED KILLS of both industries. So, here we are. Connecting more dots.

Being in those ‘creeepy’ doctor mills that were more like morgues for doped zombie was nearly more than I could handle. I talked to people. I gave them my contact info. One office told me I could not talk about WorkComp in the lobby, and they even posted a warning sign. Not too many people spoke English. The sign was posted in Spanish, too.

The parties ‘reached resolution subject to confidentiality agreement’ Fall 2015. Do you think blogging helped? In efforts to rebrand, I started a second WorkComp blog this year, but due to attacks by WorkCompsters, the original blog stands on it’s own. There we can deal with more volatile issues.

What I want to do in this group is help those of you who want to ESCAPE work comp apply some of the principles of action and response that I found valuable. Doctors and lawyers have encouraged me to do what I can to help injured workers. The only way I know how to help you is to teach you about blogging.

There is a business solution that you can employ, with or without an attorney.   That involves MEDIATION and STRUCTURED SETTLEMENT TEAMS.  THE POINT IS TO GET YOUR FREEDOM AND CIVIL RIGHTS AND HUMAN RIGHTS BACK, ‘BY ANY MEANS NECESSARY.’

If you are represented and your attorney won’t help you, consider the value in ditching the attorney and representing yourself. Can you really do worse than what the attorneys have already done to you and for you?

It was brought to my attention that not everybody knows what a BLOG is, and therefore, the power of the blog as a ‘weapon of self-defense’ is not clearly understood. OK! That makes sense.

Quick story, then some links. In 2011, facing extreme periods of Facebook censorship (weeks at a time in the ol’ days, and total lockout!) I had to find alternatives to the censorship being faced by most people screaming about Fukushima Global disaster and the triple nuclear meltdowns.
 .
I asked a buddy at work, a former SEAL, how do I create a blog?? He said he normally charged several hundred dollars, but for me I think he said it would be a couple hundred, or he may have offered to do it for free, but I would have to wait. There was no time to waste, so I figured it out.
 .
I went to wordpress.com, picked a theme and added a title, and I think the first one was AN OPEN LETTER TO THE EMPEROR OF JAPAN (on askaboutfukushimanow.com)

WordPress.COM is easier, imho, than wordpress.ORG and it’s one-stop-shopping, and it’s free. You can spend a little to ensure your readers are not bothered with ads, but it can be 100% free.
 .
You can type a post on FB, copy and paste to a new BLOG post, and voila…. you begin to collect your story so it’s documented and people can get up to speed as time goes by. I have received many calls and emails from people who just wanted to talk, because they thought they were ALONE in fighting for the life, or the life of their loved ones being tortured and abused in the American Workers Comp Systems.

START WITH A SHORT TITLE (I learned that by experience! ) and you can even just build up a collection of posts, you can share with friends privately for feedback and proof-reading, and you can blast it all over FB, Twitter, Google + LinkedIn and beyond.
